HomeMy WebLinkAbout566707 COLORADO IN MOTION - CONTRACT - AGREEMENT MISC - COLORADO IN MOTIONAmendment No. 02 1 Services Agreement – Colorado in Motion AMENDMENT NO. 02 TO AGREEMENT THIS AMENDMENT NO. 02 “Amendment No. 02” is by and between Colorado Physical Therapy Specialists, LLC dba Colorado In Motion, a Colorado limited liability company located at 210 West Magnolia, Suite 110 Fort Collins CO 80521 (“Service Provider”) and the City of Fort Collins (“City”), collectively (the “Parties”). WHEREAS: The Parties entered into a Service Agreement (“Agreement”) effective May 1, 2017 for functional employment testing as a part of the City’s work injury and disability management program, to, among other reasons, effectuate a reduction of on-the-job injuries by trying to determine if an applicant or employee can safely perform the essential functions of the job. WHEREAS: The Parties entered into Amendment No. 01 effective May 12, 2017 authorizing the Service Provider to assist the City in implementing the WorkSTEPS functional employment- testing program, and acknowledging that the Service Provider has licensed with the ©WorkSTEPS® proprietary functional employment testing program (“WorkSTEPS”) that the City desires to utilize for its functional employment testing program, and WHEREAS: The Service Provider has completed the analysis and design of the employment testing programs for two (2) positions, and the parties wish to amend the Agreement to define the afore mentioned position specific testing programs. THEREFORE THE PARTIES HERETO DO HEREBY AGREE AS FOLLOWS: 1. Job Specific Testing. Service Provider shall conduct job specific testing for the positions of Bus Operator and Transit Service Officer as outlined in the attached Exhibit 1 and Exhibit 2, respectively, and attached hereto and incorporated herein. Except as expressly amended by this Amendment No. 02, all other terms and conditions of the Agreement shall remain unchanged and in full force and effect. In the event of a conflict between the terms of the Agreement, Amendment No. 01 and this Amendment No. 02, this Amendment No. 02 shall prevail. One of the outcomes of the job analysis is to establish job specific tests that replicate the essential functions for each position tested. The applicant’s performance of these tasks is assessed during the WorkSTEPS functional test and the results are utilized by the employer to assist with placement decisions for post-offer candidates and, if applicable, return to work decisions for existing employees. For the Position of: BUS OPERATOR PDC Level: HEAVY The City representative hereby acknowledges the following as valid job specific tests: Job Specific Task I Task Simulated: Assisting passenger in wheelchair with bus egress. Equipment Used: NIOSH box weighted to 250 lb. secured in manual wheelchair seat. Description of Task Simulation 1: Candidate will push a wheelchair weighted to 250 lb. over 10 ft. to a ramp which satisfies DOT guidance on 1:6 rise:run. Candidate will demonstrate the ability to initiate transport of weighted wheelchair up 3 ft. run of ramp at an initial force of 79 f.lb. and safely transport wheelchair while walking backward down ramp. Job Specific Task II Task simulated: Pre-Trip Inspection – striking tires Equipment Used: Ball pein hammer. Lift station with 12 in. vertical barrier marked and 24” horizontal from kneeling position marked as target for ball pein hammer strike. Description of Task Simulation 2: Candidate will demonstrate the ability to assume a kneeling position (half-kneel or full-kneel) and use a ball pein hammer to strike a target at 24 in. from kneeling position and under a 12 in. vertical barrier. Candidate will then stand. Candidate will repeat task for a total of four repetitions. Job Specific Task III Task Simulated: Pushing upward on roof vent to simulate pre-trip inspection. Equipment Used: Force Gauge and overhead 69 in. stable support. Description of Task Simulation 3: Candidate will push upward using a hand held force gauge in an overhead position for up to 3 repetitions to achieve a 33 f.lb. exertion for at least one of three repetition efforts. Job Specific Task IV Task Simulated: Lifting/Lowering bike rack. Equipment Used: NIOSH box weighted to 47 lb. Description of Task Simulation 4: Candidate will lift NIOSH box from 19 in. to 46 in. and return box to start position. Job Specific Task V Task Simulated: Entering and exiting bus. Candidate will repeat task for a total of 5 repetitions. The City representative hereby acknowledges the following as valid physical requirements: 1. Employee lifts 47 lb. Occasionally (less than 33% of the time or 1-100 times per day 2. Employee's position requires pushing a maximum force of 79 f.lb. Equipment Used: Weight vest at 13 lb. Description of Task Simulation 1: Candidate don, secure and doff weighted vest, then don vest again to wear it for JST II – VI below. Following JST VI, candidate will doff vest. Job Specific Task II Task Simulated: Assisting passenger in wheelchair with bus egress. Equipment Used: NIOSH box weighted to 250 lb. secured in manual wheelchair seat. Description of Task Simulation 1: Candidate will push a wheelchair weighted to 250 lb. over 10 ft. to a ramp which satisfies DOT guidance on 1:6 rise:run. Job Specific Task III Task simulated: Securing and removing boot from vehicle wheel. Equipment Used: NIOSH box weighted to 21 lb. Description of Task Simulation 2: Candidate will demonstrate the ability to lift a 21 lb. NIOSH box from 42 in. shelf using bottom handles, carry it 25 ft. and place it on the floor. Candidate will use a half-kneel, full-kneel or squat/crouch position to lift the NIOSH box using bottom handles and place it on a 6 in. riser. Candidate will place the box back on the floor, then stand and lift to carry the box back to its start point at 42 in. shelf. Job Specific Task IV Task Simulated: Walking length of bus while in operation. Equipment Used: Foam balance beam Description of Task Simulation 3: Candidate will demonstrate the ability to safely walk forward the length of a 4 ft. foam balance beam, then turn 90 degrees right and side-step the length of the beam (walking right), then return side-stepping the length of the beam (walking left.) Job Specific Task V Task Simulated: Training and performance of arrest control and defensive tactics Equipment Used: Knee pads available DocuSign Envelope ID: 6050E765-62FB-4447-8D8F-65BB53C644D3 Amendment No. 02 5 Services Agreement – Colorado in Motion Description of Task Simulation 4: Candidate demonstrate the ability to safely move through the following body positions: stand, squat, half-kneel, full kneel, prone, supine, sit with knees bent – leaning back on palms of hands – kick right foot 3 times, left foot 3 times, then half-kneel, squat, stand. Candidate will then perform a strike using fist against a padded target – right hand strike 3x, left hand strike 3x. Job Specific Task VI Task Simulated: Entering and exiting bus. Equipment Used: 14 in. step Description of Task Simulation 4: Candidate will step up and over a 14 in. step for a total of 5 repetitions.
