AGREEMENT
THIS AGREEMENT is made and entered into this / 7 day of October,
1980, by and between THE CITY OF FORT COLLINS, COLORADO, a Municipal
Corporation, and JERALD RUSSELL.

WHEREAS, Jerald Russell is the owner of Lot A, Case Subdivision,
situate in the Southwest 1/4 of Section 16, Township 7 North, Range 69 West
of the 6th P.M., City of Fort Collins, Colorado; and
WHEREAS, Jerald Russell has requested of the City the issuance of
building permits for the construction of improvements upon said Lot A;
and
WHEREAS, on March 16, 1978, a subdivision improvement agreement
between the City of Fort Collins and Kay and Gregory S. Case was executed
in connection with said Case Subdivision; and
WHEREAS, the City has determined that it is necessary for the general
welfare of the community that Jerald Russell be bound by the conditions as
contained in said subdivision improvement agreement, a true and correct
copy of which is attached hereto as "Exhibit A".
NOW, THEREFORE, in consideration of the premises and the terms and
conditions herein stated and other good and valuable consideration, the
adequacy of which is acknowledged by the parties hereto, it is agreed as
follows:
1. That upon issuance of a footing and foundation or other building
permit to Jerald Russell for the construction of improvements upon Lot A,
Case Subdivision, City of Fort Collins, Colorado, said Jerald Russell does
agree to comply with and be bound by all terms and conditions as contained
in that certain subdivision improvement agreement executed on March 16,
1978, by and between the City of Fort Collins, Colorado, and Kay and
Gregory S. Case.
2. This agreement shall be binding upon the parties hereto, their
heirs, personal representatives, successors and assigns.
