Mason St. 2nd Floor PO Box 580 Fort Collins, CO 80522 970.221.6775 970.221.6707 fcgov. coaVpurchasing The City of Fort Collins ("City") acknowledges there is inherent risk of damage involved with draining pools due to hydrostatic pressure. We understand your subcontractor Acapulco Pools has advised DS Constructors that there is a risk of damage to the surface of the EPIC pools if the hydrostatic pressure is not properly relieved and supervised during the drainage process. The damage that may occur may be in the form of: tile upheaval, tile cracking, the pool shell may move, damage to preexisting piping and/or damage to grout and other damages that might occur under such circumstances. The City is responsible for draining the pools prior to DS Constructors work commencing. Consequently, any damage to the pools that occurs from the City draining them will be the City's sole responsibility. The City therefore agrees that DS Constructors is released from any and all liability and/or financial responsibility stemming directly from the City draining the pools. Notwithstanding the foregoing, DS Constructors shall be solely responsible for any and all other damage to the pools and EPIC facility caused by DS Constructors or by its subcontractors which is not attributable to the City's pool draining process. If complications occur as a result of the City's pool draining process, the City acknowledges this may impact the schedule and scope of the work under the City's contract with DS Constructors, and could justify a change order under that contract justifying an extension of the project completion date.
