8263 Southeast Community Park between
The City of Fort Collins and ECI Site Construction Management, Inc.
This second Amendment (“Amendment #02”) is entered into by and between ECI Site Construction
Management, Inc. (the “Service Provider”) and the City of Fort Collins, Colorado (the “City”).
WHEREAS, Service Provider and the City have mutually entered into a SE Community Park
Construction Agreement dated May 9, 2016 (the “Agreement”); and
WHEREAS, Service Provider and the City have mutually entered into an Addendum #1 dated July
19, 2016, adding $54,465 (the sum of D-3, D-4 & D-9) to the Contract Price; and
WHEREAS, City Council approved the appropriation of additional funds to the SE Community Park
Construction project using Capital Expansion Funds under Ordinance No. 094, 2016; and
WHEREAS, Park Planning & Development would like to re-incorporate the remaining deductive
alternates back into the Contract;
NOW, THEREFORE, in consideration of the foregoing recitals and the mutual promises herein
contained, the parties agree as follows:
SECTION 00520, Article 4, Contract Price is revised from ($8,376,040.94) to Nine Million Seven
Hundred Fifty-Two Thousand Four Hundred Seventy-Eight Dollars and Forty-Four Cents
($9,752,478.44). The revised Contract Price includes incorporation of the below stated tasks
and associated costs:
1. D-1: Concrete Band Scope Deduction $27,250.50
2. D-2: Gabion Wall Substitute $18,000.00
3. D-5: Sports Lighting Reduction $326,000.00
4. D-6: Hops Trellis Replacement $27,187.00
5. D-11: Baseball Restroom Elimination $386,000.00
6. D-12: Eliminate Farmhouse Pavilion $1,000.00
7. D-14: Eliminate Pervious Pavers and Substitute with Concrete Paving $32,000.00
8. D-18: Eliminate Basketball Court $49,000.00
9. D-20: Eliminate Community Garden $63,000.00
10. D-21: Eliminate Dog Park $42,000.00
11. D-23: Eliminate Ipe Deck, Harvest Room and Orchard $405,000.00
TOTAL COST ADDED TO THE CONTRACT PRICE: $1,376,437.50
CHANGE IN CONTRACT TIME ATTRIBUTABLE TO EXPANDING THE SCOPE TO INCLUDE
THE ABOVE LISTED TASKS: 56 days
Substantial Completion has been revised from May 9th, 2017 to July 5th, 2017.
Except as expressly amended by this Amendment #02, all other terms and conditions of the
Agreement, as previously amended by Amendment #01, shall remain in full force and effect. In the
event of a conflict between the terms of the Agreement as previously amended and Amendment #02,
Amendment #02 shall prevail.
