according to the recorded plat thereof, and in consideration
of the approval of said plat by the CITY OF FORT COLLINS,
hereby acknowledges the following obligations on behalf of
herself, said property, her heirs, executors and assigns and
declares that the obligations as contained herein shall be a
covenant and obligation running with the ownership of said
Arthur Subdivision as follows, to -wit:
1. The curb cut as detailed on the utility plan for
said subdivision dated March 11, 1974, page 1, shall be
revocable at: the option of the City of Fort Collins when the
service road on the east side of South College Avenue
running from Rutgers Avenue to Spring Creek Drive is fully
developed.
2. The undersigned MAE A. TILEY also agrees at such -
time if necessary, to grade and re -surface the portion of
said subdivision platted as to said service road and to
place the same on the elevation to correspond with South
College Avenue, all as shown on said plans for Arthur
Subdivision and with said grading and re-surfa.:ing to be iI
accordance with the specifications of the City of Fort
Collins. This obligation shall also run with the ownership
of said Arthur Subdivision and be an obligation thereof as
well as the personal obligation on the heirs, successors and
assigns of the said MAE A. TILEY.
