PROPOSAL Longview Trail Mitigation Final Design

Dear Rick:
Attached please find our scope of work and fee for the Final Design phase of the Longview
Wetland Mitigation project. The scope is based on our understanding of the bridge and trail
construction project schedule, discussions with Rachel Steeves and input from the City Utilities
and Purchasing Departments, and construction contractor discussions on estimated level of effort.
Per these discussion, it was agreed that the scope for the entire “turnkey” project would be divided
into three phases with separate work order to cover design, construction and monitoring. We also
understand from Rachel that a project cost overview is helpful to see the overall scale of the
project as summarized in the following cost estimate table.

Fees include all labor, direct costs, and reimbursable expenses required to successfully
complete the scope of work. Our rates to complete any out of scope items will be billed in
accordance with our contract rate schedule attached. We hope that this scope and fee meet

SCOPE OF WORK
1. Biohabitats will coordinate with Longview Trail project representatives from the City of Ft
Collins, Larimer County and Castle Rock Construction Company regarding scheduling,
work area limits, and wetland considerations on Hazaleus Natural Area.
2. Biohabitats will produce final design-build construction documents and submit applicable
stormwater permits/notifications for the Longview Trail Wetland Mitigation at Hazaleus
Natural Area.
WORK PLAN
PHASE 1 – TRAIL PROJECT COORDINATION & FINAL MITIGATION DESIGN
TASK 1.1 PROJECT COORDINATION & WETLAND MAPPING
a. Biohabitats will visit the site for a kick-off meeting with project representative(s) (from
the county and construction contractor (as appropriate), Parks Department, and Natural
Areas staff to discuss project tasks, expectations, schedule, design objectives, and
communication. Specifically, we will discuss bridge and trail construction activities,
access and stockpile locations, impact areas and potential dewatering activities, and
existing wetland area considerations.
b. Biohabitats will conduct more detailed site assessment activities to refine wetland
mapping within the construction area for Bridge No. 5 and along the edge of the
proposed mitigation area. Additional GPS data, soil sampling and spot elevation data
will be collected as needed for design refinement.
c. We will attend the construction site meeting for Bridge No. 5 and weekly progress
meetings for the trail project (up to four) prior to and during work on the Hazaleus
Natural Area as relevant to the wetland mitigation project.
Deliverables: Summary notes of meetings.
TASK 1.2 FINAL GRADING AND PLANTING DESIGN
a. Biohabitats will develop a grading plan based on the attached June 2017 concept design
and updated site information (e.g., for wetlands, work areas, and elevations) to a level of
detail sufficient for the Design-Build construction project and City Utilities Department
review. We will also develop a planting plan for the types and locations of desired
plantings based on elevations relative to the design water level. The plans will be
submitted electronically and will likely include the following items:
Plan-view of grading with proposed spot elevations provided at key locations.
Typical cross section through the proposed grading area.
Plan-view of planting locations and zones.
Plant species composition schedules with species list and quantities.
Description and details of erosion controls.

b. In addition to the plans, Biohabitats will provide a brief memorandum covering e.g.:
Itemized cost estimate.
List of special considerations including hydrology assumptions and potential
trail and bridge coordination activities.
Preliminary implementation timeline, including planting and seeding.
c. Based on the draft design plan and memorandum, Biohabitats will submit appropriate
notifications and documentation to the CO Department of Health and Environment (if
necessary) and the City of Fort Collins Utilities Department.
d. Following draft design review by City of Ft Collins Natural Areas and Parks Departments,
Biohabitats will incorporate comments into the Final Design/Build documents that will
include:
Grading plan
Planting plan
Stormwater Management Plan, including erosion control details
Deliverable: Initial design/build plans, Final design/plans and design memo including itemized
construction cost.
TASK 1.3 FLOODPLAIN USE PERMIT AND CITY ESC MATERIAL REVIEW
a. Based on the Final Design/Build documents, Biohabitats will produce and submit the
necessary information for the City of Fort Collins Floodplain Use Permit including a No-
Rise Certification Form.
b. Based on the Final Design/Build documents, Biohabitats will produce and submit the
necessary information for the City of Fort Collins Erosion & Sediment Control Material
Review.
Deliverable: Floodplain Use Permit, No-Rise Certification, and ESC Material Review.
SCHEDULE
Based on the Longview Trail Construction TAP by Castle Rock Construction Company (CO60-
083), the anticipated coordination and mitigation schedule is as follows:

FEE
Our fee including expenses to perform this work is $25,550.00 based on the task breakdown
provided below. Additional tasks will be billed, with City approval, on a time and materials basis,
based on our contract rates (attached).
Our fee associated with this scope of work is based on past discussions with City staff and the
assumptions provided below. If any assumptions in this scope of work are inconsistent with the
City’s understanding, Biohabitats would be more than happy to discuss them and revise our level of
effort and associated fee accordingly.

Assumptions
The scope and fee estimate for Design is based on the assumptions listed below:
1. The City of Fort Collins is responsible for coordinating project planning activities between
Parks and Natural Areas staff, Larimer County, construction crews, CDOT, and neighboring
landowners. The City will be responsible for providing signage and notification to the public
of the restoration activities, goals, expectations and contact information for questions.
2. Biohabitats’ scope of work does not include an assessment of water rights, property
ownership, or other legal issues that may be associated with the project. Additionally, the
scope does not include geotechnical testing or utility relocation.
3. The design approach avoids modification of the floodplain analysis provided by Anderson
Consulting Engineers from the CLOMR. The scope, fee, and schedule do not include any
hydraulic analysis related to floodplain regulations or attendance to meetings not covered by
the existing work order.

4. Additional permitting, other than those covered in the scope of work, is not anticipated (e.g.,
Section 7 consultation for federally listed species or other local, county, state, or federal
permitting requirements), and is not included in the above scope.
5. Meetings that are necessary, but not included in the above scope, will be considered out of
scope and billed on a time and materials basis.
ADDITIONAL SERVICES
Services in addition to those described above are to be compensated on a Time and Materials basis
(unless otherwise noted) per Biohabitats’ contract rate schedule. Additional services will include (but
are not limited to) additional meetings and field visits and major revisions to and/or expansion of
scope of services. Whenever practical, changes, additions, or modifications to the scope of services
shall be authorized by written change order request; however, the absence of such a written change
order shall not act as a bar to payment of fees due Biohabitats, provided the change was in fact
approved and ordered by the Client or Owner.
Payment Terms
INVOICES FOR SERVICES AND/OR EXPENSES DESCRIBED HEREIN ARE DUE AND
PAYABLE UPON COMPLETION. All amounts not paid within 35 days shall be subject to a late
payment interest charge at the rate of (1.5) percent per month, (eighteen percent APR) from the date
of invoice. In the event that Biohabitats does not receive payment within 60 days from the date of
the invoice, Biohabitats, after giving seven days written notice to the Client, may suspend or
terminate the contract without causing any type of financial or legal penalty or action against
Biohabitats by the Client or Owner. Work may commence once the Client has paid in full all
amounts due for services rendered and expenses incurred, including interest on past due invoices.
This proposal is based on a continuous work process. If the work schedule is delayed and/or the
project scope or budget is changed, Biohabitats can provide additional services upon agreement by
the Client to pay for additional services fees. Extensive itemized breakdowns of hourly activities or
provision of detailed backup for reimbursed expenses for accounting purposes are not a normal
procedure; however, at the Client’s request, Biohabitats will provide this service at an hourly rate of
$65.00 (sixty-five dollars) per hour.
