ME?fONANDUM OF AGREEMENT made and entered into this 16th day of
February, A. D. 19511 by and between NORTHERN COLORADO LOHN ASSOCIATION, a
Corporation, and H. L. KRUG, hereinafter designated as parties of the first
part, and THE CITY OF FORT COLLINS, CCLORaDO, a Municipal Corporation, herein—
after designated as party of the second part, WITNESSETH:
WHEREAS, a certain proceeding is now pending in the District Court in
the County of Larimer, State of Colorado, being Civil Action No. 10537, and
WHERI,AS, the parties hereto desire to compromise and settle said.

NOW, THEREFORE, in consideration of the premises and the terms of
this agreement it is mutually agreed as follows:
1. First parties agree to and do herewith pay unto second party the
sum of $5,000.00.
2. In consideration of said sum and the dismissal of the above
mentioned Court proceeding with prejudice, second party agrees to repair and
rebuild the street surfaces and interior alleys in Circle Drive Subdivision
in the City of Fort Collins, Colorado, in accordance with specifications
therefor which are attached heretc and made a part hereof by reference thereto.
3. Second party agrees to commence said work_ as soon as possible and
to proceed to completion as fast as weather permits, but in any event to have
the work completed by July 1, 1951, provided, however, that there shall be
added to said period the time of any delay occasioned through inability tc
obtain materials„
6. When the work is completed in accordance with the attached
specifications second party agrees to accept the improvements so constructed
as a satisfactory special improvement and to assume the usual obligation of
maintenance thereof, and waives improvement to alleys in said subdivision not
improved under this agreement.
IN WITNESS WHEREOF first parties have hereunto set or have caused
their names to be set by their duly authorized officers, and second party
has caused this agreement to be executed by its Mayor pursuant to Resolution
duly adopted by the City Council of the City of Fort Collins on the
day of February, A. D. 1951.
