As you may know, MCDONALD'S CORPORATION is planning to raze its existing facility located at 1250 West Elizabeth Street (within the "Town Square" development) and replace it with their new state-of- the-art facility, including a dual drive-thru system. Ms. Lisa Lucero-Perman (Project Manager, McDonald's) recently spoke to your associate, Mr. Roger Sherman regarding this project. Per our November 18, 2002 "Site Plan Advisory Review Committee Meeting", Mr. Thomas Reiff (Transportation Planner, City of Fort Collins) noted that the West Elizabeth Avenue street improvement project was "moving forward" and that the City was "currently negotiating" the contract'. Mr. Reiff recommended that we work closely with the selected consultant (at that time the `selected consultant' was not known) to "ensure what [we're] showing along the frontage works within the City's scheme." To bring you upAo-speed on our project, we recently2 submitted the required Minor Amendment Application to Mr. Ted Shepard (Chief Planner, City of Fort Collins) for review and approval. The current timeline goal for this project is to complete the rebuild of the facility before Colorado State University students return for the Fall, 2003 semester. REQUEST TO not dedicate a standard utility easement The Applicant for the minor amendment to the McDonald's at Campus West at 1250 West Elizabeth Street has requested not to dedicate the standard 15' utility easement along the ROW of W. Elizabeth Street. This project will dedicate an additional 9' of Right -of -Way for the street, and proposes a pocket easement for a water meter, but proposes to provide no otl ter utility easements. Regarding signing off on the minor amendment - Engineering has no problems with McDonald's getting a demolition permit, but we won't be able to sign off on the minor amendment until we have signed plans and deeds of dedication for the ROW and easements in hand. I will be out of the office beginning August 28th and will return September 8th, but other Development Review Engineers will be able to work on this while I am out. McDonald's Real Estate Company, what type of company is it? is it an Illinois Corporation? an Alaska i 2. If it is a corporation, then an attest is required for the signature if someone other than the president or v.p. is signing, and this attest should be the Secretary. 3. Since Catherine A Griffin signed as an attorney in fact, we'll need a copy of her power of attorney. 4. If Catherine Griffin is not an attorney at law, then an attorney at law will need to sign the attorney's certification and provide their registration number. If she is an attorney at law, she'll need to provide her registration number below her signature. 5. If you'd like me to return the deeds already submitted, please let me know. Ulster Street - Suite 1303 Denver, Colorado 80237 Dear Mr. Bryant, The McDonald's site located at 1250 West Elizabeth Street in Fort Collins is currently under review by the City of Fort Collins for a minor amendment which was submitted by Huitt-Zollars. This minor amendment shows McDonald's removing and replacing the sidewalk within the new Right of Way (ROW), as well as reconfiguring the eastern driveway to the site within the ROW. The City is currently planning a project to widen West Elizabeth Street, moving the curb and gutter, adding pavement, and changing parkways and landscaping along this block, which is why McDonald's is not being required to perform any of these improvements with this minor amendment. To summarize, the only improvements in the Right of Way now being required for the McDonald's minor amendment are the sidewalk and driveway improvements. Elizabeth Street Dear Sirs: It has come to our attention that the stone water inlet, curb, and sidewalk in the drive -through lane constructed by your company at the McDonald's in Fort Collins was constructed at the wrong elevation. I have been m contact with Mr. Rod Marsh of Deer Creek Corporation and Mr. Waylan Bryant of Huitt-Zollars over the past six months in an attempt to resolve this issue. Those attempts have been unsuccessful. As licensed and bonded contractors with the City of Fort Collins it is your responsibly to construct the improvements according to the approved plans. The inlet, curb, and sidewalk need to be removed and reconstructed at the proper elevation. The improper construction will result in an access problem from the drive -through lane to West Elizabeth Street when the West Elizabeth Street improvements are complete. Our attempts thm Mr. Marsh and Mr. Bryant to coordinate the reconstruction of the West Elizabeth construction with the inlet, curb, and sidewalk reconstruction have failed Therefore, the City project will close the McDonalds drive on June 21' to complete the curb and getter and bike lane reconstruction. The City will construct a temporary asphalt patch along the back side of the West Elizabeth Street improvements. This transition may be abrupt, but will stay in place until the corrections are made to the inlet and curb you installed Please contact Lance Newlin or me at 970-221-6605 to discuss scheduling the improvements needing corrections. Correction of these improvements will avoid further action by the City of Fort Collins toward your bond and license.
