RE; Basement Letter of Agreement Dear Jack: 8101 San Prentice Ave., Smile M180 !Englewood, Cokradu R0111 Pax (303) 290.9097 This letter Is to inform you that Shenandoah Land L.L.C. is ready, willing, and able to grant to Fossil Creek Nursery a sanitary sewer easement for the Nursery subject to the following conditions. 1. Fossil Creek Nursery agrees to restore the casement area by regrading and reseeding and, if applicable, resurfacing concrete or asphalt driveways. 2. Fossil Creek Nursery is to prepare a sunitury sewer easement along with is legal description and descriptive drawing or update to the existing survey for the proposed easement at Fossil Creek Nursery's solo expense. When Fossil Crook Nursery signs an acceptable development agrucment with the City of Fort Collins, Colorado, Shenandoah Land L.L.C. agrees to grant the Nursery an casement patterned after the easement form utilized by the City of Fort Collins. The Nursery will have the notarized casement recorded in the Lorimer County Clerk and Recorder's office. A copy of the recorded casement shall be provided to Shenandoah Land L.L.C. Box 580 Fort Collins, CO 80522-0580 Dear Mike: We have reviewed the Fossil Creek Nursery proposal to move the existing business to a developed site south of Trilby Road. The plans indicate that this business will assume the use of existing buildings. There is no specific mention of the prior use of this property. Impact has been analyzed by a traffic study dated August 14, 1995. We reviewed that study which describes the auxiliary lane needs. That study assumes that all movements will be allowed at the access (left and right turning vehicles). If this property is experiencing a change of use as defined in Section 2.10.3 of the State Highway Access (SHA) Code, the overall access picture should be reviewed and a determination made whether or not this access location is appropriate and what traffic movements to and from the highway should be allowed. It is possible that turns should be limited to right-in/right-out. Access The traffic study identifies a right deceleration lane of 450 feet plus a 270 foot taper. Those lengths are appropriate provided a 40 foot turning radius is constructed. This study further states that the right turn lane would be constructed within the existing paved Shoulder area. No mention is made of the shoulder width. The taper calculation has been based upon a 12 foot turn lane which we, at the Department, would like to see. Any access improvements and any restriction of turns to and from the highway must be documented by a State Highway Access Permit obtained from the City as the issuing authority. That permit must be finalized prior to any activity within the State Highway right-of-way (ROW). Landscaping The preliminary landscape plan shows deciduous trees within the State Highway ROW and deciduous and ornamental trees just west of the ROW line. The Department requests that no trees be planted within the ROW and advises that the addition of trees very near the highway can cause drifting and icing problems along the roadway. Also be advised that landscaping shall not obstruct sight distance at any State Highway access. Utilities If new utility lines or connections are necessary within the State Highway ROW, please contact Mr. Henry Rangel at (970) 350-2111 in order to obtain a utility permit.
