RODENBERGER, RECORDER — LARIMER COUNTY CO STATE DOC FEE— $.00 ORDINANCE NO. 117, 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE BLANKET UTILITY EASEMENT LOCATED IN THE FOOTHILLS FASHION MALL WHEREAS, the City of Fort Collins has been petitioned by Everwest Partnership as an Owner and Developer of the Foothills Fashion Mall to vacate a portion of the blanket easement as platted with the Foothills Mall Plat described more particularly below; and WHEREAS, Everwest Partnership is requesting the vacation to allow the expansion of the proposed Mervyns Department Store; and WHEREAS, City Departments and Utility Companies have been contacted and have no problems with the vacation; and WHEREAS, all utilities currently located in the portion of the easement to be vacated will be relocated by the Developer at the Developer's expense; and WHEREAS, there will be no costs to the City in vacating the utility easement; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the portion of utility easement at the location of Mervyns Department Store, recorded with the Larimer County Clerk and Recorder described more particularly as follows, to wit: An "L" shaped strip of land, 30 feet wide on the westerly leg and 20 feet wide on the easterly legs, which is located on Tracts 1, 2, and 5 of the Repl at of Tracts A, B, L, M, and N of Southmoor Village Fifth Filing, Fort Collins, Colorado, which begins at a point which bears S 70° 47' 51" W 646.08 feet, and again S 44° 45' 30" W 10.00 feet from the Northeast corner of said Tract 5 of said Replat, and runs thence along the westerly leg of said 30 foot wide easement, S 44° 45' 30" W 380.00 feet; thence S 89' 45' 30" W 14.14 feet; thence N 45° 14' 30" W 20.00 feet; thence N 44° 45' 30" E 410.00 feet; thence S 45° 14' 30" E 30.00 feet; thence along the easterly legs of said 20 foot wide easement, S 45° 14' 30" E 22.00 feet; thence N 440 45' 30" E 94.50 feet; thence S 45° 14' 30" E 175.00 feet; thence S 44° 45' 30" W 20.00 feet; thence N 450 14' 30" W 155.00 feet; thence S 44° 45' 30" W 94.50 feet; thence N 45° 14' 30" W 42.00 feet to the point of beginning. be, and the same hereby is vacated, abated and abolished. r; ash �qs Introduced, considered favorably on first reading, and ordered published this 4th day of August, A.D. 1987 and to be presented for final passage on the 7th day of June, A.D. 1988.
