An additional 5.5 feet right of way on James Court, added to the existing 20- foot right of way for a total of 25.5 feet from the centerline. 3. A 9-416ot utility easement on James Court. You may advise the City of Fort Collins that MY wife and I are inclined to negotiate an easement that would permit the erection of this wall. At the present, the only Conditions would be that my legal fees and expenses related to negotiating the easement in.. such a way that I am able to ensure that my feature development rights are not negatively impacted would be paid for. We expect the negotiations would be limited to making determination that the zoning requirements, the size of the easement and obtaining commitments from the City relative to future development rights will not be impacted by the casement, and tlc actual negotiations of the terms themselves. 'If this commitment by us appears to be in line with your expectations, please cal me so that we c.an commence work towards a mutually satisfactory solution. s a Very truly yours, Roger V.
