Re: MOU for Cost Sharing Improvements at the Environmental Learning Center
Background
Recently the existing vault toilet located at the Environmental Learning Center was discovered
to be leaking and in a state of disrepair. Colorado State University has taken the lead on the
project and is proposing the removal and replacement with a new vault toilet. C.S.U. has asked
the City of Fort Collins to be a financial partner in this project.
Recommendation
Because this replacement project will be constructed directly adjacent to the trail and will
benefit the trail user, staff supports a $10,000 City contribution to the project. The total cost of
the project is estimated at $60,000.
The attached Memo of Understanding outlines the details of the agreement. It has been signed
by C.S.U. officials and requires your signature to complete.

MEMORANDUM OF UNDERSTANDING
Regarding Cost Sharing for Improvements at Environmental Learning Center
This Memorandum of Understanding (MOU) dated March O/, 2015, outlines
collaborative efforts between the City of Fort Collins ("City") by and through its Park Planning
& Development Division and The Board of Governors of the Colorado State University System,
acting by and through Colorado State University ("CSU"), for the benefit of the Facilities
Management Department, to support the improvement of facilities at the Environmental
Learning Center (ELC), located at 3545 East Drake Road; Fort Collins, CO.
The goal of this MOU is to facilitate completion of upgrades to the restroom facilities at
the ELC to enhance user experiences and increase educational and adjacent recreational use of
ELC resources.
I.BACKGROUND
A. The City and CSU entered into an intergovernmental agreement (IGA), dated
December 15, 1997, to further the purposes of the Poudre River Environmental Learning District
Conceptual Land Use Plan (Land Use Plan), completed in April 1997.
B. The Land Use Plan was prepared in a collaborative effort to define a conceptual
outline of potential uses on adjoining parcels of land owned by the City and CSU, where the City
maintains a recreational trail and CSU has built the ELC, an outdoor laboratory for natural and
cultural research and education.
C. The mission of the Fort Collins Park Planning & Development Division is to
provide enjoyable parks and trails for the citizens of Fort Collins, long-range acquisition and
development of parks and trails, and oversight of park and trail construction and review of
developments within residential and commercial areas.
D. The Facilities Management Department is committed to quality competitive
service. Its mission is to anticipate and provide the physical environment which enables CSU to
achieve its objectives in instruction, research, and public service.
E. The vault toilet located at the ELC failed in 2014, and was closed by CSU.
F. The vault toilet has been maintained and available for public use, and the parties
desire to continue to keep the toilet open and available for public use after its replacement.
G. In furtherance of the goals in the IGA, the Land Use Plan, and the mutual benefits
received by the parties through full operation of the ELC, the parties desire to document their
collaborative efforts to install a replacement vault toilet at the ELC.
H. RESPONSIBILITIES
With regard to planned improvement of the vault toilet facilities at the ELC,
1. CITY will provide:
a. facility replacement funding in the amount often thousand dollars ($10,000)
toward the direct costs incurred by CSU for replacement of the vault toilet at
the ELC trailhead, including the following aspects of the project, and as
further set forth in Exhibit A -Project Description, attached hereto:
• remediation of the existing site where the pit toilet failed
• installation of a new precast vault & facility
2. CSU will provide:
a. Project Coordination, including:
• Pumping and removal of existing pit toilet vault
• Excavation and Installation of new precast vault at appropriate elevation
above floodplain
• Construction of vault toilet structure, as depicted in the drawings attached
hereto as Exhibit B
• installation of all necessary sidewalks to connect it to adjacent bike trail
b. Pumping, operation and maintenance of improved vault toilet facilities.
c. Acknowledgement on the improved facilities of the City's contribution toward
the cost of improving the facilities in the form of the City's name/logo and the
name of the Park Planning & Development Division.

EXHIBIT A
Project Description
ELC Toilet Replacement Project
The old pit toilet at the Environmental Learning Center failed in
2014. The bottom of the vault rotted out requiring Colorado State
to pump out the vault and close the facility. While the ELC is owned
and operated by CSU, the bike trail along the river through this
property sees an enormous amount of traffic from the community.
As a result, Colorado State reached out to the City to propose cost
sharing a replacement facility.
The new facility (shown in the attached drawing), will provide a
facility similar to other units at parks & open spaces in the area. The
toilet will be fully accessible. The cost of this project is estimated at $75,000 — this includes:
- remediation of the existing site where the vault failed
- installation of a new precast vault & facility
- installation of all necessary sidewalks to connect it to the adjacent bike trail
