PfAINTENANCE COVENANT
The undersigned, owner of Ed Carroll Volkswagen, Fort Collins,
Colorado, hereby covenants with the City of Fort Collins, Colorado, that in
consideration of the approval of the P.U.D. of Ed Carroll Volkswagen, the
undersigned agrees to maintain all landscaping, parking areas, and sidewalks
as shoc:n on the site and landscape plans of the Ed Carroll Volkswagen P.U.D.,
and to keep said open spaces clean and in good repair.
In the event of the failure of the undersigned, or its assigns, to
keep said spaces clean and in good repair, the City of Fort Collins, upon 24
hours notice to the undersigned or its assigns, may proceed to clean, repair
or maintain said spaces, and any cost expended by the City of Fort Collins
for such work shall be an obligation of the undersigned or its assigns. Upon
failure to pay for such work, the City of Fort Collins may file a lien against
said property, obtain a judgment against the undersigned or its assigns, and
foreclose said lien.
This shall be a covenant running ndth the land, and shall be binding
upon the undersigned and its assigns.

NOTICE
Please take notice that on July 24. 1989, the Director of Planning of the City
of Fort Collins, Colorado, approved the Final Plan known as Ed Carroll
Volkswaeon-Audi Amended PUD, which development was submitted and pro-
cessed in accordance with Section 29-526 of the Code of the City of Fort
Collins. The Final Plan of the subject property is on file in the office of the
Clerk of the City of Fort Collins.
The subject property is more particularly described as follows:
A tract of land situate in the Northeast Quarter of Section
26, Township 7 North, Range 69 West of the 6th Principle
Meridian, Fort Collins, Colorado.
