RE: Transfer of Auction #1457644 Mobile Office Trailer (former use: Santa’s House)
Dear Mr. Wiebke:
This letter of understanding and agreement between the Downtown Development
Authority, the City of Fort Collins and Mr. Steven H. Wiebke is hereby executed to affect
the transfer of the above equipment.
The above said equipment is being transferred from the Downtown Development
Authority to Steven H. Wiebke with the understanding that the equipment is accepted in
“as-is” condition and no guarantees or warranties of any kind are attached. In addition,
all care, maintenance, or repair costs are the sole responsibility of Mr. Wiebke.
The Downtown Development Authority has agreed to reimburse Mr. Wiebke the sum of
$1,255.00 for unforeseen expenses incurred during the transportation of the above
trailer. In return, Mr. Wiebke hereby agrees that upon receipt of those funds the matter
is now resolved and he will make no further claims against the Downtown Development
Authority or the City of Fort Collins regarding this matter or any other issue related to
the purchase of the Mobile Office Trailer referenced above.
As a result of the consideration of $1255.00 paid to Steven H. Wiebke, Mr. Wiebke, on
behalf of himself, his heirs, assignees and agents, further agrees to RELEASE AND
FOREVER DISCHARGE both the Downtown Development Authority and the City of
Fort Collins, their elected or appointed officials and officers, employees, former
employees, agents and attorneys, in their official and individual capacities, from any and
all obligations, claims, liabilities demands and causes of action, whether known or
unknown, which they ever had or may hereafter acquire arising out of the purchase,
transport, operation or use of the #1457644 Mobile Office Trailer referenced above.
Upon execution of this transfer, Steven H. Wiebke accepts and agrees to the terms and
conditions of this transfer and may dispose of the equipment as he sees necessary at
any time in the future.
