The approved roadway plan was prepared and is being constructed by the City with an approved right-of-way of 50 feet from the roadway centerline to the property frontage. The new city standard requires 57.5 feet from the roadway centerline to the property frontage for arterial streets. The development must be aware that an additional 7.5 feet of right-of-way will have to be dedicated along Shields Street in order comply with the new city standards. 2. An additional 12 feet of right-of-way will have to be dedicated along northbound Shields Street to provide a right -turning movement onto Wabash Street traveling eastbound. Originally, the :right-of-way required for the right turning movement was to be purchased and developed by Four Season Condominiums. The review process will dictate the party who is responsible for dedication and development of the right turning movement. At this time we recommend that this development dedicate the right-of-way. 3. According to the Master Street Plan Wabash Street is a two-lane collector. However, when Four Seasons Condominiums proposed their development Wabash Street was designated as a two-lane connector with a roadway width of 36 feet and a right-of-way width of 57 feet. This development must be aware that the City may require an additional 4.5 feet of right- of-way from the roadway centerline to their property frontage depending upon the Four Seasons review process. This development proposal is being reviewed under the Land Development Guidance System (LDGS). The proposal is for a new multi -story church facility and associated parking on a site that is 14.9 acres in size. The LDGS is in the process of being phased out to allow for implementation of the City's adopted Land Use Code LUC . Basically, the expiration date for projects to be able to be accepted and reviewed under the LDGS is January 17, 2000. The expiration date would not affect this development proposal (since a final development plan has been submitted) unless the plan were to be withdrawn and resubmitted at a later date. 2. Jim Slagle of Public Service Company offered the following comments: a. PSG needs a 9' wide utility easement at the back of sidewalk along Wabash Street. b. PSC: needs a 9' wide utility easement along South Shields Street that is east of and adjacent to the waterline easements. Please contact Jim, at 225-7843, if you have questions about these comments. 3. The City's (Right -of -Way Planning Department stated that it is important for the 1.5' strip (of right-of-way encroachment into the property, as shown on the subdivision plat) along Wabash Street to be resolved. 281 North College Avcnue • PO. Show placement of all HC ramps on the Site Plan and denote with an "R". b. Show pole -mounted light fixture locations. Also, information about the height of the poles and the type of lighting should be provided on the Site Plan. C. For your information, the proposed monument sign at the South Shields StreeUWabash Street intersection will need to be closer to Wabash as the sign further south on Shields will be the allowable Shields Street signage. d. RE: Plant Note #13 on the Planting Plan — item quantities on the Plant List should match the number shown on the actual Planting Plan itself. e. A shadow analysis is required for all buildings over 40' in height. As a minimum, portions of this building are 48' high. f. Are the turf grass areas to be sod or seed? Please clarify. City staff would prefer sod. g. It appears that the outdoor fellowship area at the northwest corner of the building is accessible only from inside the building. The perimeter landscaping looks like it blocks any outside pedestrian access. Provisions for outside access is recommended. If there already is outside access please clarify that on the plans. h. The "possible future expansion areas" must be better defined and labeled on the Site Plan. The Statement of Planning Objectives narrative says that these future expansion areas are "shown, but screened" on the PUD. It is not clear what "screened" means and it is difficult to tell where these areas are. Also, these expansion areas must have a dimensioned building envelope around them, with distances shown to property lines. i. More landscaping should be included on the east and south sides of the parking lot areas to provide more screening from adjacent residential properties. A 6' high fence should also be provided along the residential lot lines to help screen auto headlights. j. On the Site Plan, show building envelope dimensions and distances to the nearest property line. k. Where is the proposed trash enclosure? It needs to be shown and labeled. Please contact Jenny, Gary, or Peter at 221-6760 if you have questions about these comments. 5. A copy of the comments received from Rick Lee of the Building Inspection Department is attached to this comment letter. 6. Ron Gonzales of the Poudre Fire Authority offered the following comments: a. Address numerals shall be visible from the street fronting the property, and posted with a minimum of 6" high numerals on a contrasting background (example: bronze numerals on a brown brick are not acceptable). b. Fire hydrants are required, with a maximum spacing of 600' along an approved roadway. Each hydrant must be capable of delivering 1,500 gallons of water per minute at a residual pressure of 20 pounds per square inch. Hydrants shall be of an approved type as defined by the water department and the fire department. No commercial building can be greater that 300' from a fire hydrant. C. The use and size of this proposal requires that fire sprinklers be installed in the building. d. A fire lane is required on -site. This fire lane shall be visible by painting and signage and maintained unobstructed. A fire lane plan shall be submitted prior to installation. e. A manual fire alarm system is required for this proposed project. EXCEPTION: Manual fire alarm boxes are not required when an approved automatic sprinkler system is installed which will immediately activate the pre-recorded announcement upon water flow. f. Poudre Fire Authority requires a "Knox Box' for immediate key access to be mounted on the front of every new building equipped with a required fire sprinkler system or fire alarm system. Please contact Ron, at 221-6570, if you have questions about these comments. 7. Doug Martine of the Light & Power Department offered the following comments: a. Light & Power will need an 8' wide utility easement along Wabash Street. b. The developer will need to coordinate the electric system and transformer location with the Light & Power Engineering Department. Please contact Doug, at 221-6152, if you have questions about these comments. 8. The Mapping and Drafting Department stated that the legal description and outside boundary close. Also, please submit a plat, not an ALTA Survey. 9. Matt Baker of the Engineering Department, representing Street Oversizing, offered the following comments: a. South Shields Street was constructed by street oversizing in 1998. A repayment from this development will be due for the local access portion of the construction cost, to include an inflation factor. Please contact Man/ Shaffer, at 221-6109, for the amount due. b. The City prefers that utility connections not be cut into the new pavement on South Shields Street. Please coritact Matt, at 224-6108, if you have questions about these comments. 10. Kathleen Reavis of the Transportation Planning Department offered the following comments: a. Add a walkway off of South Shields Street, at the south end of the building area. b. Clarify the detached walk along Wabash Street. C. Complete a sidewalk to the east (a short distance) along Wabash Street to connect into the existing sidewalk. d. Add a pedestrian walkway (south to north) in the south parking lot. e. Can a pedestrian connection be made to the east? Without seeing adjacent land use information it is difficult to know if this is possible or not. f. Does Transfort need a bus stop on South Shields Street? Check with Gaylene Rossiter. She can be reached at 221-6195. Additional comments are on a red -lined Site Plan that is being forwarded to the applicant. Please contact Kathleen, at 224-6140, if you have questions about these comments. 11. Dennis Greenwalt of AT&T Cable Services stated that they would like to see public utility easements along the right-of-way for both South Shields Street and Wabash Street. 12. Please contact Donald, at 221-2053, if you have questions about his comments. 15. Ward Stanford of Traffic Operations offered the following comments: a. Show the current South Shields Street layout, flowline to flowline, for 500' north and south of this project, as well as the intersection of South Shields Street and Wabash Street for 200' west on Wabash Street. Please include striping, medians, etc. b. Show proposed striping on Wabash Street east of South Shields Street. C. Consider widening the church accesses on Wabash Street to allow for left and right turn lanes for exiting traffic. This would improve the alignment of the left turn lanes with the multi -family access across Wabash Street, to the north. Please contact Ward, at 221-6820, if you have questions about these comments. 16. Tim Buchanan, the City Forester, stated that, for clarification purposes and to ensure that: the applicant gets the tree desired, he is suggesting that the scientific and common names be adjusted for the following plant: applicant lists: Pinus strobus .......... Western White Pine adjust name to: Pinus strobiformis ... Southwestern White Pine The following comments and concerns were expressed at Staff Review on December 8, 1999: Engineering (Mark McCallum 17. The existing i and proposed sidewalks on -site and in the area need to be shown clearly on the plans. 18. The utility plans need to show the limits of street repair associated with this development. 19. The subdivision plat is somewhat confusing. 20. A 15' wide utility easement is needed along South Shields Street and a 9' wide utility easement is needed along Wabash Street. 21. Easements for all drainage facilities (on -site and any necessary off -site) must be provided on the subdivision plat or through separate documents. 22. Is there an existing center median in South Shields Street that would make the south access to this site a right-in/right-out only? 23. All parking spaces on -site are shown to 18' deep. The standard minimum depth is 19' for a standard, full-size vehicle (without accommodation for overhang). Stormwater (Basil Hamdan 24. The proposed parking area in the southeast portion of the property appears to be encroaching into the drainage overflow channel along the south property line. This would '.not be allowed because the flows cannot be impeded. 25. The utility plans do not appear to be good for final approval. There are easements missing. 26. Are there 2 sets of inlets proposed? 27. How does the on -site grading tie into the adjacent existing neighborhood? Off - site information and grading is needed. 28. The drainage plan needs to look at off -site street capacities for storm water. 29. Is the detention pond area sized correctly to accommodate the storm drainage for this development? 30. The southern portion of this development can outlet storm water into the south overflow channel. Please talk to Basil about the drainage basin map for this area. An update to the drainage master plan may be appropriate. Transportation Planning (Kathleen Reavis) 31. This development should construct an off -site sidewalk to the east, along Wabash Street, to connect with existing sidewalk. 32. Check with GayLene Rossiter of Transfort to see if a transit stop is needed on South Shields Street along the church frontage. 33. There are internal sidewalk issues that need to be addressed. 34. How big is the church, actually? Where are the "proposed" expansions? Traffic Engineering (Ward Stanford) 35. Wider curb cuts should be provided along Wabash Street. 36. The signing & striping plan for Wabash Street should be submitted to the City for review. 37. What is the status of parking or "no parking" along Wabash Street? Is there designated "no parking" now? Planning 38. A larger context map for the area should be submitted. This will help understanding the vehicular and bicycle/pedestrian circulation patterns in the area. 39. More internal sidewalk connections from the various parking areas to the entries to the church building should be provided. 40. A pedestrian sidewalk/refuge area should be provided in the south parking lot. 41. The sidewalks along South Shields Street and Wabash Street should be better defined and shown on the Site and Planting Plans. 42. A Photometric Lighting Plan should be submitted to the City for review. The plan should specify high pressure sodium as the lighting source. 43. More description is needed on the Building Elevations. No colors are identified. 44. How does the outdoor fellowship area (amphitheater) work with the building? The only access appears to be from the inside of the building. 45. The southerly entrance to the site, along South Shields Street, will be somewhat controlled by a median in Shields Street. Can this be a % movement or full movement entry? 46. It would be good to have a model at the Planning and Zoning Board hearing for the Board members to look at. This is a very large building and it will be helpful to give the Board all the visual assistance possible. 47. The building is more than 40' in height. This requires that a "shadow analysis" be done and submitted to the City for review. Please see All Development Criterion A-2.8 in the Land Development Guidance System. Check with the Zoning Department to see if the steeple/spire and cross are exempt from the height evaluation. 48. Additional landscaping should be provided along the east side of the parking lot areas for good buffering to the existing neighborhood to the east. 49. Additional comments are on red -lined Site, Planting, and Building Elevation Plans that are being forwarded to the applicant. This completes the: staff comments at this time. Additional comments will be forthcoming as they are received from City departments and outside reviewing agencies. Under the development review process and schedule there is a 90 day plan revision submittal time -frame mandated by the City. The 90 day turnaround period begins on the date of the comment letter prepared by the project planner in the Current Planning Department. Upon receipt, the revisions will be routed to the appropriate City departments and outside reviewing agencies, with their comments due to the project planner no later than the third weekly staff review meeting (Wednesday mornings) following receipt off the revisions. At this staff review meeting the item will be discussed and it will be determined if the project is ready to go to the Planning and Zoning Board for a decision. If so, will be scheduled for the nearest Board hearing date with an opening on the agenda. Please return all drawings red -lined by City staff with submission of your revisions. The number of copies of revisions for each document to be resubmitted is on the attached Revisions Routing Sheet. The neighbors did not want a fence erected along the church's property line. The additional plantings will serve the purpose of a buffer / screen. j. It has been brought to my attention that as the result of an agreement between Four Seasons Condominiums and the developer of this property, Wabash Street is to be built by Four Seasons by the year 2000. The City of Fort Collins is not a party to this agreement. 5. The right-in/right-out proposed access movement along Shields Street as indicated by flowlines needs to be located an appropriate distance from drainage easement. The median proposed for this access will also have to be located an appropriate distance from the overland storm water overflow. 6. An existing access for Fort Collins City Church is located approximately on the other side of the drainage easement and in accordance with City standards accesses locate this close to one.another on an arterial street should not be allowed. 7. All plans must represent a minimum of 150 feet beyond the proposed project area. In particular, the Fort Collins City Church access should be included. 8. All accesses aligned less than 200 feet from centerline to centerline must be planned to align on one centerline. In general, the proposed development is in the preliminary stages of review and as a result more detailed plans will need to be obtained in order to adequately review the ability of this proposed site to function with the surrounding area. The 15" sanitary sewer trunk is located in a 20' wide permanent utility easement and a additional 5' utility easement has been added to the north side of the 20' easement, giving a 15' utility casement along the north side of the 15" sanitary sewer trunk 2. Utility easements have been added for all proposed fire hydrants. 3. Existine 15" sanitary sewer and its associated appurtenances along south property line are shown in the overall utility plan and the large-scale utility plan of the south half of the site. 4. All CP test stations, valves, blowoffs and air -release valves shown on the City of Fort Collins water and wastewater system map are shown on the utility plans with the exception of one CP test station which could not be located in the field. 5. All proposed fittings, thrust blocks, valves, etc. were labeled on the large-scale utility plans. 6. Standard general notes pertaining to water line depths and D.I.P. encased in polywrap were included on the overall utility plan and the large-scale utility plans. Potholing of the existing 16" and 36" water mains was not performed. It was assumed that they were installed within the city standard of 4.5-5.5 feet of cover. A complete profile of the 4" water line crossing/lowering at the existing 36" water main was provided on the large-scale utility plan for the south half of the site. The standard crossing/lowering detail was modified to fit the situation and it appears on detail sheet 15. S. There are no profile views with water/sewer crossings. There is no concrete encasement required. 9. All necessary details have been added. 10. The requested 5' utility easement on the east side to the existing easement labeled item 11, are located within a new 9' utility easement requested by PSC. 11. An irrigation tap will not be needed for this development. Water for irrigation will be run through the building off of a 2" service. A signature block has been added to all utility plan sheets 2. Redlines have been addressed Cover Sheet Comments: 1. All redlined notes have been addressed. 2. The vertical control has been connected to City Bench Mark 5-93, and noted on the cover sheet. Drainage & Erosion Control Plan: 1. The site grading had been changed to eliminate most of the storm pipe. The remaining pond out -fall pipe is located within a drainage easement and the R.O.W. 2. The existing and proposed sidewalks have been identified on all sheets. An "R" on all sheets indicates the locations of access ramps. Horizontal Control Plan Sheets: 1. The curb returns for the access drives have been changed to radii of 15 feet. 2. Curves C43 and C45 have not been changed to 50 ft. 3. A 20-ft radios for C 125 was not used, as it will eliminate most of the island. Utility Plan Sheets: l . The proposed sidewalk will connect to the existing attached walk along Wabash at the Northeast property line. 2. The cxistine' Shields street median is not shown, as the median does not extend southward to the proposed entrance. 3. The requested notes have been added to the utility plan sheets. 4. This development proposal is being reviewed under the Land Development Guidance System (LDGS). The proposal is for a new multi -story church facility and associated parking on a site that is 14.9 acres in size. The LDGS is in the process of being phased out to allow for implementation of the City's adopted Land Use Code LUC . Basically, the expiration date for projects to be able to be accepted and reviewed under the LDGS was January 18, 2000. The expiration date would not affect this development proposal (since a final development plan was submitted in a timely manner) unless the plan were to be withdrawn and resubmitted at a later date. 2. Jim Slagle of Public Service Company stated that they have no further concerns or problems with the development proposal at this time. 3. The City's Right -of -Way Planning Department stated that it is important for the 1.5' strip (of right-of-way encroachment into the property, as shown on the subdivision plat) along Wabash Street to be resolved (this is a repeat, reiteration comment). 4. Representatives of the Zoning Department offered the following comments: a. The wording in Plant Note #7 on the Landscape Plan should be changed to read "...the valuation of materials AND LABOR prior to...". The City's requirement is that parking lot screening from the residences to the fast and the church to the south shall consist of a 6' high fence or wall in combination with plant materials. A landscaped visual barrier can be used in lieu of the fence as long as it provides sufficient opacity to block at least 75% of the light from motor vehicle headlights. It doesn't appear that tt�xoposed landscaping will accomplish this yet. The applicant has indicated that additional evergreen trees have been "strategically located to block headlights from cars in drive aisles...". However, the headlights also have to be blocked from cars that are parked in the stalls. When they turn on their lights, they shouldn't shine in the windows of the homes and church. There still appear to be numerous gaps in the landscaping that will allow headlights to penetrate. e. The Exterior Elevations show a Maximum Height of 40'-0" and a T.O.P. of 48'-0". Therefore, the maximum height is 48'. Please change the wording to reflect this. f. The required building envelope dimensions are not on the Site Plan. g. There should be only one building envelope shown on the Site Plan, and it should encompass the whole building (both the proposed building and the possible future expansion). The envelope around just the proposed building should be removed. Building envelope dimensions should be shown for just this final envelope. It would be easier to show dimensions if the envelope is "squared off', rather than having an envelope that follows the Irregular outline of the building footprint. h. While the monument /id sign locations don't need to be shown, the applicant should be advised that, since they are shown, only one main freestanding ground sign is allowed. Signs at the driveway entrances will have: to be of a smaller, traffic directional nature (i.e., "church entrance"). This site is in the Residential Neighborhood Sign District. The Exterior Elevations need to show wall sign locations (not size and content) if the church wants to have building -mounted signs. Address numerals shall be visible from the street fronting the property, and posted with a minimum of 6" high numerals on a contrasting background (example: bronze numerals on a brown brick are not acceptable). b. Fire hydrants are required, with a maximum spacing of 600' along an approved roadway. Each hydrant must be capable of delivering 1,500 gallons of water per minute at a residual pressure of 20 pounds per square inch. Hydrants shall be of an approved type as defined by the water department and the fire department. No commercial building can be greater that 300' from a fire hydrant. C. This proposed facility shall be fire sprinklered. d. A fire lane is required on -site. This fire lane shall be visible by painting and signage and maintained unobstructed. A fire lane plan shall be submitted prior to installation. e. A manual fire alarm system is required for this proposed project. EXCEPTION: Manual fire alarm boxes are not required when an approved automatic sprinkler system is installed which will immediately activate the pre-recorded announcement upon water flow. f. Poudre Fire Authority requires a "Knox Box" for immediate key access to be mounted on the front of every new building equipped with a required fire sprinkler system or fire alarm system. Please include striping, medians, etc. This is a repeat comment (from the City comment letter dated Dec. 20, 1999). b. Show proposed striping on Wabash Street east of South Shields Street. Tim Buchanan, the City Forester, offered the following comments: a. Street trees need to be placed at 40' spacing along South Shields Street in the parkway between the sidewalk and curb (see the attached section of the Landscape Plan). Ornamental trees can be used because of the waterline under the parkway. NOTE: Current Planning can put together a meeting with Zoning, the City Forester, Water/Wastewater, and the applicant to discuss this issue about a street tree/utility conflict. b. The City Forester requests that another type of ornamental tree be substituted for Brandywine Crabs as a street tree. This cultivar does produce some large fruit that can cause a nuisance problem over a street or sidewalk. The applicant should consider these cultivars as substitutes ..... David, Radiant, Thunderchild, Spring Snow, or Centurian. Please contact Tim, at 221-6361, if you have questions about these comments. The following comments and concerns were expressed at the Staff Review meeting on February 23, 2000: Engineering (Marti: McCallum) 15. The entries into the site from Wabash Street should be a maximum of 35' in width. They are show to be 36' wide on the utility plans. 16. A 5' wide sidewalk is being shown along Wabash Street. An additional 0.5' of right-of-way must be dedicated along Wabash Street to provide for the sidewalk. 17. There are issues associated with the subdivision plat. It is somewhat confusing. 18. Are the utility easements along South Shields Street right? It should be clarified as to what is needed. 19. Is the south entry along South Shields Street acceptable for an emergency access lane, from a geometric/design standpoint? Some of the radii in the emergency access lane may not be sufficient. 20. A detail for the south entry from South Shields Street is needed. 21. The nose of the median in the south entry from South Shields Street must be out of the street right-of-way. 22. The street cut limits need to be better shown on the utility plans. The costs for street cuts will be quite large, especially since both South Shields Street and Wabash Street improvements are very recent. 23. This project is responsible for repays on the Wabash Street improvements. 24. The 1.5' right-of-way discrepancy along Wabash Street needs to be processed and resolved. 25. Right-of-way widths need to be shown on the subdivision plat. 26. The actual utility line must be removed from the subdivision plat. Only the utility easement is needed. 27. A cross-section through the outdoor fellowship area should be provided. Stormwater (Basil Hamdan 28. All storm water flows are going from the site north to Wabash Street. The Stormwater Utility wants more flows to go south, to the drainage swale. The applicant's engineer has been made aware of this. 29. The drainage master plan for Four Seasons may have to be revised. Please contact Basil, at 224-6035, to discuss this. 30. No ties to the grading off -site, in adjacent developments, are shown on the grading plan. 31. The detention pond has to be reconfigured. Transportation Planning (Kathleen Reavis) 32. Is the sidewalk along the south side of Wabash Street, to the east of this property, existing so that a continuous sidewalk will be in place? 33. Could the church parking lot be used as a "Park 'N' Ride" during the week? Traffic Operations (Ward Stanford) 34. Show South Shields Street, curb to curb, for 500' to both the north and south of this site. Show Wabash Street, curb to curb, for 200' to the west. 35. The signing & striping plan for Wabash Street should be submitted to the City for review. Planning 36. The actual layout of outdoor fellowship area (amphitheater) is still relatively undefined on the Site Plan. It is difficult to know what is what (walks, steps, walls, turf grass, landscaping, etc.). 37. The southerly entrance to the site, along South Shields Street, must be designed to accommodate emergency access? 38. It would be good to have a model at the Planning and Zoning Board hearing for the Board members to look at. This is a very large building and it will be helpful to give the Board all the visual assistance possible. 39. Additional landscaping should be provided along the east and south sides of the parking lot areas for good buffering to the existing neighborhoods to the east and south. 40. Additional comments are on red -lined Site, Landscape, and Exterior Elevation Plans that are being forwarded to the applicant. 41. Another round of review is needed before this item can be scheduled for a Planning and Zoning Board hearing. This completes the staff comments at this time. Additional comments will be forthcoming as they are received from City departments and outside reviewing agencies. Under the development review process and schedule there is a 90 day plan revision submittal time -frame mandated by the City. The 90 day turnaround period begins on the date of this comment letter (March 1, 2000) prepared by the project planner in the Current Planning Department. Upon receipt, the revisions will be routed to the appropriate City dlepartments and outside reviewing agencies, with their comments due to the project planner no later than the third weekly staff review meeting (Wednesday mornings) following receipt of the revisions. At this staff review meeting the item will be discussed and it will be determined if the project is ready to go to the Planning and Zoning Board for a decision. In the long term the Horsetooth/Century and Wabash/Shields intersections have failing minoir left turn movements at LOS F. The overall LOS at Horsetooth and Century if F. Both of these intersections are stop sign controlled and as stated earlier, in a commercial area. Based on the City's LOS guidelines (p.21), a stop sign controlled intersection in a commercial area has no LOS standard (N/A). Minor left turn movements at local / collector - arterial intersections are common along arterial streets. The failing LOS is usually short term. Therefore the City Traffic Engineer is of the opinion that the TIS is acceptable from a motor vehicle perspective and should be allowed to move forward." 6. The Transportation Planning Department stated the following: a. The TIS is acceptable for bikes, pedestrians and transit. b. Wabash needs to include a minimum of 6' bike lanes (8' width preferred without on -street parking). 7. Public Service Company requires that easements be granted adjacent to Shields Street and Wabash. 8. The Current Planning Department stated the following: a. Pursuant to Sections 2.3.2[C] and 2.3.2[G] of the Land Use Code, this ODP is subject to Planning and Zoning Board (Type 2) review. Therefore, a neighborhood meeting is required for this ODP request. Please contact the Current Planning Department to schedule the neighborhood meeting. b. Section 2.3.2 [H] of the Land Use Code outlines the criteria which are applicable when reviewing an ODP request. Criteria 1 states: "The overall development plan shall be consistent with the permitted uses and applicable zone district standards (Article 4) of all zone districts contained within the boundaries of the overall development plan and shall also be consistent with any applicable general development standards (Article 3). If the overall development plan contains any land within the MMN, CC and / or NC Districts, the plan shall be consistent with the land use requirements, block size requirements and permitted uses of the block standards for those districts." The subject property is zoned MMN, Medium Density Mixed Use Neighborhood. The block standards of the MMN District are described in Section 4.5[E] of the Land Use Code. Section 4.4[E][1][a] of the Land Use Code states: "Each Medium Density Mixed -Use Neighborhood and each development within this District shall be developed as a series of complete blocks bounded by streets (public or private).... Each geographically distinct district must contain a minimum mix of different block types asset forth in (Section 4.5[E][1 ][b])." This particular MMN District consists of the subject property (15.55 acres) and the Four Seasons Condominiums property (14.85 acres) for a total of 30.40 acres. According to Section 4.5[E][1][b], a minimum 85% (25.84 acres) of this MMN District must be developed as residential blocks. Since the Four Seasons Condominiums PUD property is 100% (14.85 acres) residential, 71 % (10.99 acres) of the Faith Evangelical Free Church property must be residential blocks with a maximum block size of 7 acres and an overcall minimum average density of 7 dwelling units per net acre. The remaining 29% (4.5 acres) of the Faith Evangelical Free Church property could be a Civic Block for the new church. The applicant's proposal for one Civic Block of 15.55 acres does not comply with the Block Standards of the MMN District. There appear to be 3 options if the applicant wishes to proceed with the request on this property. First, the applicant can request Modifications to the Block Standards. It appears that the applicable criteria for considering Modification(s) of Standards would be Section 2.7.3[A]. However, staff support of a modification for the proposal (as submitted) will be highly unlikely as it is difficult to justify that the current proposal does not "impair the intent and purposes of this Land Use Code"; and that "the plan as submitted will advance or protect public interests and purposes of the standard ....... equally well or better than would a plan which complies with the standard..." The second option would be to apply for a rezoning of the property. In doing so the applicant would need to request a district which allows "Places of worship or assembly"; a district which does not have Block Standards; a district which does not have Land Use Standards (such as maximum building footprints, etc. unless a modification of standard is requested); and a district that is consistent with the City Structure Plan. However, please note that a rezoning must be justified by criteria in Section 2.8.4[H] of the Land Use Code. The third option would be to place the project on hold and advocate for revisions to the MMN District block standards. c) Please revise the ODP to label the Four Seasons Condominiums are "proposed". d) Please revise the general note regarding permitted uses to reflect the uses that are proposed. e) The access from South Shields Street needs to be moved further north due to Stormwater comments. f) Please revise the Planning Objectives document. The request for an ODP does not change the zoning of the property. 9. Comments from the Stormwater Utility are attached. Please note that pursuant to Section 2.3.2[H][7] of the Land Use Code, "the overall development plan shall be consistent with the appropriate Drainage Basin Master Plan." 10.
