RESOLUTION NO. PZ95-6
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A DRAINAGE AND
UTILITY EASEMENT ON LOT 7 OF
FAIRBROOKE P.U.D., 7th FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate
certain easements and rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of Lot 7 of Fairbrooke P.U.D., 7th Filing
has requested the vacation of a portion of a drainage and utility
easement on said Lot and more particularly described on Exhibit
"A", attached hereto and incorporated herewith; and
WHEREAS, the owner has been granted a variance to the
sideyard setback; and
WHEREAS, the vacation request has been reviewed and approved
by the pertinent City and private utility agencies and they
report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the portion of the
drainage and utility easement on Lot 7 of Fairbrooke P.U.D., 7th
Filing, more particularly described on Exhibit "A" attached
hereto and incorporated herewith, be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 27th day of
March, A.D. 1995. 1

Colorado, which begins at a point which bears S 4 V 13' 56"
W 19.58 feet and again S 89' 46' 03" E 5.22 feet from the most
Northerly comer of said Lot 7 and run thence S 88' 46' 03" E 1.31 feet;
thence S 41' 13' 56" W 141.86 feet; thence along the are of a 52.00 foot
radius curve to the left a distance of 1.10 feet, the long chord of which
bears N 23' 39' 26" W 1.10 feet; thence N 410 13' 56" E 140.55 feet to the
point of beginning.
