It is a very real health and safety hazard to the general public and I must insist that this work be done immediately. Your failure to comply will result in the City not releasing any certificates of occupancy for the buildings now under construction and refusal of any other building permits that your builders might request. Your cooneration in this matter will be greatly appreciated. These streets are still under your construction warranty and it is your responsibility for maintaining and repairing them. In order for the City to accept these streets, all necessary repairs should be made as soon as possible. CARROLL,JR- September 22, 1980 Mr. Roger Rrempel Director of Public Works Post Office Box: 580 Fort Collins, Colorado 80522 Dear Roger: TELEPHONE AREA CODE 303 482-4322 As you know, I represent Bartran Homes, the Developer of the Collindale Subdivisions located east of Lemay and North of Horsetooth Road. I am writing to you regarding the road improvements for Horsetooth Road adjoining the Subdivisions. The utility plans are all in and approved by the City. Bartran Homes is ready to install their share of the road improvements. They are concerned, however, that installation of only their portion of the improvements will create a vary hazardous situation for motorists along this stretch of road. They are also concerned about the present status of the road and hazards which exist at this time. The City owns the property on the other side of Horsetooth Road and it will be the responsibility of the City to install the improvements on this portion. Bill Bartran has discussed this with engineering and indications have been given that the City :is not ready to install its share of the improvements. It appears from our standpoint that there are three possible solutions to this problem, as follows: 1. Bartran Homes will install the road improvements on their half of the road in accordance with the approved subdivision plans provided the City assumes in writing all liability for any injury or damage which may be caused by the condition of the road after the improvements are installed in accordance with the approved plans. 2. Bartran Homes will obtain bids for their share of the work and pay to the City their share of the cost of the work based :upon such bids. The City would then assume responsibility for all improvements to be made to Horsetooth Road and liability for any injury or damage which may be caused because of the present condition of this road. 3. Bartran Homes will install its share of the improvements this Fall with the City to install its share of the improvements at the same time. This appears to be the most desirable solution and depends only upon the ability of the City to finance its share of the improvements at this time. Box 469 Fort Collins, Colorado 80522 Dear Art, In response to your letter of September 22 suggesting alternatives for the construction of Horsetooth Road adjacent to Bartran's Collindale Subdivision, we find Alternative 3 most acceptable, under certain conditions., Alternative 1 and 2 are not acceptable. Under Alternative 3 if all of the necessary work were to be completed by Bartran we would attempt to include the City's share of the cost in a 1981 bond issue for city street oversizing costs. We could then repay Bartran for the City's portion of the work when funds become available. We have had to have developers carry the City's share of cost for work such as this for over a year. Perhaps Bartran would be able to do this with an agreed upon interest rate. If you are anxious to proceed yet this fall, we need to meet and discuss this, otherwise we should be able to work out funding over the winter. Since ely, oge K er mpel, P.E.
