Mason St. 2n' Floor PO Box 580 Fort Collins, CO 80522 970.221.6775 970.221.6707-fax fcgov. com/purchasing RE: 1) BID 8198 Transfort Reroof 2) City Good Faith Effort Determination dated December 22, 2015 3) Select Roofing Administrative Reconsideration dated December 28, 2015 Dear Mr. Stanevich: Pursuant to 49 CFR Part 26.53 (d) in the reference 2 letter dated December 22, 2015 the City provided Select Roofing the opportunity for Administrative Reconsideration and the opportunity to meet with the City. After a thorough review of your response letter dated December 28, 2015, the City has reaffirmed that you have not sufficiently documented that you have made a good faith effort to meet the DBE goal of 5% set by the City. To be considered responsive to the bid, Select Roofing needed to either; 1) achieve the 5% DBE goal; or 2) demonstrate good faith efforts. In accordance with the U.S. Department of Transportation guidance concerning good faith efforts a "...bidder must show that it took all necessary and reasonable steps to achieve a DBE goal ... by their scope, intensity, and appropriateness to the objective, could reasonably be expected to obtain sufficient DBE participation, even if they are not fully successful." "The efforts employed by the bidder should be those that one could reasonably expect a bidder to take if the bidder were actively and aggressively trying to obtain DBE participation sufficient to meet the DBE contract goal." As required by 49 CFR Part 26.53, good faith efforts must be completed prior to submission of the bid. Based on the documentation provided, we found no evidence that Select Roofing actively solicited DBE participation prior to submittal of the bid. In conclusion, this Administrative Reconsideration has determined that Select Roofing's bid is non responsive because good faith efforts have not been adequately documented. Pursuant to 26.53, the result of the reconsideration process is not administratively appealable to the Department of Transportation.
