HomeMy WebLinkAbout423216 NORTH AMERICAN BUS INDUSTRIES NABI - CONTRACT - RFP - P1065 TRANSFORT BUSES (2)Amendment No. 6 AGREEMENT TO PURCHASE 60-FOOT, ARTICULATED, LOW FLOOR, HEAVY DUTY, CNG-FUELED TRANSIT BUSES This Amendment to the Agreement to Purchase 60-foot, Articulated, Low Floor, Heavy Duty, CNG-fueled Transit Buses, dated the 27th day of April, 2010, which includes Amendments 1 through 5 and this Amendment No. 6, dated September 10th, 2014 (the "Agreement"), is hereby entered into by and between the City of Fort Collins, Colorado, a municipal corporation {the "City"), and NABI BUS, LLC (previously known as North American Bus Industries, Inc.) a US corporation located in Anniston, Alabama, (the "Contractor"). Amendment dated this 10th day of September, 2014 (Amendment No. 6) The following sections of the Agreement are amended to read as follows: Scope of Work B. Contractor will deliver two (2) buses and related equipment no later than the May 31, 2015. The City intends to issue a new purchase order for the additional two (2) buses including the following price adjustments noted below to each bus. It is understood by both parties that the two (2) buses will be produced in a single production run. All buses will be delivered to the City's Transfort facility at 6570 Portner Road, Fort Collins, CO 80525. Compensation B. The Agreement price, for the purchase, manufacture, delivery, and final acceptance for the two (2) Model 60-BRT Transit Buses is Eight Hundred Sixty -Five Thousand, Six Hundred Forty -One Dollars ($865,641) per bus, per NAB] letter dated August 25, 2014. The price re -determination is the contract awarded price adjusted according to the Bureau of Labor Statistics Producer Price Index (PPI) for Truck and Bus Bodies WPU1413. Fort Collins 60ft CNG 291000 pricing — April 2012 — $842,337.00 PPI — June 2014 — $23,304.00 Further changes to the Agreement price, per unit, must be negotiated and approved by both parties. Any price increases shall be justified by appropriate documentation of an increase in PPI unless the increase is due to approved changes. Approved changes in options, bus configuration, or other services, shall be in the form of an Option & Equipment Revision form, which will become written amendments to this Agreement, and may result in an adjustment to the amount of compensation to which Contractor and the City have initially agreed.
