8468 CONSTRUCTION MANAGEMENT/GENERAL CONTRACTOR
POUDRE RIVER DOWNTOWN PROJECT
The City of Fort Collins is requesting proposals from qualified Construction Managers/General
Contractors for the Poudre River Whitewater Park Project.
As part of the City’s commitment to Sustainable Purchasing, proposals submission via
email is preferred. Proposals shall be submitted in a single Microsoft Word or PDF file
under 20MB and e-mailed to: purchasing@fcgov.com. If electing to submit hard copy
proposals instead, five (5) copies, will be received at the City of Fort Collins' Purchasing
Division, 215 North Mason St., 2nd floor, Fort Collins, Colorado 80524. Proposals must be
received before 3:00 p.m. (our clock), March 01, 2017 and referenced as Proposal No.
8468. If delivered, they are to be sent to 215 North Mason Street, 2nd Floor, Fort Collins,
Colorado 80524. If mailed, the address is P.O. Box 580, Fort Collins, 80522-0580. Please
note, additional time is required for bids mailed to the PO Box to be received at the
Purchasing Office.
The City encourages all Disadvantaged Business Enterprises (DBEs) to submit proposals in
response to all requests for proposals. No individual or business will be discriminated against

A pre-proposal meeting will be held at 2:00 PM on February 10, 2017 in the Community
Room, located at 215 N Mason Street, Fort Collins.

New Vendors:
The City requires new vendors receiving awards from the City to fill out and submit an IRS form
W-9 and to register for Direct Deposit (Electronic) payment. If needed, the W-9 form and the
Vendor Direct Deposit Authorization Form can be found on the City’s Purchasing website at
www.fcgov.com/purchasing under Vendor Reference Documents.
Sales Prohibited/Conflict of Interest: No officer, employee, or member of City Council, shall have
a financial interest in the sale to the City of any real or personal property, equipment, material,
supplies or services where such officer or employee exercises directly or indirectly any decision-
making authority concerning such sale or any supervisory authority over the services to be
rendered. This rule also applies to subcontracts with the City. Soliciting or accepting any gift,
gratuity favor, entertainment, kickback or any items of monetary value from any person who has
or is seeking to do business with the City of Fort Collins is prohibited.
Collusive or sham proposals: Any proposal deemed to be collusive or a sham proposal will be
rejected and reported to authorities as such. Your authorized signature of this proposal assures
that such proposal is genuine and is not a collusive or sham proposal.
The City of Fort Collins reserves the right to reject any and all proposals and to waive any
irregularities or informalities.
Sustainability: Consulting firms/teams participating in the proposal are to provide an overview of
the organization’s philosophy and approach to Sustainability. In no more than two (2) pages
please describe how your organization strives to be sustainable in the use of materials,
equipment, vehicles, fuel, recycling, office practices, etc. The City of Fort Collins incorporates
the Triple Bottom Line into our decision process by including economic (or financial),
environmental, and social factors in our evaluation.
The selected Service Provider shall be expected to sign the City’s standard Agreement without
revision prior to commencing Services (see sample attached to this Proposal).

8468 CM/GC FOR POUDRE RIVER WHITEWATER PARK
I. PROJECT SCOPE OF WORK AND REQUIREMENTS
A. General Information
The City of Fort Collins (City) is seeking qualification statements from qualified
Construction Managers/General Contractors (CM/GC) to provide construction services
related to the construction of the Poudre River Whitewater Park in Fort Collins,
Colorado.
The Poudre River Whitewater Park is based on the concepts presented in the
PoudreRiver Downtown Master Plan (October 2014 http://www.fcgov.com/poudre-
downtown/).
The Poudre River Whitewater Park Improvements plans (50%) are available in
attachment 1.
The Poudre River Downtown Master Plan developed a vision for the Poudre River from
Shields Street to Mulberry Street. The Master Plan identified opportunities and
constraints as it related to the three main River Project tenants; natural systems
enhancements, flood mitigation and recreation. The Master Plan segmented the river
into “reaches” and “Reach 3 – Museum of Discovery to Burlington Northern Santa Fe
Railroad” was identified as the first project for implementation. Reach 3 is now identified
as “The Poudre River Whitewater Park” and includes the removal of the Coy Irrigation
Diversion Structure and Boat Chutes and then reconstruct the river to incorporate in
stormwater improvements, whitewater drop features, pedestrian gathering areas, a
pedestrian bridge, trails, parking areas, restoration, and road improvements. The Plan
seeks to enhance stormwater conveyance, provide natural systems connectivity, and
promote the City’s access to the river.
The total estimated cost of the Poudre Whitewater Park project is $5.0 to $7.0 million.
B. Project Background
1. The City is under contract with Anderson Consulting Engineers and a team of sub-
consultants. Anderson is responsible for providing all contract documents and
design details for the project. The following is a preliminary schedule for the Poudre
River Whitewater Park Project:

2. The project goals are to develop a partnership/collaborative design and delivery
process to facilitate:
a. Achieving project opening in Spring 2018

b. Minimize risk, improve the construction schedule, and promote innovation / cost
efficient construction.
c. Maximize improvements within a set budget.
d. Minimize impacts to surrounding businesses, CSU Powerhouse Campus, the
Poudre Trail, Vine Drive, Excel Energy, and private inholdings.
The CM/GC should address their approach to accomplish these goals.
C. CM/GC Requirements
The City expects the CM/GC Contractor to provide pre-construction and construction
services related to the completion of the Poudre River Whitewater Project. These
services are to include, but not be limited to the following:
1. Preconstruction Support Services
o Provide a designated representative to participate in the engineering design
effort, which will begin upon contract award.
o The CM/GC is required to bring the following skills, knowledge and expertise
during the Preconstruction Support Services phase of the project. Following are
minimum requirements:
Estimate quantities of materials, labor and equipment needed to construct
the project.
Determine the task/work breakdown structure needed to complete the
project and estimate the cost, duration, and sequence of the these task
Understand the availability, cost, and capacities of materials labor and
equipment.
Identify potential risk, including cost risk, and methods to mitigate them
during the design process.
Determine constructability and inform project construction phasing.
Coordinate project work with utilities and stakeholders.
Provide dewatering plan and river construction phasing; including Irrigation
ditches and water coordination (Lake Canal, ELCO and Larimer Weld)
Develop strategy for hazardous materials management.
Understand and inform team regarding the demolition, cost, and construction
impacts of existing irrigation structures and walls.
2. Construction Contract Price Negotiations
When the City, the designer, and the CM/GC agree that the project has been
designed to a sufficient level of detail to allow the CM/GC to accurately price
construction elements of the project, Construction Contract Price Negotiations will
commence. In order to expedite the project, Construction Contract Price
Negotiations may start before the completion of the Preconstruction Support
Services. The CM/GC’s work effort for Construction Contract Price Negotiations will
be separate from its Preconstruction Support Services, and will not be compensated
for by the City. The CM/GC will be compensated for construction cost estimates

prepared during the design process prior to Construction Contract Price
Negotiations. The City will determine when Construction Contract Price Negotiations
have begun. The Construction Contract Price Negotiations will conclude with the
establishment of a Guaranteed Maximum Price (GMP) Construction Work Order
agreement. The Construction Work Order agreement will incorporate general
conditions using the Standard General Conditions of the Construction Contract
prepared by the Engineers Joint Contract Document Committee (EJCDC) and other
provisions in accordance with the City’s construction contract requirements.
a. Price Negotiation Process: The following procedures will be used for
Construction Contract Price Negotiations.
i. The designer will produce a set of the relevant plans and
specifications showing the work to be accomplished. The plans will
also show all work accomplished under any previous construction
packages.
ii. The CM/GC will prepare a “bid” to perform the work. The bid will include
detailed unit line item pricing and may include lump sum items as
appropriate.
iii. As part of the “bid” the CM/GC will obtain a minimum of 3 quotes for all major
subcontracted work unless otherwise approved by the City.
iv. The City will develop an independent construction cost estimate for the work
or may engage an independent third party to perform the construction cost
estimate.
v. Upon opening the CM/GC’s “bid” the City will determine the acceptability of
the “bid” by comparing it to its independent construction cost estimate.
vi. If the City determines the prices are acceptable, the City will prepare a
Work Order for construction services. If a previous Work Order for
construction services had been entered into, this work may be added to
that contract by change order.
vii. If the prices are not acceptable the City and the CM/GC will conduct a
price negotiation meeting to discuss the variances between the “bid”
and independent construction cost estimates.
viii. Following the price negotiation meeting the Construction Contract
Negotiations will enter into subsequent iteration of the above noted
process.
ix. The City reserves the right to require the CM/GC to enter into “open book”
cost model price negotiations at any time through this process, where the
CM/GC will be required to reveal and defend its detailed pricing breakdowns
including labor, materials, equipment, subcontractor and supplier quotes,
mobilization, overhead, mark-up, and profit. See below for the City’s “open
book” negotiation requirements.
x. At any time, if the City determines that an agreement cannot be
successfully negotiated, the City reserves the right to terminate
Construction Contract Cost Negotiations and the Preconstruction Support
Services contract and procure the construction of the project by other

means. If the City then offers the project up for public bids the CM/GC will
not be eligible to bid on the project.
b. “Open Book” Negotiations Process: Negotiations may require any or all of
the following information.
The CM/GC shall submit information as requested by the City to the extent
necessary to permit the City to determine the reasonableness of the “bid” price.
The CM/GC shall provide cost or pricing data, broken down by individual work
item, for the CM/GC and each major subcontractor. Submit material and
subcontractor quotes, anticipated labor and equipment usage, and anticipated
production rates.
If requested, submit a written proposal for the work identifying the major
elements of the work, the quantity of the element, and its contribution to the
proposed price. Provide further breakdowns if requested by the City.
Material: Furnish quotes and/or material invoices showing the cost of
material to be incorporated in the work.
Labor: Show basic hourly rates, fringe benefits, applicable payroll costs
(workers compensation, insurance, etc.) paid subsistence, and travel costs
for each labor classification and foreman employed in the work
Equipment: Provide a complete descriptive listing of equipment to be used in
the work including make, model and year of manufacture. Support rented or
leased equipment costs with invoices
Other direct costs: Furnish documentation of invoices to support any other
direct costs to be incurred that are not included above (e.g., bonds,
mobilization, permits, etc.)
Production Rates: Provide actual hours of performance, on a daily basis, for
each labor classification and for each piece of equipment.
Subcontract Costs: Provide supporting data as required above.
Overhead: Identify overhead rates and list the types of costs that are
included in overhead.
Profit: Include a reasonable profit reflecting the efficiency and economy of
the CM/GC and subcontractors in performing the work, the contract risk
type, the work difficulty, and management effectiveness.
Markup: List any markup cost for subcontractors or other items. Provide
backup information as requested for a breakdown and justification of markup
expenses.
3. Construction Requirements
o Provide construction services according to the Agreement and contract
documents including self-performance of at least 20% of the physical work
(including overhead, profit and materials).
o Provide qualified full time site supervision and management of trade
subcontractors to meet or exceed the defined project schedule.

o Provide open procurement of subcontractors and suppliers that are not assigned
by the City. Include the City in the procurement process. A minimum of 3
quotes are required for the subcontractor procurement process unless otherwise
approved by the City.
o Provide storm water management and BMP maintenance for the site complying
with State and City regulations.
o Provide construction delivery scheduling, meeting attendance and reporting
according to contract document and federal or state requirements. This includes
monthly reporting on DBE participation if applicable, progress reporting and
subcontractor work participation.
o Provide site security and protection during construction. Provide all site safety
management and compliance with OSHA standards and criteria. Implement a
site safety program that is reported on regularly.
o Provide for quality control program that meets or exceeds minimum job/contract
document and industry standards. Coordinate and perform all quality control
testing and inspections. All such tests and inspections shall be subject to the
City’s written review.
o Provide subcontractor and/or DBE participation to meet set goals if applicable.
Report in your proposal to the City how the remaining work will support this goal.
o Meet all licensing requirements as set forth by the City of Fort Collins for both
CM/GC and subcontracted work. Provide work that complies with the Larimer
County Urban Area Street Standards (LCUASS) as applicable.
o Provide services to manage participation in project close out process and needs
during the project warranty period.
D. Owner Expectations and Delivery Schedule
Partnering
The City and CM expect a partnering relationship with the selected CM/GC. A formal
Partnering Session will be held with the selected CM/GC, City of Fort Collins team
members, contract Engineers and Landscape Architects (Anderson Consulting
Engineers and BHA Design) as soon as the selection process is completed. The City
expects an environment where trust and teamwork prevent disputes, foster a
cooperative bond to everyone’s benefit, and facilitate the completion of a successful
project. Traditional adversarial relationships between the project participants are not an
acceptable way of doing business on this project.
Key Staff
The City expects the CM/GC to commit key staff members to manage the project
through attendance of weekly project meetings; preparation of RFIs; management of
subcontractors; management of schedule; management of quality and management of
cost. Key staff members for this project are expected to include a project manager,
superintendent and possibly a field engineer.
Communication
The City expects open and honest communication related to project activities including
subcontractor performance, cost control, schedule control, budget and quality issues as
they may arise. The City expects communication to occur directly through the
established chain of command which may involve working directly, receiving direction

and coordinating with City assigned personnel.
Contract Management
The City expects the CM/GC to participate in contract management such that pay
applications, work change directives, change orders, RFIs and other documents are
managed timely and effectively to avoid delays in project delivery. The City expects the
CM/GC to work with its representatives to gain approval and processing of these
documents in a coordinated fashion.
Performance Standard
The City expects CM/GC performance to a standard that exceeds industry accepted
parameters. The City expects a world class CM/GC and project. The City expects to
pay fairly for all work performed and expects the CM/GC to be profitable.
II. SUBMITTAL REQUIREMENTS
CM/GC firms that have the requisite experience and qualifications are encouraged to submit
proposals.
General Company Information
Name of firm, contact person for this proposal, title, phone number, fax number, street and
mailing addresses, and previous names of firm in last 10 years; date firm was established.
Describe how the firm is organized. Provide general contracting licenses held by firm.
Profile Projects
Provide a brief project description and history of projects, similar in scope to this project,
completed in the last 10 years. Include the following information:
1. Project description that includes the project name, firms that comprised the design
team, and site location. Please include pictures of the work completed.
2. Project history that includes the original schedule agreed upon at the time of signing
the contract, the actual duration of construction, and any special characteristics of
the project that affected delivery.
3. Type of project delivery model used.
4. Original contract cost.
5. Cost at completion and number of change orders.
6. CM/GC, subcontractor or owner initiated claims and their resolution.
7. Original contract time and actual completion time.
Provide a brief discussion of any unusual factors that affected the project delivery (e.g.
owner initiated delays, additions to the work, etc.). Provide both an owner reference and
consulting engineer/architect reference for cited projects.
Company Resources
Indicate the total number of personnel employed by the company and how many resources
are in each category (e.g. Administration, Clerical, Estimating, Project Management, Project
Coordinator, Project Engineer, Superintendent, Foreman, Carpenter, Laborer, etc.) Provide
an organizational chart for the resources proposed to be used on this project. Indicate the
office location this project will be managed through. Provide a full list of equipment on hand
owned and managed by the firm.

The City values a company’s investment in supporting the industry with apprenticeships,
volunteer, or intern opportunities, the use of locally sourced materials and labor, and the
ability to recycle materials from generated construction materials. Describe your previous
experience emphasizing local labor and materials and utilizing pollution prevention
techniques.
Key Project Staffing
Names and resumes of proposed key project staff, including proposed project manager and
construction project superintendent. Include references from owners and consulting
engineers for the last 3 projects for each assigned person. Detail the availability of proposed
staff. (Note: key personnel must be committed to this project for its duration, unless excused
by the Owner. This requirement is non-negotiable.)
Project Budget and Cost Control
1. Describe your approach to developing a cost to complete this project.
2. Describe your approach to developing value engineering ideas through construction
delivery to enhance the work product while potentially saving cost.
3. Describe how the delivery schedule outlined in Part I.D above affects your approach
to pricing.
4. Describe your approach to be transparent or open book when developing a cost for
this project in cooperation with the project team.
Construction Sequencing and Scheduling
Describe the scheduling software your firm typically uses for sequencing tasks and
scheduling subcontractors, materials and equipment. The City will require that an industry
recognized software is used to develop and manage the project schedule; fully base-lined,
critical path shown and float managed. Describe the way in which your firm develops and
maintains project schedules for projects of this size and nature. Describe your process and
frequency for updating project schedules and how your firm works to overcome challenges
and works to maintain the original completion date. Submit an example of a project schedule
for a similar size project.
Method of Construction
Submit a written narrative explaining your approach to completion of this project. There are
several businesses, the CSU Powerhouse Campus, two (2) active railroads and Xcel Energy
along the Corridor, therefore ensuring access at all times will be important, as well as being
efficient and cost effective during construction.
Quality Assurance/Quality Control
Provide details on your firm’s quality control program. Explain how your team administers a
quality control program during construction, how performance measures are documented
and how quality issues are addressed. Provide examples of when your firm exceeded
quality standards, gained industry recognition or received quality awards.
Partnering Experience
Describe at least 5 projects completed by your firm where partnering was formally
implemented. Provide a listing of key staff who participated in these projects and their roles.
Describe in detail what Partnering means to your firm and how it is integral to your business
operations.

Safety Record
Provide the firm’s OSHA reportable accident rate and current workman’s compensation
insurance multiplier for the last 3 years. Provide the OSHA reportable accident rate on
projects managed by the proposed superintendent or project manager over the three year
period. Provide a list of all projects in the last 5 years that have received an OSHA citation
either to the GC or subcontractor on the jobsite and provide a narrative of the citations.
Trade Subcontractors
Provide a listing of subcontractors for major trades your firm plans to engage to meet the
three bid requirement. Explain your relationship with these firms, how long they have
worked with you on projects, and how your subcontractor procurement process works. Give
examples of situations where these firms have performed to tight timeframes and
accelerated schedules.
Financial Statement
Provide a recent financial statement (audited if possible) including balance sheet and
income statement showing:
1. Current assets
2. Other assets
3. Current liabilities
4. Other liabilities
5. Fixed assets and equipment
6. Banking Reference (Provide name, address and phone number)
Bonding Company Reference
Provide the name, address and phone number of the firm’s bonding agent. Provide a letter
from the bonding agent indicating the firm’s bonding capacity is adequate to undertake this
work.
Insurance Company
Provide the name, address and phone number of the firm’s insurance agent(s). Provide
certificate of insurance outlining coverage and policy limits. Provide statements to answer
the following questions. (See also Insurance Requirements in Item V. Sample Agreement).
1. Does coverage meet minimum project requirements?
2. Does coverage include builder’s risk?
3. Can this coverage be extended for work on this project?
4. Can coverage be increased?
5. Can the City be listed as an additional insured?
6. Are there any current claims that will affect coverage limits available for this project?
Services and Construction Agreements
The CM/GC will be required to sign a Services Agreement (SA) for the pre-construction
Work, similar to Exhibit A attached herein. The pre-construction services shall include (at
minimum) review of designs for constructability, review of site layout and grading, estimating
cost of different options, alternatives and components, providing opinions and
recommendations on suitable methods and approaches to accomplish the work, offer value
engineering suggestions to accomplish the desired objectives in the most cost effective

manner possible, and provide the team with up to date on-going cost status of the current
project design.
The CM/GC will be required to sign a Construction Agreement for the construction Work. A
template of the City’s Construction Agreement is available upon written request. The
construction services shall include (at minimum) full time site supervision when trades are
working, stormwater management and permitting of the project site, site protection and
security during construction, procurement of all subcontractors and suppliers to complete
construction, project sequencing and scheduling of manpower, materials and equipment,
project safety enforcement, management of quality control, management of testing,
management of surveying, and management of project close-out. The Work Order for
construction services will be awarded at approximately 90% design completion based on the
CM/GC’s satisfactory performance under the pre-construction services Work Order.
Any exceptions to the agreements must be stated with your submission of qualifications for
this project. The City makes no guarantees it will change the agreements but may consider
the exceptions.
CM/GC Fees
Provide a list of construction cost factors that will be used to develop the cost of work.
Provide the following.
Work Order I (Pre-Construction) Services:
1. Cost estimate for pre-construction services (meetings, cost estimating, value
engineering and related tasks), to include personnel hourly rates and estimated time
per task.
Work Order II (Construction) Services:
2. Overhead markup, expressed as a percentage.
3. Profit markup, expressed as a percentage.
4. Subcontractor markup, expressed as a percentage.
5. Permanent materials markup, expressed as a percentage.
6. Equipment markup, expressed as a percentage.
7. Labor markup (provide unburdened labor rates and markups), expressed as a
percentage.
8. Change order markup for labor, materials, and subcontractors, expressed as a
percentage.
9. Budgetary estimate to complete the construction project.
10. Provide estimate for the percent of the construction project you plan to self-perform.
Describe in detail how your firm uses the markups and cost of work to develop the
Guaranteed Maximum Price for the project. The City anticipates working with the CM/GC to
develop this cost for all known quantities of the project. For unknown circumstances, the
City anticipates negotiating allowances to complete the work. The final project cost will be
established as a Guaranteed Maximum Price (GMP) including a detailed bid schedule.

III. SELECTION PROCESS AND SCHEDULE
Qualified CM/GC’s interested in the work described in this Request for Proposal should
submit items contained in Part II of this request.
The proposer’s authorized signature on the Proposal assures the team’s compliance with
City of Fort Collins’ purchasing restrictions. A copy of the restrictions is available for review
in the Purchasing Department or the City Clerk’s Office. The City reserves the right to reject
any and all proposals and to waive any informalities and irregularities therein.

The City reserves the right to select the top ranked firm directly from proposal documents
without a formal interview process.
In the event it becomes necessary to revise any part of the RFP a written addendum will be
issued. Each Proposal shall state it is valid for a period of not less than ninety (90) days
from date of proposal submittal.
Taxation
The City is exempt from all state taxation including state sales and use taxes.
IV. EVALUATION CRITERIA
CM/GC Qualification Review and Assessment
CM/GC firms will be evaluated on the following qualification criteria. These criteria will be

V. SAMPLE AGREEMENT
PROFESSIONAL SERVICES AGREEMENT
WORK ORDER TYPE
THIS AGREEMENT made and entered into the day and year set forth below by and
between THE CITY OF FORT COLLINS, COLORADO, a Municipal Corporation, hereinafter
referred to as the "City" and , hereinafter referred to as "Professional".
WITNESSETH:
In consideration of the mutual covenants and obligations herein expressed, it is agreed
by and between the parties hereto as follows:
1. Scope of Services. The Professional agrees to provide services in accordance with any
project Work Orders for , issued by the City. A blank sample of a work order is
attached hereto as Exhibit "A", consisting of ( ) pages and is incorporated
herein by this reference. A general scope of services is attached hereto as Exhibit “B",
consisting of ( ) pages and is incorporated herein by this reference. The City
reserves the right to independently bid any project rather than issuing a Work Order to the
Professional for the same pursuant to this Agreement. Irrespective of references in Exhibit
A to certain named third parties, Professional shall be solely responsible for performance
of all duties hereunder.
2. The Work Schedule. The services to be performed pursuant to this Agreement shall be
performed in accordance with the Work Schedule stated on each Work Order.
3. Time of Commencement and Completion of Services. The services to be performed
pursuant to this Agreement shall be initiated as specified on each Work Order. Time is of
the essence. Any extensions of any time limit must be agreed upon in writing by the
parties hereto.
4. Contract Period. This Agreement shall commence , 20 , and shall continue in
full force and effect until , 20 , unless sooner terminated as herein provided. In
addition, at the option of the City, the Agreement may be extended for additional one year
periods not to exceed ( ) additional one year periods. Renewals and pricing
changes shall be negotiated by and agreed to by both parties. Written notice of renewal
shall be provided to the Professional and mailed no later than thirty (30) days prior to
contract end.
5. Early Termination by City/Notice. Notwithstanding the time periods contained herein, the
City may terminate this Agreement at any time without cause by providing written notice of
termination to the Professional. Such notice shall be delivered at least fifteen (15) days
prior to the termination date contained in said notice unless otherwise agreed in writing by
the parties. All notices provided under this agreement shall be effective when mailed,

In the event of any such early termination by the City, the Professional shall be paid for
services rendered prior to the date of termination subject only to the satisfactory
performance of the Professional's obligations under this Agreement. Such payment shall
be the Professional's sole right and remedy for such termination.
6. Design, Project Insurance and Insurance Responsibility. The Professional shall be
responsible for the professional quality, technical accuracy, timely completion and the
coordination of all services rendered by the Professional, including but not limited to
designs, plans, reports, specifications, and drawings and shall, without additional
compensation, promptly remedy and correct any errors, omissions, or other deficiencies.
The Professional shall indemnify, save and hold harmless the City its officers and
employees, in accordance with Colorado law, from all damages whatsoever claimed by
third parties against the City and for the City's costs and reasonable attorney’s fees arising
directly or indirectly out of the Professional's negligent performance of any of the services
furnished under this Agreement. The Professional shall maintain insurance in accordance
with Exhibit , consisting of one (1) page, attached hereto and incorporated herein.
7. Compensation. In consideration of services to be performed pursuant to this Agreement,
the City agrees to pay Professional on a time and reimbursable direct cost basis
designated in Exhibit "B", consisting of ( ) page(s), attached hereto and
incorporated herein by this reference. At the election of the City, each Work Order may
contain a maximum fee, which shall be negotiated by the parties hereto for each such
Work Order. Monthly partial payments based upon the Professional's billings and itemized
statements are permissible. The amounts of all such partial payments shall be based
upon the Professional's City-verified progress in completing the services to be performed
pursuant to the Work Order and upon approval of the Professional's direct reimbursable
expenses. Final payment shall be made following acceptance of the work by the City.
Upon final payment, all designs, plans, reports, specifications, drawings, and other
services rendered by the Professional shall become the sole property of the City.
8. City Representative. The City will designate, prior to commencement of work, its project
representative who shall make, within the scope of his or her authority, all necessary and
proper decisions with reference to the project. All requests for contract interpretations,
change orders, and other clarification or instruction shall be directed to the City
Representative.
9. Project Drawings. Upon conclusion of the project and before final payment, the
Professional shall provide the City with reproducible drawings of the project containing
accurate information on the project as constructed. Drawings shall be of archival,

prepared on stable mylar base material using a non-fading process to provide for long
storage and high quality reproduction. "CD" disc of the as-built drawings shall also be
submitted to the owner in and AutoCAD version no older then the established city
standard.
10. Monthly Report. Commencing thirty (30) days after Notice to Proceed is given on any
Work Order and every thirty days thereafter, Professional is required to provide the City
Representative with a written report of the status of the work with respect to the Work
Order, Work Schedule and other material information. Failure to provide any required
monthly report may, at the option of the City, suspend the processing of any partial
payment request.
11. Independent Contractor. The services to be performed by Professional are those of an
independent contractor and not of an employee of the City of Fort Collins. The City shall
not be responsible for withholding any portion of Professional's compensation hereunder
for the payment of FICA, Workers' Compensation, other taxes or benefits or for any other
purpose.
12. Subcontractors. Professional may not subcontract any of the Work set forth in the Exhibit
A, Statement of Work without the prior written consent of the city, which shall not be
unreasonably withheld. If any of the Work is subcontracted hereunder (with the consent
of the City), then the following provisions shall apply: (a) the subcontractor must be a
reputable, qualified firm with an established record of successful performance in its
respective trade performing identical or substantially similar work, (b) the subcontractor will
be required to comply with all applicable terms of this Agreement, (c) the subcontract will
not create any contractual relationship between any such subcontractor and the City, nor
will it obligate the City to pay or see to the payment of any subcontractor, and (d) the work
of the subcontractor will be subject to inspection by the City to the same extent as the
work of the Professional.
13. Personal Services. It is understood that the City enters into this Agreement based on the
special abilities of the Professional and that this Agreement shall be considered as an
agreement for personal services. Accordingly, the Professional shall neither assign any
responsibilities nor delegate any duties arising under this Agreement without the prior
written consent of the City.
14. Acceptance Not Waiver. The City's approval of drawings, designs, plans, specifications,
reports, and incidental work or materials furnished hereunder shall not in any way relieve
the Professional of responsibility for the quality or technical accuracy of the work. The
City's approval or acceptance of, or payment for, any of the services shall not be
construed to operate as a waiver of any rights or benefits provided to the City under this
Agreement.
15. Default. Each and every term and condition hereof shall be deemed to be a material
element of this Agreement. In the event either party should fail or refuse to perform

according to the terms of this Agreement, such party may be declared in default.
16. Remedies. In the event a party has been declared in default, such defaulting party shall
be allowed a period of ten (10) days within which to cure said default. In the event the
default remains uncorrected, the party declaring default may elect to (a) terminate the
Agreement and seek damages; (b) treat the Agreement as continuing and require specific
performance; or (c) avail himself of any other remedy at law or equity. If the non-
defaulting party commences legal or equitable actions against the defaulting party, the
defaulting party shall be liable to the non-defaulting party for the non-defaulting party's
reasonable attorney fees and costs incurred because of the default.
17. Binding Effect. This writing, together with the exhibits hereto, constitutes the entire
Agreement between the parties and shall be binding upon said parties, their officers,
employees, agents and assigns and shall inure to the benefit of the respective survivors,
heirs, personal representatives, successors and assigns of said parties.
18. Law/Severability. The laws of the State of Colorado shall govern the construction,
interpretation, execution and enforcement of this Agreement. In the event any provision of
this Agreement shall be held invalid or unenforceable by any court of competent
jurisdiction, such holding shall not invalidate or render unenforceable any other provision
of this Agreement.
19. Prohibition Against Employing Illegal Aliens. Pursuant to Section 8-17.5-101, C.R.S., et.
seq., Professional represents and agrees that:
a. As of the date of this Agreement:
1. Professional does not knowingly employ or contract with an illegal alien who will
perform work under this Agreement; and
2. Professional will participate in either the e-Verify program created in Public Law 208,
104th Congress, as amended, and expanded in Public Law 156, 108th Congress,
as amended, administered by the United States Department of Homeland Security
(the “e-Verify Program”) or the Department Program (the “Department Program”),
an employment verification program established pursuant to Section 8-17.5-
102(5)(c) C.R.S. in order to confirm the employment eligibility of all newly hired
employees to perform work under this Agreement.
b. Professional shall not knowingly employ or contract with an illegal alien to perform
work under this Agreement or knowingly enter into a contract with a subcontractor that
knowingly employs or contracts with an illegal alien to perform work under this
Agreement.
c. Professional is prohibited from using the e-Verify Program or Department Program
procedures to undertake pre-employment screening of job applicants while this
Agreement is being performed.
d. If Professional obtains actual knowledge that a subcontractor performing work under

this Agreement knowingly employs or contracts with an illegal alien, Professional shall:
1. Notify such subcontractor and the City within three days that Professional has
actual knowledge that the subcontractor is employing or contracting with an illegal
alien; and
2. Terminate the subcontract with the subcontractor if within three days of receiving
the notice required pursuant to this section the subcontractor does not cease
employing or contracting with the illegal alien; except that Professional shall not
terminate the contract with the subcontractor if during such three days the
subcontractor provides information to establish that the subcontractor has not
knowingly employed or contracted with an illegal alien.
e. Professional shall comply with any reasonable request by the Colorado Department of
Labor and Employment (the “Department”) made in the course of an investigation that
the Department undertakes or is undertaking pursuant to the authority established in
Subsection 8-17.5-102 (5), C.R.S.
f. If Professional violates any provision of this Agreement pertaining to the duties
imposed by Subsection 8-17.5-102, C.R.S. the City may terminate this Agreement. If
this Agreement is so terminated, Professional shall be liable for actual and
consequential damages to the City arising out of Professional’s violation of Subsection
8-17.5-102, C.R.S.
g. The City will notify the Office of the Secretary of State if Professional violates this
provision of this Agreement and the City terminates the Agreement for such breach.
20. Special Provisions. Special provisions or conditions relating to the services to be
performed pursuant to this Agreement are set forth in Exhibit " " - Confidentiality,
consisting of one (1) pages, attached hereto and incorporated herein by this reference.

EXHIBIT
INSURANCE REQUIREMENTS
1. The Professional will provide, from insurance companies acceptable to the City, the
insurance coverage designated hereinafter and pay all costs. Before commencing work
under this bid, the Professional shall furnish the City with certificates of insurance
showing the type, amount, class of operations covered, effective dates and date of
expiration of policies, and containing substantially the following statement:
“The insurance evidenced by this Certificate will not reduce coverage or limits and
will not be cancelled, except after thirty (30) days written notice has been received
by the City of Fort Collins.”
In case of the breach of any provision of the Insurance Requirements, the City, at its
option, may take out and maintain, at the expense of the Professional, such insurance
as the City may deem proper and may deduct the cost of such insurance from any
monies which may be due or become due the Professional under this Agreement. The
City, its officers, agents and employees shall be named as additional insureds on the
Professional 's general liability and automobile liability insurance policies for any claims
arising out of work performed under this Agreement.
2. Insurance coverages shall be as follows:
A. Workers' Compensation & Employer's Liability. The Professional shall maintain
during the life of this Agreement for all of the Professional's employees engaged in
work performed under this Agreement:
1. Workers' Compensation insurance with statutory limits as required by
Colorado law.
2. Employer's Liability insurance with limits of $100,000 per accident,
$500,000 disease aggregate, and $100,000 disease each employee.
B. Commercial General & Vehicle Liability. The Professional shall maintain during the
life of this Agreement such commercial general liability and automobile liability
insurance as will provide coverage for damage claims of personal injury, including
accidental death, as well as for claims for property damage, which may arise
directly or indirectly from the performance of work under this Agreement.
Coverage for property damage shall be on a "broad form" basis. The amount of
insurance for each coverage, Commercial General and Vehicle, shall not be less
than $1,000,000 combined single limits for bodily injury and property damage.
In the event any work is performed by a subcontractor, the Professional shall be
responsible for any liability directly or indirectly arising out of the work performed
under this Agreement by a subcontractor, which liability is not covered by the
subcontractor's insurance.
C. Errors & Omissions. The Professional shall maintain errors and omissions
insurance in the amount of $1,000,000.

CONFIDENTIALITY
IN CONNECTION WITH SERVICES provided to the City of Fort Collins (the “City”) pursuant to
this Agreement (the “Agreement”), the Professional hereby acknowledges that it has been
informed that the City has established policies and procedures with regard to the handling of
confidential information and other sensitive materials.
In consideration of access to certain information, data and material (hereinafter individually and
collectively, regardless of nature, referred to as “information”) that are the property of and/or
relate to the City or its employees, customers or suppliers, which access is related to the
performance of services that the Professional has agreed to perform, the Professional hereby
acknowledges and agrees as follows:
That information that has or will come into its possession or knowledge in connection with the
performance of services for the City may be confidential and/or proprietary. The Professional
agrees to treat as confidential (a) all information that is owned by the City, or that relates to the
business of the City, or that is used by the City in carrying on business, and (b) all information
that is proprietary to a third party (including but not limited to customers and suppliers of the
City). The Professional shall not disclose any such information to any person not having a
legitimate need-to-know for purposes authorized by the City. Further, the Professional shall not
use such information to obtain any economic or other benefit for itself, or any third party, except
as specifically authorized by the City.
The foregoing to the contrary notwithstanding, the Professional understands that it shall have no
obligation under this Agreement with respect to information and material that (a) becomes
generally known to the public by publication or some means other than a breach of duty of this
Agreement, or (b) is required by law, regulation or court order to be disclosed, provided that the
request for such disclosure is proper and the disclosure does not exceed that which is required.
In the event of any disclosure under (b) above, the Professional shall furnish a copy of this
Agreement to anyone to whom it is required to make such disclosure and shall promptly advise
the City in writing of each such disclosure.
In the event that the Professional ceases to perform services for the City, or the City so requests
for any reason, the Professional shall promptly return to the City any and all information
described hereinabove, including all copies, notes and/or summaries (handwritten or
mechanically produced) thereof, in its possession or control or as to which it otherwise has
access.
The Professional understands and agrees that the City’s remedies at law for a breach of the
Professional’s obligations under this Confidentiality Agreement may be inadequate and that the
City shall, in the event of any such breach, be entitled to seek equitable relief (including without
limitation preliminary and permanent injunctive relief and specific performance) in addition to all
other remedies provided hereunder or available at law.

Project Overview
This proposed Poudre River Whitewater Park project embodies the character and vision of City Plan, the
Downtown River Master Plan, as well as the P-O-L Zone district. This project also adds to the vibrancy
and character envisioned in the C-C-R Zone district.
The proposed Poudre River Whitewater Park is located east of College Avenue and north of Downtown
Fort Collins, and is surrounded by considerable urban development. Consequently, the river and its
floodplain are highly altered and influenced by structures including bridges, two railroads, concrete
flood walls, a diversion structure and adjacent private development. Channelization of the river is
extreme between College and the BNSF Railroad Bridge. Likewise, limited riparian forest habitat and a
minimal corridor for wildlife movement reflect the most acute confinement on the river’s 12-mile
journey through Fort Collins.
The Poudre River Downtown Master Plan (October 2014) envisions a major remodel of this river reach,
creating an active and vibrant setting where people are encouraged to engage with and play in the river
in an urban setting.
The transformation will begin by removing the existing Coy Ditch diversion structure and boulder-lined
“boat chute”. After removing these structures, the river channel will be narrowed to a more natural,
sustainable width and deepened by implementing a variety of terraces to improve natural river function,
increase flood capacity, to provide additional space for bank improvements and riparian habitat. The
improved channel will be stabilized by constructing four in-stream sloping rock features, two of which
incorporate whitewater wave features and “holes”. An added benefit is that the new sloping rock

features will be designed to allow fish passage creating aquatic connectivity that hasn’t existed in this
reach of the river since the Coy Diversion was constructed.
Additional space on the river banks, created by narrowing the river channel, will incorporate: a river
overlook; terraced seating areas on the south river bank; ADA river access; put-in/take-out areas,
habitat enhancements; and a pedestrian bridge over the river.
Flood Mitigation and Bank Stabilization
Specific issues and potential opportunities associated
with flood mitigation and bank stabilization include
the following:
Currently, 100-year flows overtop College Avenue.
Removal of the Coy Ditch Diversion structure and
the boat chute, while lowering the channel bed
through this reach, would eliminate overtopping
of College Avenue during the 100-year flood
(provided adequate real-time maintenance is
provided at the UPRR Bridge upstream of College
Avenue).
Currently, 100-year flows spill east along Vine
Drive, requiring the definition of a regulatory split
flow path from Linden Street to Dry Creek, near
Lemay Avenue. It appears that by removing the
Coy Diversion and the boat chute, as well as
implementing a combination of additional
improvements (which include opening up the
north overbank under the BNSFRR Bridge and
reducing the floodplain constriction at Linden) it
would be possible to eliminate the 100-year flow
split along Vine Drive or reduce the split to
nuisance/non-regulatory flood levels.
Bank stabilization and improvements include revegetation portions of both banks along with either
rock riprap toe protection or, where banks are near vertical, stacked boulder toe protection.
Habitat/Ecological Restoration and Protection
Specific issues and potential opportunities associated with habitat/ecological restoration and protection
include the following:
The Coy Diversion structure and boat chute significantly impact fish passage and create a large
upstream pool within the river. In addition, these structures are unattractive and visually dominant
features in the landscape. Fish passage and aquatic habitat improvements will be integrated into
the recreational improvements when both the Coy Diversion and boat chute are removed.

Existing river banks near the Coy Diversion are dominated by vertical concrete walls and steep
slopes. The existing concrete walls located on the north bank will remain because they provide
flood protection for adjacent properties and they are physically and functionally connected to the
historic Coy Headgate. The existing concrete walls on the south bank will be removed and replaced.
The new wall creates a raised terrace that provides a panoramic vista of the Poudre River and the
new whitewater park.
This stretch of the river is envisioned as an area that will accommodate visitor use that is higher than
adjoining reaches. Wildlife connectivity improvements will be provided along the river banks to the
greatest extent possible, although fragmentation will likely remain.
Wildlife connectivity is currently provided beneath College Avenue by the bridge’s northernmost
span and will be enhanced by improving vegetation along the north bank.
Improving the backwater and poor fish habitat condition upstream of Coy Diversion Structure by
reconfiguring/modifying/lowering the in-stream structures.
The river channel is designed to create riffles and pools similar to those present in the river
upstream and downstream of this reach.
This area contains a significant amount of non-native vegetation. Over time, non-native vegetation
will be replaced with native species.
Historically, the John G. Coy Ditch flowed through two small ponds in the Gustav Swanson Natural
Area. However, water is no longer being diverted at the Coy Diversion, and as a result the amount
of water passing through the ditch and the ponds has been greatly reduced. The west
pond/wetland will be disturbed as little as possible, and the Coy Ditch and the east pond will be
filled and these areas will be restored to blend with the surroundings.
Recreation and Access
Specific issues and potential opportunities associated with recreation and access include the following:
Approximately 9 feet of fall exists within the channel between College Avenue and the Burlington
Northern Santa Fe Railroad Bridge making it a very suitable location for a whitewater play park. The
master plan includes two whitewater wave features, each having 1.5 to 2 feet of fall.
Potential interpretive/educational topics for this section of the river include: historic power
generation techniques, geothermal, coal, demonstration water wheel, in-stream flow
measurements, Coy ditch, irrigation, the grotto, old water works facility (Gustav Swanson), etc. The
City and the design team are currently working with the Poudre Heritage Alliance to develop ideas
for the interpretive features.
The proposed site plan accommodates a future trail connection to Gustav Swanson Natural Area
under the north side of BNSF Railroad Bridge. However, this trail will not be constructed as part of
this project.

The proposed pedestrian bridge will greatly improve the north/south connection across the river
and provide a great place to watch people using the whitewater features.
This project includes a portion of the planned “History Walk”. The design team is working with Park
Planning and the Poudre Heritage Alliance to identify opportunities for historic interpretation.
Interpretive features will be incorporated into the final design.
Bike parking spaces are provided in close proximity to the parking lot and the overlook, outside of
the floodway.
Lighting is required for safe access. Where practical, low level, down directional, accent type lighting
is used. Ornamental pedestrian pole lights are used along primary trails and near steps. Lighting will
terminate at 11 p.m..
The plan includes the City’s first ADA river access and accessible fishing.

(ii) Description of proposed open space, wetlands, natural habitats and features, landscaping,
circulation, transition areas, and associated buffering on site and in the general vicinity of the project.
An Ecological Characterization Study (ECS) is included with the PDP submittal. The following is an
excerpt from the ECS.
The Poudre River Whitewater Park project is designed to preserve and enhance the ecological character
and function and wildlife use of its natural habitat and features, and to minimize and mitigate for
development impacts by addressing the features below.
Fish passage. Removal of the Coy Ditch diversion and existing concrete flume will improve fish habitat
connectivity. While one objective of the project is to provide whitewater kayakingopportunities, an
equivalent focus of the kayak course design is fish passage and how aquatic species may benefit from
channel modification. Currently fish migration is restricted through this reach; channel modifications will
allow fish to resume active migration.
Aquatic habitat. Enhancement of aquatic habitat will be achieved by a system of pools, riffles, and runs
within the Poudre River channel, and enhanced fish passage in the “north bay” (between the
northernmost piers on the north bank) beneath College Avenue.
Streambank protection. Increased native woody plantings along the river and retention of some large
non-native crack willow will provide streambank protection and improve aquatic habitat (e.g., via
moderation of ambient and water temperatures, and leaf litter input). In addition, designated visitor
access points will minimize trampling and divert pedestrians from forested areas that may be used by
wildlife.
Riparian and upland habitat. The riparian zone within the currently overwide channel will be enhanced
by terracing the riverbank and reducing the artificially wide channel to allow for more natural riparian
habitat. Additionally, numerous non-native species will be removed from the riparian zone and
replaced with native riparian trees. This focus on woody species will create an abundance of habitat
opportunities for birds, insects, and small mammals in the form of forage, pollination, nesting,
protection, and migration opportunities. Note that willow stakes and riparian seeding and plugs will
complement the canopy plantings.

Currently the upland areas north of the Poudre River are in a degraded condition, dominated by non-
native species and featuring little structural or compositional diversity. A diverse assemblage of native
trees, fruit-bearing shrubs and herbaceous species including graminoids and showy forbs (e.g.,
milkweeds) will bring enhanced grassland and pollinator habitat opportunities to the site.
Significant trees and existing wetlands. Existing significant native trees, wetlands, and other native
vegetation will be preserved to the extent possible in order to protect old growth, character, and
habitat. Design was influenced by currently significant trees; one example is the staircase on the south
bank, which was diverted around a grove of willows. Similarly, pedestrian trails were designed to go
around trees instead of removing the trees to accommodate trails. Last, the layout and size of the
parking lot and the trail around it were designed to avoid removal of existing spruce, silver maple,
chokecherry, and Rocky Mountain juniper, as well as the nearby existing wetlands. Mitigation for the
necessary removal of certain individual trees will exceed city requirements.
Coy Ditch BMP. The eastern portion of the former Coy Ditch will be modified to create a Low-Impact
Development BMP. Re-grading will reduce the side slopes of the ditch, thus encouraging a wider variety
of native vegetation and improving the passive treatment of waters that drain from Vine Drive and the
parking lot.
Use and density. Of the eleven (11) total acres across the project area, 1.5 acres will support higher than
current activity levels. These higher activity levels will be at the parking lot and at the river between
whitewater features. Recreational users including kayakers will be restricted to relatively small areas on-
site. Kayakers and others accessing the river will have well-defined access areas that will protect riparian
areas not intended for access. Trails are designed to protect existing trees, to minimize the potential for
creation of social trails, and also to allow for a substantial riparian margin, i.e., they are not directly
adjacent to the river. An exception to this is an ADA path on the north bank that allows direct access to
the water. The trail near the Xcel regulator station will be very close to the station’s fencing to restrict
fragmentation and the overall area of disturbance, and all uses around the pond in the northern part of
the project area will be passive.
While the south bank of the Poudre does draw high concentrations of users, this is one of the few places
along the river corridor where this opportunity exists. The park was designed with the intention of
accommodating recreational opportunities along this south bank, consistent with the Poudre River
Downtown Master Plan, with plantings of shrubs and trees intended to soften the effect and user
impacts. Indeed, the current reach is characterized by a vertical wall, so a combination of hardscaping
(trail, overlook, staircase) and strategic plantings will improve both the ecological function and aesthetic
of this area. From the standpoint of river management between Shields and Mulberry, providing a
concentrated area such as this as a community gathering place should reduce similar demands in other
reaches throughout the downtown corridor.
Quality of runoff water. The primary sources of stormwater through the site will be from Vine Drive and
properties north of Vine Drive. All runoff will be treated with the following features.
A BMP feature called a SNOUT (http://www.bmpinc.com), a hooded outlet cover, will pre-treat
storm runoff from Vine Drive and the parking lot in the northeast corner of the property by
removing floating debris and pollutant-carrying sediment. Two will be installed on Vine Drive and

one in the parking lot. Note that the parking lot will occupy a very small proportional area of the
park and be a minimal contributor of storm runoff relative to off-site sources.
The existing stormwater retention pond in the northeast corner of the site (adjacent to Vine Drive)
will be modified to act as a standard water quality pond. As such, it will treat local storm runoff
from Vine Drive and several properties north of Vine between Jerome and Redwood Streets.
A grass-lined swale between Vine Drive and the western wetland (adjacent to the Quonset hut on
the east side) will treat local storm runoff from Vine Drive and properties north of Vine Drive
between College Avenue and Jerome Street.
The existing wetland along Coy Ditch south of the parking lot ill be used as secondary bioswale
treatment for water quality before release to the Poudre.
The existing wetland south of the Quonset hut will continue to receive on-site runoff, formalizing its
current water treatment function.
Noise. All sources of noise will be attenuated by the planting of over 200 trees throughout the project.
Existing sources of noise are College Avenue, the Xcel regulation station, the railroads, and the Power
House Energy Institute to the south of the project
(iii) Statement of proposed ownership and maintenance of public and private open space areas;
applicant's intentions with regard to future ownership of all or portions of the project development plan.
The developed property and outdoor use spaces will be maintained by the City of Fort Collins.
(iv) Estimate of number of employees for business, commercial, and industrial uses.

(v) Description of rationale behind the assumptions and choices made by the applicant.
Located within the Public Open Lands (P-O-L) and Community Commercial – Poudre River District (C-C-
R) zone districts, this project exemplifies the purpose and standards envisioned for this district in the
Land Use Code.
The purpose of the P-O-L zone district is stated as follows:
P-O-L Zone District Purpose. The Public Open Lands District is for large publicly owned parks
and open lands which have a community-wide emphasis or other characteristics which warrant

inclusion under this separate designation rather than inclusion in an adjoining neighborhood or
other District designation.
The Poudre River Whitewater Park meets this purpose by creating a publicly owned park that is:
well connected to the community; provides access to nature; unique opportunities for
recreation; and improved flood protection. The proposed use is compatible with surrounding
uses, and incorporates a series of trails linking areas north of the river to Downtown.
The purpose of the C-C-R zone district is stated as follows:
C-C-R Zone District Purpose . The Community Commercial - Poudre River District (C-C-R) is
for downtown fringe areas in the Cache la Poudre River corridor with both public street frontage
and River frontage. This District provides locations for redevelopment or development of
moderate intensity uses that are supportive of Downtown, subject to floodplain restrictions. Such
redevelopment or development shall be compatible with the scenic, cultural, natural and
historical context of the River and Downtown.
A main purpose of the District is to foster a healthy and compatible relationship between the
River, the Downtown and surrounding urban uses. Any significant redevelopment shall be
designed as part of a master plan for the applicable group of contiguous properties.
The Poudre River Whitewater Park meets this purpose by preserving and enhancing portions of
the floodplain as open space.
(vi) The applicant shall submit as evidence of successful completion of the applicable criteria, the
completed documents pursuant to these regulations for each proposed use. The Planning
Director may require, or the applicant may choose to submit, evidence that is beyond what is required in
that section. Any variance from the criteria shall be described.
The submittal includes items required for Project Development Plan submittal as well as other items
requested from the Planning staff.
(vii) Narrative description of how conflicts between land uses or disturbances to wetlands, natural
habitats and features and or wildlife are being avoided to the maximum extent feasible or are
mitigated.
There are no significant conflicts between land uses. However, fence improvements are planned to
screen views of the Xcel Regulation Station, the Kundla property and the Upham property. See
description to item ii above.

A neighborhood meeting was held on October 17, 2016, and the following concerns were raised by
community members:
Bike and pedestrian safety and crossings along Vine Drive – additional sidewalks are planned
on the south side of Vine creating improved connections to surrounding neighborhoods. The
existing bike lanes on Vine Drive will remain.
Interest in a restaurant/patio overlooking the project – This is a nice idea, but public parks do
not include commercial facilities. However, it is possible that future private development in
surrounding areas could incorporate these types of uses.
Adequate Parking –people expressed concerns about the limited quantity of parking available in
this area and worried that visitors may have to park on streets and in adjacent developments.
The site plan incorporates adequate parking for whitewater park’s anticipated use, and a
potential future parking lot is allowed for in the event that additional parking is necessitated in
the future.
Flooding –the proposed development will not create a rise in the Base Flood Elevation. In fact,
flood elevations will be improved in many areas within the project area and in surrounding
areas.
Impacts on Wildlife – concerns were raised about impacts to wildlife along the Poudre River. The
proposed development meets the intent Division 3.4 Environmental, Natural Area, Recreational
and Cultural Resource Protection Standards. An Ecological Characterization Study was prepared
for the site. The site and landscape plan details are based on the results and recommendations of
this study including implementation of a landscape buffer along the creek, habitat
enhancements, and native plant species.
