RODENBERGER, RECORDER - LARIMER COUNTY CO STATE DOC FEE - ORDINANCE NO. 131, 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF AN UTILITY EASEMENT IN NAZARENE CHURCH P.U.D. WHEREAS, the Council of the City of Fort Collins has been petitioned by the Developer of the Fort Collins Retirement Nazarene Church P.U.D. to vacate a portion of a utility easement more particularly described below; and WHEREAS, the Developer has obtained approval of an administrative change to build a parking structure to provide protection for 16 parking stalls in the parking lot; and WHEREAS, the parking lot was dedicated as a blanket utility, drainage and public access easement on the recorded plat; and WHEREAS, no underground utilities exist in the portion proposed to be vacated, and the area will remain as a parking area and a storm drainage detention pond; and WHEREAS, City agencies and Utility companies have been contacted and report no problems with the vacation; and WHEREAS, there will be no cost to the City in making the proposed change in the Easement; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the portion of the utility easement dedicated on the plat of Nazarene Church P.U.D., recorded with the Larimer County Clerk and Recorder described more particularly as follows, to wit: A tract of land located in the Southeast Quarter of Section 24, Township 7 North, Range 69 West of the 6th P.M., City of Fort Collins, Larimer County, Colorado, being more particularly described as follows: Considering the East line of the Southeast Quarter of said Section 24 as bearing South 00°13'30" East and with all bearings contained herein relative thereto: Commencing at the East Quarter corner of said Section 24; thence along the East line of said Southeast Quarter of Section 24, South 0°13'30" East 629.65 feet; thence, South 89'46'30" West, 351.95 feet to the POINT OF BEGINNING; thence, South 0021'21" East, 82.00 feet; thence, South 89°38'39" West, 40.00 feet; thence, North 0°21'21" West, 82.00 feet; thence, North 89'38'39" East, 40.00 feet to the Point of Beginning. The above described tract of land contains 3,280 square feet and is subject to all easements now on record or existing. be, and the same hereby is vacated, abated and abolished. Introduced, considered favorably on first reading, and ordered published this 1st day of September, A.D. 1987, and to be presented for final passage on the 15th day of September, A.D. 1987.
