RESOLUTION NO. PZ93-13
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A UTILITY EASEMENT
ON LOT 23 OF THE ORCHARD AT CLARENDON HILLS
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner has requested that the City vacate a
portion of a utility easement, more particularly described on
Exhibit "A", attached hereto and incorporated herewith; and
WHEREAS, the vacation request has been reviewed and approved
by the pertinent City and private utilities and they have no
objections; and
WHEREAS, the vacation request to the City pertains only to the
utility easement and does not pertain to the private irrigation
easement existing on Lot 23.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the portion of the utility
easement on Lot 23 of the Orchard at Clarendon Hills, more
particularly described on Exhibit "A", attached hereto and
incorporated herewith, be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 25th day of
October, A,D. 1993.
This resolution was previously recorded. It is being re -recorded to include
Exhibit A.

DESCRIPTION OF PROPOSED EASEMENT VACATION
A part of Lot 23 of The Orchard at Clarendon Hills, City of Fort Collins, County
of Larimer, State of Colorado, which begins at a point which bears S 81' 54'
50" W 10.11 feet, and again S 00' 29' 40" W 10.11 feet from the Northeast corner
of said Lot 23 and run thence S 00' 29' 40" W 10.11 feet; thence S 81' 54'
50" W 125.70 feet; thence along the arc of a 196.00 foot radius curve to the
left a distance of 10.03 feet, the long chord of which bears N 03' 41' 12" W
10.03 feet; thence N 81' 54' 50" E 126.43 feet to the point of beginning.
