8263 Southeast Community Park between
The City of Fort Collins and ECI Site Construction Management, Inc.
This first Amendment (“Amendment #01”) is entered into by and between ECI Site Construction
Management, Inc. (the “Service Provider”) and the City of Fort Collins, Colorado (the “City”).
WHEREAS, Service Provider and the City have mutually entered into a SE Community Park
Construction Agreement dated May 9, 2016 (the “Agreement”); and
WHEREAS, the City’s Invitation to Bid contained multiple deductive alternates that were incorporated
into the Agreement; and
WHEREAS, some of the deductive alternates removed components of the same item in error,
effectively double-counting certain deductive alternates;
WHEREAS, the Contract Price is incorrect and the parties wish to amend the Agreement to
incorporate the correct Contract Price;
NOW, THEREFORE, in consideration of the foregoing recitals and the mutual promises herein
contained, the parties agree as follows:
SECTION 00520, Article 4, Contract Price is revised from ($8,321,575.94) to Eight Million Three
Hundred Seventy-Six Thousand Forty Dollars and Ninety-Four Cents ($8,376,040.94). The
revised Contract Price includes incorporation of the funds from the following deductive
alternates erroneously omitted:
1. D-3: Dog Park Corral Trellis Reduction: $10,390
D-4: Dog Park Trellis Reduction: $10,075
(Both deducts are components of deducted item D-21: Eliminate Dog Park - $42,000)
2. D-9: Orchard Trellis Structure Reduction: $34,000
(Deduct is a component of deducted item D-23: Eliminate Ipe Deck, Harvest Room & Orchard - $405,000)
TOTAL COST ADDED TO THE CONTRACT PRICE (Sum of D-3, D-4 & D-9): $54,465
Except as expressly amended by this Amendment #01, all other terms and conditions of the
Agreement shall remain in full force and effect. In the event of a conflict between the terms of the
Agreement and Amendment #01, Amendment #01 shall prevail.
