between the City of Fort Collins
and Bike Fort Collins
This First Amendment (“Amendment #01”) is entered into by and between the City of Fort Collins
(“City”) and Bike Fort Collins (the “Service Provider”).
WHEREAS, the City and the Service Provider mutually entered into a Services Agreement with
an effective date of March 1, 2014 (the “Agreement”); and
WHEREAS, on March 2, 2016 the parties renewed the Agreement and revised the Scope of
Work; and
WHEREAS, the parties desire to amend the Scope of Work to remove the requirement for
Transfort/Parking Services to provide staffing support at the Service Provider’s Kiosk; and
WHEREAS, both parties agree to the changes;
NOW, THEREFORE, in consideration of the foregoing recitals and the mutual promises herein
contained, the parties agree as follows:
1. Section 1, Paragraph 2, Scope of Work. Delete the following:
“c. Transfort CSRs shall be cross-trained to assist with FCBS checkouts using technology
provided by Zagster Inc..”
2. Section 2, Scope of Work. Delete the following:
“Transfort Customer Service Support (further outlined in Section 1):
1. Transfort/Parking Services staff will be available to provide customer service support (as
outlined below) to the FCBS Kiosk an average of 7-10 hours per week (adjusted for seasonal
hours), an estimated 286.5 hours per year (hours will be determined by Transfort/Parking
Services, FC Bikes and Service Provider).
2. Transfort/Parking Services staff will offer check-out or check-in assistance and other services
inside the FCBS Kiosk.”
Except as expressly amended by this Amendment #01, all other terms and conditions of the Agreement,
as previously revised March 2, 2016, shall remain in full force and effect.
IN WITNESS WHEREOF, the parties have executed this Amendment #01 the day and year shown.
