The questions deadline has been changed to June 6, 2016 at 5:00 PM. 2. The Opening Date has been changed to 3:00 PM (our clock) on June 14, 2016. 3. Interviews with the short-listed contractors will be held on the afternoon of June 28, 2016. MODIFICATION TO PAGE 7, SECTION I.C.2.a.ii – DELETE SECTION AND REPLACE WITH: ii. The contractor will prepare a “bid” to perform the work shown. The unit prices submitted in Attachment 3 of the Proposal will provide a starting point for the unit price negotiations based on the current level of design. The Contractor and the City will review the unit price assumptions, risks, quantities and other relevant factors and adjust the unit prices for the work accordingly as design progresses. It was noted that given the preliminary nature of the current plans (especially regarding the sub-surface storm sewer system) that the accuracy of unit price estimating at this stage of the project would be very limited and could vary significantly between the submitted proposals. The intent of requiring a Unit Price Cost Proposal is primarily for the City to assess the contractor’s understanding of the project and their proposed methods. The way in which the contractor presents assumptions, potential risks and mitigations, and preconstruction processes to reduce risk, are of greater importance than the actual value of the unit price (provided the unit price is within a reasonable range and supported with reasonable assumptions). The evaluation Criteria in Section IV. emphasizes the contractor’s understanding of the project and the reasonableness of their assumptions, potential risks and mitigation strategies. The provided unit prices should reflect the contractor’s thought process, assumptions, risks, mitigation, etc. The City recognizes that there may be significant refinements in the project subsequent to the submittal of the proposals – in fact the CMGC process should promote such refinements to the benefit of the project. The City will work with the contractor to identify all of the risks, assumptions and mitigations throughout the design process. It is NOT the City’s intent to hold the contractor to an unfair price if issues arise through the design that affects the unit prices. It is the City’s goal that the contractor makes a fair profit and the City pays a fair price for the actual work, and does not intend to hold the contractor to prices given early in the design phase if significant changes are made during the design. Similarly, the City should not be held to an unfair price, if through the design process, high risk items are clarified and mitigated. The City is looking to develop a relationship with the contractor based on teamwork, collaboration and trust to prevent disputes, and seeks to foster a cooperative bond that will mutually benefit all stakeholders.
