Mason St, 2"d Floor PO Box 580 Fort Collins CO 80522 RE: BID 8198 Transfort Reroof- Good Faith Effort Determination Dear Mr. Paul, The letter is in response to the rejection letter for the Good Faith Effort on the Transfort Reroofing project in Fort Collins, Colorado. It is our understanding that the City of Fort Collins is rejecting our bid and labeling it as non -responsive because of insufficient documentation and effort before the bid opening. Furthermore the City of Fort Collins is stating that we did not meet the goal of 5% DBE and did not seek out DBE accreditation companies prior to the bid opening. At Select Roofing Contractors, LLC, we believe we did bid the project as per the bid documents provided by the City of Fort Collins and can complete the project within the schedule requirements. Our goal is to provide quality roofing products and services that exceed industry standards and take pride in our work at any progression in the project. Select Roofing Contractors, LLC, would like the city to reconsider our efforts and appeal the non -responsive bid due to the goal of 5% DBE. The bid documents were not clear that the goal of 5% DBE was supposed to be a requirement before the bid opening. The invitation to bid section 00020 calls out "the DBE goal of 5%". We were understanding that it was a goal of the city —something to achieve, but not required. It does not say that the DBE was required in the documents. Furthermore the invitation to bid section 00020 calls out that "if the apparent low bidder does not meet the project DBE goal, three copies of the contractor's good faith effort needs to be submitted to the City of Fort Collins Purchasing Department by 4pm on the next business day after the bid opening". It was our understanding that we needed to make an "effort" during this time period. We did this and it was acknowledged in the rejection letter that we did make an "effort" after bid time. The instructions or the invitation to bid does not say this process was required before the bid opening. For these reasons we feel we followed the instructions correctly and bid the project as per the bid documents. We would ask the City of Fort Collins to reconsider our bid proposal. We also think the language in the bid documents needs to be rewritten for more clarity on the DBE, specifying if it is required or not.
