SCOPE OF WORK FOR POUDRE RIVER DOWNTOWN PROJECT REACH 3, PHASE I – DESIGN, CONSTRUCTION ASSISTANCE, AND LOMR CHANGE ORDER #1 – MAY 2017 The following scope of work and accompanying budget have been prepared based on additional work effort required to address the addition of properties to the project site, plat preparation, additional permitting requirements, and a significant increase in coordination needs, including stakeholders and the selected CMGC contractor, assuming design, permitting and coordination efforts are completed by August 31, 2017. TASK 1. PREPARATION OF OUTREACH GRAPHICS AND VINE DRIVE PROPERTY PLANNING BHA will produce a bird’s eye rendering for the project site to be used to facilitate fundraising. TASK 2. FIELD SURVEY AND BASE MAP PREPARATION Field survey data within the project area previously collected by King Surveyors will be supplemented to include the private properties recently acquired by the City along Vine Drive. This work will include detailed site survey, utility locates/survey, and topographic mapping. This additional survey will be incorporated into both the design base map (horizontally referenced to the City of Fort Collins ground master network and vertically referenced to the North American Vertical Datum of 1988 – NAVD88) and the floodplain base map (horizontally referenced to Colorado State Plane North (NAD1983) and NAVD88). The electronic surface of existing terrain in State Plane/NAVD88 will also be updated. A Subdivision Plat will be prepared for the project, along with up to ten (10) easement descriptions, easement vacations, or property conveyance exhibit drawings. Comments received during the PDP process will be addressed and revisions to the plat made for FDP submittal. King will coordinate with Project Team members and City staff as part of the plat and easement preparation process. TASK 3. ECOLOGICAL, HABITAT AND CULTURAL RESOURCES EVALUATIONS The Ecological Characterization Study (ECS) and Ecological Assessment Technical Memorandum, two separate and distinct documents (required by the City and USACE, respectively) will be revised to include the Krush Property. TASK 4. SCHEMATIC DESIGN Additional schematic design services will be provided by BHA for the added properties along Vine Drive. TASK 5. DESIGN DEVELOPMENT (50% DESIGN) / PRELIMINARY DEVELOPMENT PLAN The additional properties along Vine Drive will require design effort that was not anticipated by the approved scope or work, including expansion of the site plans, grading plans, landscape plans, and drainage plans, as well as revising the color rendered site plan, PDP documents and calculations, and architectural design concepts for the overlook shelter. In addition, the extended frontage along Vine Drive will require the design of an extended storm sewer system and additional roadway improvements. Through the PDP process it was also determined that: (a) the design of the ultimate roadway section would be required to demonstrate the current Vine Drive improvements would be compatible with possible future roadway expansion; and (b) the Phase 2 parking lot would need to be designed. This task includes the work effort for these items. Finally, to coordinate the proposed site drainage improvements with area storm sewer improvements anticipated by the Stormwater Department for properties north of Vine and abandoning the Coy Ditch, it will be necessary for ACE to prepare a hydrologic model for areas north of the project site, essentially creating a local drainage master plan. PERMITTING CONDITIONAL LETTER OF MAP REVISION (CLOMR) The approved scope of work did not include effort that may be required to address review comments from either the City or FEMA. Although the potential nature and extent of comments cannot be foreseen, this task will set aside $5,000 for addressing City CLOMR comments and $3,000 to address FEMA CLOMR comments. This budget will be used on a time and materials basis to the extent necessary to satisfy the City and FEMA reviews. If additional effort beyond these allowances is needed to address comments, that work would need to be conducted under a supplemental scope of work and budget. INDIVIDUAL 404 PERMIT The approved scope of work did not include effort that may be required to address review comments received from the USACE or others through the 404 Permit process, or revisions to the initial 404 IP submittal due to the addition of the Krush Property. Comments from the USACE, received pursuant to the initial 404 IP application, will require the preparation a significantly revised 404 IP application to reformulate the project purpose and provide enhanced alternative analysis documentation. The revised submittal will also include changes pursuant to obtaining the Krush Property. This will necessitate significant effort by staff from both Walsh and ACE to revise the 404 IP application. Although the potential nature and extent of future comments cannot be foreseen, this task will also set aside approximately $6,000 for addressing potential future 404 IP comments. This budget will be used on a time and materials basis to the extent necessary to satisfy the USACE. If additional effort beyond this allowance is needed to address comments, that work would need to be conducted under a supplemental scope of work and budget. TASK 7. CONSTRUCTION DOCUMENTS / FINAL DEVELOPMENT PLAN The additional properties along Vine Drive will require design effort that was not anticipated by the approved scope or work, including expansion of the site plans, layout plans, grading plans, landscape plans, and drainage plans. In addition, the extended frontage along Vine Drive will require the design of an extended storm sewer system and additional roadway improvements. Finally, final design of the Phase 2 parking lot will be prepared. TASK 8. PROJECT COORDINATION Anticipated coordination efforts for this project have exceeded that reflected in the approved scope of work. Rather than monthly and bi-weekly project coordination meetings, weekly meetings have been held throughout much of the preliminary design and permitting phases. In addition, consultant project team members have been involved with most of the project stakeholder and adjacent property owner meetings, when most of these meetings were not previously included. It is anticipated that stakeholder and property owner meetings will continue to be held throughout much of final design. It is expected that weekly coordination meetings will the held with the selected CMGC contractor over the course of 18 weeks (May through August 2017). In addition to formal meetings, it is anticipated that as-needed coordination between the City Project Manager, ACE Project Manager, BHA Project Manager and lead design staff will be conducted via email and phone calls during this same 18-week period. All services conducted under this Project Coordination task will be tracked on a time-and-materials basis throughout the project, with a summary of costs incurred and budget remaining under this task provided with each invoice. The main factors that led to a need for increased budget include: • Direction provided by the U.S. Army Corps of Engineers after the Individual Permit application had been submitted, which moved away from the alternatives analysis based on the Poudre River Master Plan and in another direction. This necessitated a new alternatives analysis and major re-working of the Individual Permit document and supporting figures. • Discussions and efforts to reduce wetland impacts in the parcels north of the Poudre River. • Discussions and revisions related to refinement of the design for access and seating along the Poudre River. As a result, we request additional budget of $5,000 for seeing the Individual Permit through the review process and addressing any further issues that might be raised by the U.S. Army Corps of Engineers. Our fee includes the initial submittal and two additional submittals addressing City of Fort Collins comments. Major changes made to the layout after our initial draft will be billed at our standard hourly rates. Attending meetings and copies for submittals are not included in our fee. A current Title Commitment and copies of the Schedule B Exceptions will need to be provided by the client before we can begin. Our fee includes one set of final mylars. Additional descriptions will be billed at $400 per description. Item IV The fee to prepare a Topographic Survey of the Division Seven System Parcel and Morak Parcel will be $4,101. This will be added to the existing topo in both ground master and state plane.
