Attached as a separate CAD file titled “A2.1a.dwg”. 2) Regarding the orientation of the mobile layout; it was noted that the existing overhead lighting was orientated east to west. Normally you want the lighting positioned perpendicular to the units, so that would suggest a north to south alignment of the units. Therefore, the question is, if we were to recommend that the units be aligned east to west, would the City consider re-aligning the overhead lighting to accommodate? Or, based on that requirement, only consider that alignment which corresponds with the existing lighting arrangement? The City would consider re-aligning the overhead lighting if the East-West orientation was the best solution. 3) Standard Four Post Shelving the shelves of which are designed to have “integrated pegs” to fit into upright slots. Verbiage as follows: The shelving shall consist of three basic parts: uprights, shelves, and shelf supports; which are assembled without any loose nuts, bolts, or studs of any kind, without any sway braces or gussets, and with minimal tools. There shall be no holes on exposed surfaces, except that the shelves have two holes for center stops (plus optional slots for dividers/bins, etc.). The front and back flange of the shelf shall be flush with the outside face of the post; and the back, where needed, will be flush with the outside face of the post. Shelves shall be adjustable on 1-1/2" centers. Therefore, are you allowing for any “non-standard” traditional Four Post designed methods i.e. separate; nuts, bolts, or clips to install shelves into uprights? We would prefer what has been specified, but we are open to a solution that would provide us with better value and still meet the intent of the specifications. 4) Should the layout of the rails be designed for only the shelving required by the current inventory of collection storage items? We would like the rails laid out for a full build-out of the room with shelving. REQUEST FOR PROPOSAL 7431 COLLECTION STORAGE EQUIPMENT FOR FORT COLLINS MUSEUM OF DISCOVERY The City of Fort Collins is requesting proposals for the purchase and installation of collection storage equipment in the collection storage area at the Fort Collins Museum of Discovery. Proposals may be submitted by E-mail in either Microsoft Word or PDF format. E-mail submittals shall be e-mailed to: purchasing@fcgov.com. If submitting hard copy proposals, five (5) copies, will be received at the City of Fort Collins' Purchasing Division, 215 North Mason St., 2nd floor, Fort Collins, Colorado 80524. Proposals will be received before 3:00 p.m. (our clock), October 3, 2012 and referenced as Request for Proposal No. 7431. O'Neill II, CPPO, FNIGP Director of Purchasing & Risk Management RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 2 of 25 REQUEST FOR PROPOSAL 7431 COLLECTION STORAGE EQUIPMENT FORT COLLINS MUSEUM OF DISCOVERY Section 1.0 Proposal Requirements 1.1 GENERAL DESCRIPTION The City of Fort Collins is soliciting proposals for the purchase and installation of collection storage equipment for the collection storage area at the new Fort Collins Museum of Discovery, located at 408 North Mason Street, which is scheduled to open on November 10, 2012. A drawing of the collection storage area is attached in Exhibit A. Current Collection Storage Requirements are provided in Exhibit B. Fort Collins Local History Archive Box Count is provided in Exhibit C. These Exhibits A - C provide the area in which the collection storage equipment is to reside and the requirements for storage. 1.2 SUMMARY A. This Section includes the following: 1. This Section includes supply, delivery, engineering and installation of new collection storage equipment and high density mobile storage systems. 2. Due to coordination requirements, etc., bidder must identify mobile system manufacturer with proposal and provide proof of specification compliance for all mobile system components as detailed in section 2.1 through 2.3 of this specification. 1.3 PERFORMANCE REQUIREMENTS A. Due to the delicate nature of the collection, the following specifications and performance requirements are mandatory. 1. Selection Criteria: Selection criteria will be based on an initial proposal and then an interview process in which vendor presents project experience, product quality, qualifications, product support and cost. 2. The purpose of the systems, components, and qualifications described in these specifications is to establish a common system configuration and minimum level of performance from which to compare potential suppliers. It is understood that layout and configuration changes may be incorporated after a contract is awarded based on specific capabilities and solutions. 1.4 SUBMITTALS (Due with Proposal - MANDATORY) A. Product Data: Include installed weight, load criteria, furnished specialties, and accessories. Submit manufacturer’s product literature, schematics, testing data and other items as described in this RFP. Include data substantiating RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 3 of 25 that products to be furnished comply with requirements of the contract documents. B. Shop Drawings: Prepared for detailing fabrication, assembly, and installation of mobile storage unit, as well as procedures and diagrams. Include details of layout and installation including clearances, spacing and relation to adjacent construction in plan, elevation, and section; clearly show exit and access aisle widths; access to concealed components; components, assemblies, connections, attachments, reinforcement, and anchorage. Submit drawings showing location, ranges and extent of system. Show installation details at non-standard conditions. Furnish floor layouts, technical and installation manuals for every unit with necessary dimensions for rail layout and system configuration at the project site. 1. Provide layout, dimensions, and identification of each unit corresponding to sequence of installation and erection procedures. Specifically include the following: a. Location, position and configuration of systems in the collection space. b. Details indicating method and configuration of installation on floor. C. Installer Certificates: Signed by manufacturer certifying that installers comply with specified requirements. (See 1.5 A & B) D. Warranty: Submit a written warranty, executed by the Installer, and Manufacturer, agreeing to repair or replace units which fail in materials or workmanship within the specified warranty period. This warranty shall be in addition to and not a limitation of other rights the Owner may have against the Contractor under Contract Documents. 1. The entire installation will be warranted against defects in materials and workmanship for a period of 5 years from date of acceptance by the Owner. 2. Structural members of the carriage components shall be warranted for the life of the system. E. Project Schedule: Provide a project achievement plan detailing all critical elements necessary to plan, manufacture, ship and install systems. We also want to see a phased plan for installation of rails, fixed shelving and mobile shelving. (pricing for the whole package, pricing for rails and stationary furniture, pricing for rails only) Include critical project milestones, and risk mitigation plan. F. Pricing: Provide pricing broken out as follows: rails only; fixed shelving only; mobile shelving only; and the entire system. G. Reference List: Provide a list of three museum systems installed in the past 5 years of similar size, scope and magnitude to be visited or called by the project manager. Reference list must include system address, description, contact/ phone number, and date installed. RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 4 of 25 H. Provide certificate of insurance outlining coverage types and limits. 1.5 QUALITY ASSURANCE (Due with Proposal - MANDATORY) A. Installer Qualifications: Engage an experienced installation supervisor who is an authorized and certified representative of the manufacturer(s) required for this Project with not less than 10 years’ experience installing systems similar to those required for this project, and licensed or certified by manufacturer. Certification required by manufacturer on manufacturer's letterhead required at time of proposal. Qualification must include resume of certified installation supervisor. B. Other mandatory requirements. Must submit proof with proposal. 1. Manufacturer must have a minimum of 10 years’ experience in continuous manufacture of mobile storage systems. 2. Proposer should be ISO 9001 certified for a minimum of 3 years. Certification from ISO required with proposal. If not ISO 9001 certified, submit manufacturer’s established complete quality control/assurance plan. 3. Proposer must have had all major system elements finishes, lubricants, etc. chemically analyzed and tested for emissions, volatiles, etc. System shall be inert. Must supply test results from independent test lab with proposal. 4. Proposer must provide ongoing maintenance plan. 1.6 PROJECT CONDITIONS Field Measurements: Provide unit locations by field measurements and indicate measurements on Shop Drawings. Delivery, Storage, & Handling: The Proposer must be able to comply with instructions and recommendations of manufacturer for special delivery, storage and handling requirements. Section 2.0 – Products 2.1 MATERIALS – Mobile Carriage System A. BASIS OF DESIGN: Products are based upon Mechanically Operated Movable Shelving Systems. B. RAIL / TRACK 1. Rail shall be manufacturer selected standard and include an in rail anti-tip system. Provide design details outlining materials and construction methods. Rail shall be installed with adjustable leveling screws (Shims shall not be accepted) and a full bed of non-shrink hydraulic grout. Provide details of rail anchoring method. All rails will be recessed into topping slab being provided by the City of Fort Collins. C. CARRIAGES 1. Carriages shall be minimum 1,000 lbs. (1500 kg) per linear carriage foot capacity, fixture unit welded, riveted, or bolted construction, uniframe assemblies constructed of minimum 12 ga. steel with main supporting structural face section 5 ¾” (146 mm) high with two reinforcing flanges running the full length of the carriage. Wheel support section shall be minimum 12 ga. steel and shall be welded between the main support face sections, one per rail assembly. Carriage face sections shall provide a smooth clean appearance without any exposed assembly holes or protruding hardware. Carriage shall be powder coat painted from manufacturer’s standard colors. 2. All carriage splices shall be tongue and groove, offset angle, tension bolted type, designed to maintain proper unit alignment and weight load distribution. D. DRIVE SYSTEM 1. Design: Provide drive system which prevents carriage whipping, binding and excessive wheel/rail wear under normal operation. Provide line shaft drive that powers all wheels on one side of the carriage. Describe method for ensuring there is no binding or whipping of the carriage as it travels across the rail. Drive system shall exhibit no play or looseness. 2. Shafts: Solid steel rod or tube. 3. Shaft Connections: Secured couplings. 4. Bearing Surfaces: Provide rotating load bearing members with ball or roller bearings. Provide shafts with pillow block or flanged self-aligning type bearings. E. STEEL FACE PANELS 1. All exposed ends (refer to drawings) shall have steel panels for mounting of Mechanical Assist operator. Panels shall be constructed of 18 gauge steel. Panels shall be free of any exposed assembly holes or protruding hardware, and shall be assembled without any exposed sharp edges. Panels shall be powder coat painted from manufacturer’s standard colors. Two 3” x 5” (78 mm x 127 mm) cardholders shall be provided per aisle entry location. F. SYSTEM CONTROL AND OPERATIONAL REQUIREMENTS 1. Mechanical assist control operation. The system shall be of the mechanical assist type having a chain sprocket drive system. The system shall have a positive drive to ensure that there is no play in the drive handle and that the carriage will stop without drifting. All components of the system shall be compatible for smooth, non-jerking, even movement RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 6 of 25 along the total length of the carriage. Drive system shall have a minimum gear ratio of 1 lb. of force to 8,000 lbs. of load. All bearings used in the drive mechanism shall be permanently shielded and lubricated. a. Provide dual control system so that carriages are operable from both ends, dependent on final layout of system…. b. Provide provision for tensioning of drive chain without the removal of the system end panels. 2. Operating handles shall transmit power through a chain drive to the drive wheels. Handle shall be equipped with a safety locking pin, manually engaged for additional protection of patrons in aisle. G. NON POWERED SAFETY SWEEP 1. Provide non-powered safety sweep running the full length of each side of each movable carriage. Sweep system shall safely stop the entire carriage when it comes into contact with a person or object in the aisle. Indicate sweeps with visual safety indication tape. Sweep shall not require battery or electrical power for operation. Sweep shall allow a carriage to be “backed off” of an obstruction without any resetting from the user. 2.2 MATERIALS- Shelving and Storage Equipment Installed on Mobile Carriage System A. BASIS OF DESIGN: Descriptions in this section establish minimum performance and design specifications for various storage accessories to be installed on the mobile carriage system (2.1). B. FOUR POST SHELVING 1. Shelves: Full depth (or through) shelves shall have mounting holes for attachment of center stop. Multi-function slots for file dividers, bin dividers and/or divider rods) shall be placed on 2” (50 mm) centers across entire shelf length (starting 1” (25 mm) from each end). (This is mandatory to provide owner complete flexibility to adapt these accessories without the need to purchase new shelves.) Plain canopy tops shall be supplied on all shelving sections. Each double face shelf shall be provided with removable center stops (slotted for future flexibility). Shelves must accommodate loads of 50 lbs. per lineal foot of shelf with maximum deflection of L/140. Provide appropriate number of reinforcements to accommodate this standard. 2. Uprights: Uprights shall consist of 18 ga. (1.2 mm) steel formed into either a 2” (50 mm) wide “Tee” shape common post, or a 1” (25 mm) wide “Angle” shape end post. (Open uprights unacceptable.) Upright Height: All dimensions are mandatory. Spliced uprights are acceptable. Provide documentation on method of splice. DRAWERS INSTALLED IN OPEN SHELVING Drawer units consist of a lockable fixed front face attached to a formed drawer unit, which extends on slide extensions. Height of drawer units shall be, as required. Drawers shall be installed in shelving units. Drawer units shall be provided with an interlock system. Drawers shall be provided with a label holder. Provide minimum weight capacity of 100 lbs. per drawer. D. FLAT FILE CABINETS (key: FF) Provide museum grade flat files. E. WIDE SPAN SHELVING: 1. At locations, as necessary, provide wide span shelving of the following construction: a. Uprights shall be fully welded with tubular cross bracing to provide stability. b. Provide shelf adjustability on 1-1/2” centers. c. Provide Z-beam construction cross braces of 14 ga construction. d. For all openings provide independently adjustable slats which will allow a portion of the shelf to be opened to accommodate large or tall objects. F. ART STORAGE BIN CABINETS 1. At locations, as necessary, provide full length art storage bin cases. a. Top, bottom and sides of units of cases shall be of 16 ga construction. Interior uprights should be of 18 ga construction with a smooth surface front to back on both sides. b. Units should include the required quantity of interior uprights. Upright shall have a roll front. c. Interior shelves shall be of 18 ga construction. Vertical interior shelves shall not be adjustable; however horizontal shelves shall be adjustable on 2” centers without requiring the use of tools to adjust. G. ROLLED TEXTILE RACKS- CANTILEVERED 1. Provide cantilevered textile storage racks of the following construction: a. Frame Unit: Vertical posts and bottom legs to be no less than 2”x2”x14 ga Square Tubing. Horizontal supports to be no less than 1”x1”x 15 ga tubing. These shall be welded to form a solid unit. b. Bottom legs shall include holes to allow attachment to high density system. c. The cantilevered textile support shall be of 16 ga construction and secured in place via a spade head shoulder thumb screw. Support RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 8 of 25 shall be designed to be moved horizontally on frame unit horizontal supports to allow various sizes of textiles to be stored. H. HINGED DOORS INSTALLED ON OPEN SHELVING 1. Provide full height hinged doors on each applicable section. Doors shall be constructed of steel and include individual locking capability. a. Where hinged doors are required on sections containing pull out shelves, doors may not impede movement of pull out shelves from shelving section. b. Provide documentation outlining construction of doors to assure stability and rigidity. Doors may be two tier on each elevation due to height. Hanging garments and firearm storage sections require door sections. I. GARMENT RODS INSTALLED IN OPEN SHELVING 1. Provide garment hanging rods that interface with standard key holes on the open shelving specified in “open shelving” section. a. Each assembly shall provide 250 lb weight capacity per rod. b. To prevent deflection provide center support brackets as required. J. PULL OUT TRAYS 1. Provide museum quality pull out tray systems with inserts to allow them to be installed within the open shelving sections. a. Trays shall be fully formed and powder coated with no exposed edges or burrs. Glide panels shall allow vertical adjustability on ¼” centers. b. Trays will be fabricated of no less than 20ga steel. Glide panels shall be constructed of not less than 18 gauge steel. c. Tray front shall include two handles and a label holder. d. Provide system to ensure the trays don’t shift during movement of the mobile system carriages. K. SADDLE STORAGE MOUNTS 1. Provide saddle storage mounts that allow saddles to be stored safely and securely. L. ADDITIONAL CONSIDERATIONS 1. Provide consideration for storage of large animal mounts within the system. Describe method of storage, capacity and configuration within the system. RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 9 of 25 2.3 FINISHES A. GENERAL 1. All product finishes and coatings shall be non-off-gassing and inert. B. POWDER COAT PAINT FINISH 1. All painted components shall be powder coated. Color to be selected from manufacturer’s standard color card. 2.4 INSTALLATION A. Install components and accessories after finishing operations, including painting, have been completed. Install system to comply with final layout drawings, in strict compliance with manufacturer’s printed instructions and structural calculations. Position units level, plumb; at proper location relative to adjoining units and related work. B. Adjust: Adjust components and accessories to provide smoothly operating, visually acceptable installation. C. Cleaning: Immediately upon completion of installation, clean components and surfaces. Remove surplus materials, rubbish and debris resulting from installation upon completion of work and leave areas of installation in neat, clean condition. D. Protection: Protect system against damage during remainder of construction period. Advise Owner of additional protection needed to ensure that system will be without damage or deterioration at time of substantial completion. 2.5 DEMONSTRATION / CUSTOMER TRAINING A. Provide complete training to end user’s staff. Training shall include general safety and operation instructions, and basic preventative maintenance procedures. B. Provide Operations and Maintenance Manual (2 Copies). These criteria will be the basis for review of the written proposals and optional interview session. At discretion of the City, interviews of top rated firms may be held. The rating scale shall be from 1 to 5, with 1 being a poor rating, 3 being an average rating, and 5 being an outstanding rating. WEIGHTING FACTOR QUALIFICATION STANDARD 2.0 Scope of Proposal Does the proposal show an understanding of the project objective, methodology to be used and results that are desired from the project? 2.0 Assigned Personnel Do the persons who will be working on the project have the necessary skills? Are sufficient people of the requisite skills assigned to the project? 1.0 Availability Can the work be completed in the necessary time? Can the target start and completion dates be met? Are other qualified personnel available to assist in meeting the project schedule if required? Is the project team available to attend meetings as required by the Scope of Work? 1.0 Motivation Is the firm interested and are they capable of doing the work in the required time frame? 2.0 Cost and Work Hours Do the proposed cost and work hours compare favorably with the project Manager's estimate? Are the work hours presented reasonable for the effort required in each project task or phase? 2.0 Firm Capability Does the firm have the support capabilities the assigned personnel require? Has the firm done previous projects of this type and scope? Job Knowledge a) If a study, did it meet the Scope of Work? b) If Professional administered a construction contract, was the project functional upon completion and did it operate properly? Were problems corrected quickly and effectively? WITNESSETH: In consideration of the mutual covenants and obligations herein expressed, it is agreed by and between the parties hereto as follows: 1. Scope of Services. The Service Provider agrees to provide services in accordance with the scope of services attached hereto as Exhibit "A", consisting of ( ) page and incorporated herein by this reference. 2. The Work Schedule. [Optional] The services to be performed pursuant to this Agreement shall be performed in accordance with the Work Schedule attached hereto as Exhibit "B", consisting of ( ) page , and incorporated herein by this reference. 3. Time of Commencement and Completion of Services. The services to be performed pursuant to this Agreement shall be initiated within ( ) days following execution of this Agreement. Contract Period. Written notice of renewal shall be provided to the Service Provider and mailed no later than ninety (90) days prior to contract end. 6. Delay. If either party is prevented in whole or in part from performing its obligations by unforeseeable causes beyond its reasonable control and without its fault or negligence, then the party so prevented shall be excused from whatever performance is prevented by such cause. To the extent that the performance is actually prevented, the Service Provider must provide written notice to the City of such condition within fifteen (15) days from the onset of such condition. [Early Termination clause here as an option 7. Early Termination by City/Notice. Notwithstanding the time periods contained herein, the City may terminate this Agreement at any time without cause by providing written notice of termination to the Service Provider. Such notice shall be delivered at least fifteen (15) days prior to the termination date contained in said notice unless otherwise agreed in writing by the parties. The City shall pay the Service provider for the performance of this Contract, subject to additions and deletions provided herein, per the attached Exhibit " ", consisting of page , and incorporated herein by this reference. 9. City Representative. The City will designate, prior to commencement of the work, its representative who shall make, within the scope of his or her authority, all necessary and proper decisions with reference to the services provided under this agreement. All requests concerning this agreement shall be directed to the City Representative. 10. Independent Service provider. The services to be performed by Service Provider are those of an independent service provider and not of an employee of the City of Fort Collins. The City shall not be responsible for withholding any portion of Service Provider's compensation hereunder for the payment of FICA, Workmen's Compensation or other taxes or benefits or for any other purpose. 11. Personal Services. It is understood that the City enters into the Agreement based on the special abilities of the Service Provider and that this Agreement shall be considered as an agreement for personal services. Accordingly, the Service Provider shall neither assign any responsibilities nor delegate any duties arising under the Agreement without the prior written consent of the City. 12. Acceptance Not Waiver. The City's approval or acceptance of, or payment for any of the services shall not be construed to operate as a waiver of any rights or benefits provided to the City under this Agreement or cause of action arising out of performance of this Agreement. 13. Warranty. a. Service Provider warrants that all work performed hereunder shall be performed with the highest degree of competence and care in accordance with accepted standards for work of a similar nature. Unless otherwise provided in the Agreement, all materials and equipment incorporated into any work shall be new and, where not specified, of the most suitable grade of their respective kinds for their intended use, and all workmanship shall be acceptable to City. c. Service Provider warrants all equipment, materials, labor and other work, provided under this Agreement, except City-furnished materials, equipment and labor, against defects and nonconformances in design, materials and workmanship/workwomanship for a period beginning with the start of the work and ending twelve (12) months from and after final acceptance under the Agreement, regardless whether the same were furnished or performed by Service Provider or by any of its subcontractors of any tier. Upon receipt of written notice from City of any such defect or nonconformances, the affected item or part thereof shall be redesigned, repaired or replaced by Service Provider in a manner and at a time acceptable to City. 14. Default. Each and every term and condition hereof shall be deemed to be a material element of this Agreement. In the event either party should fail or refuse to perform according to the terms of this agreement, such party may be declared in default thereof. 15. Remedies. In the event a party has been declared in default, such defaulting party shall be allowed a period of ten (10) days within which to cure said default. In the event the default remains uncorrected, the party declaring default may elect to (a) terminate the Agreement and seek damages; (b) treat the Agreement as continuing and require specific performance; or (c) avail himself of any other remedy at law or equity. If the non-defaulting party commences legal or equitable actions against the defaulting party, the defaulting party shall be liable to the non-defaulting party for the non-defaulting party's reasonable attorney fees and costs incurred because of the default. 16. Binding Effect. This writing, together with the exhibits hereto, constitutes the entire agreement between the parties and shall be binding upon said parties, their officers, employees, agents and assigns and shall inure to the benefit of the respective survivors, heirs, RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 19 of 25 personal representatives, successors and assigns of said parties. 17. Indemnity/Insurance. a. The Service Provider agrees to indemnify and save harmless the City, its officers, agents and employees against and from any and all actions, suits, claims, demands or liability of any character whatsoever brought or asserted for injuries to or death of any person or persons, or damages to property arising out of, result from or occurring in connection with the performance of any service hereunder. b. The Service Provider shall take all necessary precautions in performing the work hereunder to prevent injury to persons and property. c. Without limiting any of the Service Provider's obligations hereunder, the Service Provider shall provide and maintain insurance coverage naming the City as an additional insured under this Agreement of the type and with the limits specified within Exhibit , consisting of one (1) page, attached hereto and incorporated herein by this reference. The Service Provider before commencing services hereunder, shall deliver to the City's Director of Purchasing and Risk Management, P. O. Box 580 Fort Collins, Colorado 80522 one copy of a certificate evidencing the insurance coverage required from an insurance company acceptable to the City. 18. Entire Agreement. This Agreement, along with all Exhibits and other documents incorporated herein, shall constitute the entire Agreement of the parties. Covenants or representations not contained in this Agreement shall not be binding on the parties. 19. Law/Severability. The laws of the State of Colorado shall govern the construction interpretation, execution and enforcement of this Agreement. In the event any provision of this Agreement shall be held invalid or unenforceable by any court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provision of this Agreement. 20. Prohibition Against Employing Illegal Aliens. Pursuant to Section 8-17.5-101, C.R.S., et. seq., Service Provider represents and agrees that: RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 20 of 25 a. As of the date of this Agreement: 1. Service Provider does not knowingly employ or contract with an illegal alien who will perform work under this Agreement; and 2. Service Provider will participate in either the e-Verify program created in Public Law 208, 104th Congress, as amended, and expanded in Public Law 156, 108th Congress, as amended, administered by the United States Department of Homeland Security (the “e-Verify Program”) or the Department Program (the “Department Program”), an employment verification program established pursuant to Section 8-17.5-102(5)(c) C.R.S. in order to confirm the employment eligibility of all newly hired employees to perform work under this Agreement. b. Service Provider shall not knowingly employ or contract with an illegal alien to perform work under this Agreement or knowingly enter into a contract with a subcontractor that knowingly employs or contracts with an illegal alien to perform work under this Agreement. c. Service Provider is prohibited from using the e-Verify Program or Department Program procedures to undertake pre-employment screening of job applicants while this Agreement is being performed. d. If Service Provider obtains actual knowledge that a subcontractor performing work under this Agreement knowingly employs or contracts with an illegal alien, Service Provider shall: 1. Notify such subcontractor and the City within three days that Service Provider has actual knowledge that the subcontractor is employing or contracting with an illegal alien; and 2. Terminate the subcontract with the subcontractor if within three days of receiving the notice required pursuant to this section the subcontractor does not cease employing or contracting with the illegal alien; except that Service Provider shall not terminate RFP 7431 Collection Storage Equipment for Fort Collins Museum of Discovery Page 21 of 25 the contract with the subcontractor if during such three days the subcontractor provides information to establish that the subcontractor has not knowingly employed or contracted with an illegal alien. e. Service Provider shall comply with any reasonable request by the Colorado Department of Labor and Employment (the “Department”) made in the course of an investigation that the Department undertakes or is undertaking pursuant to the authority established in Subsection 8-17.5-102 (5), C.R.S. f. If Service Provider violates any provision of this Agreement pertaining to the duties imposed by Subsection 8-17.5-102, C.R.S. the City may terminate this Agreement. If this Agreement is so terminated, Service Provider shall be liable for actual and consequential damages to the City arising out of Service Provider’s violation of Subsection 8-17.5-102, C.R.S. g. The City will notify the Office of the Secretary of State if Service Provider violates this provision of this Agreement and the City terminates the Agreement for such breach. 21. Special Provisions. The Service Provider will provide, from insurance companies acceptable to the City, the insurance coverage designated hereinafter and pay all costs. Before commencing work under this bid, the Service Provider shall furnish the City with certificates of insurance showing the type, amount, class of operations covered, effective dates and date of expiration of policies, and containing substantially the following statement: "The insurance evidenced by this Certificate will not be cancelled or materially altered, except after ten (10) days written notice has been received by the City of Fort Collins." In case of the breach of any provision of the Insurance Requirements, the City, at its option, may take out and maintain, at the expense of the Service Provider, such insurance as the City may deem proper and may deduct the cost of such insurance from any monies which may be due or become due the Service Provider under this Agreement. The City, its officers, agents and employees shall be named as additional insureds on the Service Provider's general liability and automobile liability insurance policies for any claims arising out of work performed under this Agreement. 2. Insurance coverages shall be as follows: A. Workers' Compensation & Employer's Liability. The Service Provider shall maintain during the life of this Agreement for all of the Service Provider's employees engaged in work performed under this agreement: 1. Workers' Compensation insurance with statutory limits as required by Colorado law. 2. Employer's Liability insurance with limits of $100,000 per accident, $500,000 disease aggregate, and $100,000 disease each employee. B. Commercial General & Vehicle Liability. The Service Provider shall maintain during the life of this Agreement such commercial general liability and automobile liability insurance as will provide coverage for damage claims of personal injury, including accidental death, as well as for claims for property damage, which may arise directly or indirectly from the performance of work under this Agreement. Coverage for property damage shall be on a "broad form" basis. The amount of insurance for each coverage, Commercial General and Vehicle, shall not be less than $500,000 combined single limits for bodily injury and property damage. In the event any work is performed by a subcontractor, the Service Provider shall be responsible for any liability directly or indirectly arising out of the work performed under this Agreement by a subcontractor, which liability is not covered by the subcontractor's insurance.
