Our initial scope of work involved meeting the maximum noise levels at individual owner property lines, as interpreted from City Municipal Code requirements and as interpreted by City Planning Staff, and others. The following scope is additional to the current contract scope and represents the process we believe will be successful to complete this project: MAJOR AMENDMENT ADDITIONAL SCOPE Sound Modeling - D.L. Adams Associates 1. Sound Modeling Updates - Wall height revisions - Revisions as necessary to meet 55dBA at property line via wall height adjustments and minimal receiving point adjustments. This is the recommended approach from D.L. Adams as a decibal level below 90dBA at the receiv- ing point may prove difficult to attract a variety of performers. 2. Sound Modeling Updates - Receiving point decibal level adjustment and wall height revisions - Revisions as necessary to meet 55dBA at property line via receiving point decibal level adjustments with some wall height modifications. 3. Sound Modeling Updates - Integrated and dispersed sound system design - Develop the option of an integrated sound system and provide a narrative describing the installed system and a cost opinion for the design, purchase, and integration of a permanent system. 4. Permanent noise monitoring system design - Consult and design a permanent noise monitoring system that could be used to aid in the procedural enforcement of noise sources within the gardens. Work with Gardens to establish triggering criteria and appropriate uses for noise monitoring system. Cost estimate to be included. 5. Acoustical modeling process narrative and report - Update formal report to include the direction that is decided upon and provide a complete report including all of our most cur- rent recommendations for use in city zoning and planning hearing. 6. Attend Neighborhood Meeting on Feb. 8th 7. Attend Planning and Zoning Hearing and develop documents required 8. Attend meeting to discuss final sound modeling implications - Attend a meeting in Fort Collins with representatives from the City and the Gardens. BUDGET AND FEE SCHEDULE The following represents the proposed fee for the above tasks. See spreadsheet below for a detailed task/fee breakdown. Find attached D.L. We look forward to continuing working together on the Gardens noise concerns. Basic Additional Services 1. Update the noise prediction modeling based on the adjusted property line requirements as defined by the city attorney. The modeling updates will include two approaches, adjusting the Barrier wall and lowering the maximum allowable noise level. We will rely on the Russel Mills Studio to clarify the property line that is to be used. 2. Attend a meeting in Fort Collins to review the current development proposal with the neighborhood. 3. Attend a meeting in Fort Collins with representatives from the City and the Gardens. Discuss details of the most current plan and the proposed implications. 4. Additional Expert Witness Services We propose to perform the Additional Services described above for an hourly fee of $225 per hour for labor and all related out-of-pocket expenses. Billed time will include travel time as well as time on site. Additional Services Not Included The following services are not included in the Additional Services listed above, but may be added if needed for an additional fee. 1. Full design of sound or performance lighting systems. 2. Further revisions to the acoustical modeling. 3. Attendance at additional meetings beyond those included in the Basic Additional Services. 4. Construction administration services, i.e., respond to RFIs, review shop drawings, site visits. These services can be provided on an hourly, as-needed, basis for labor.
