Under this work order, Stillwater Sciences and its subcontractors will provide design, field data collection, construction cost estimates, and permitting services for the ELC diversion structure. Service Provider agrees to perform the services identified above and on the attached forms in accordance with the terms and conditions contained herein and in the Master Agreement between the parties. In the event of a conflict between or ambiguity in the terms of the Master Agreement and this Work Order (including the attached forms) the Master Agreement shall control. Phase 1: Data Collection & Design Development Project Management The firm will attend a project grounding discussion to understand full scope and history of the project, a kick-off meeting, and regularly scheduled progress design status meetings with City staff. Project meetings will likely consist of bi-weekly coordination conference calls or in-person meetings to facilitate discussion of design-related questions and to share information and progress. The firm will prepare email summaries of the bi-weekly conference calls or in-person meetings for distribution to the project team (i.e., the firm and its subconsultants and City staff). City staff will approve the email distributions for this internal project team use. Assumptions and deliverables: Project duration is approximately 6 months, from Jan 2020 through June 2020 (per RFP), with an understanding that delays beyond the firm or the City’s control may extend project duration to 9 months. Project Management (PM) deliverables consist of email summaries of bi-weekly coordination conference calls or in-person meetings. Data Collection and Analysis The firm will collect relevant data regarding the project site which includes wetland delineation, surveys for Threatened & Endangered Species, cultural and historical resources, tree surveys, topography, utility line locations, and geotechnical surveys. Roughness and riparian vegetation will be mapped to inform 2D hydraulic modeling outputs. A survey will be conducted to identify on-site materials such as boulders, wood, and cobbles to inform construction costs. The firm will conduct bathymetric survey of both channels to develop numeric models and a drone flight to develop a digital elevation model (DEM). Water level monitoring data will be collected in both channels using data loggers. Sediment data will also be collected to model sediment transport. A geotechnical report will also be prepared to help guide the development of alternatives that includes maps and boring hole data. Prior to the development of alternatives, the design team will be required to attend an initial meeting with the City’s Floodplain Administrator and Master Planning Engineer concerning the proposed project. This will allow the Consultant and the City to discuss the project, required approach, models to be used, and available mapping. This meeting is a requirement outlined in the City of Fort Collins Floodplain Modeling Guidelines. A few weeks after the above meeting and prior to conducting the alternative analysis, the design team will be required to provide the City with their initial model setup and a brief technical memo to outline their hydraulic modeling approach. The City will provide a review of this model set-up and the Consultant will be required to respond to any comments. Due to Colorado State Law SB 18-167 regarding utility investigation during design, the Consultant (or subconsultant) will be required to perform a Subsurface Utility Engineering (SUE) plan in accordance with State law. This shall include a utility plan developed to Quality Level B or better per ASCE standards and stamped by a licensed Professional Engineer in the State of Colorado. Utility mapping data will be provided in electronic CAD format to inform Phase 1 analysis of alternative solutions. The Consultant (or subconsultant) will complete all SUE work for this project and will deliver final SUE plans after 30% design. HKS will provide plan sheet(s) for inclusion in the 60% design plan set, as well as utility logs, memos, utility research, existing plans and as- builts, and other information obtained and developed through the SUE process. The licensed engineer shall be ASCE 38 certified. • The Consultant (or subconsultant) shall have a thorough understanding of subsurface utility engineering and associated standards and requirements • It is anticipated that final SUE plans will be delivered after 30% design, however, preliminary work will likely be required during preliminary design. The same Consultant/subconsultant should be used to complete the both the SUE plan and preliminary design. • The Consultant shall provide plan sheets to be incorporated into the project plan set, utility logs, memos, utility research, existing plans and as-builts, as well as other information obtained and developed through the SUE process to the City. Assumptions and deliverables: No formal deliverable will be produced to document data collection/survey, as this information will be included in the basis of design memorandum produced at the end of Phase 1, as described below. Approximate potential boundaries for jurisdictional waters of the U.S., including wetlands, in close proximity to anticipated work areas will be identified to help inform development of the permitting checklist in Phase 2. Clearances for threatened and endangered (T&E) species in support of Section 404 permitting is included in this scope of work, with level of effort assumed to include desktop investigations and potential for brief supporting fieldwork. No additional geotechnical borings will be required, and existing information will be sufficient to produce a Geotechnical Engineering Report to help guide the alternative development. Supporting analyses Lithos will complete, as needed, include evaluation of structure and foundation elements, subgrade stabilization and improvement to reduce the need to tie structures into bedrock to resist scour, ground improvement alternatives, constructability recommendations and evaluation of geotechnical related risks and mitigation alternatives. Initial utility mapping will be based on QL B designation. Supplemental field investigations will be required and recommended based on this initial mapping. The following efforts are not expected to be necessary for this project: QL B designation of storm and sanitary sewers, exploratory excavation, quality level upgrades, excavation of materials other than soil, work on section corners or corner monument records, and right-of-way, boundary, or easement delineation. An Existing Utility Plan will be produced. Develop and Model Design Alternatives The firm will develop design alternatives using an iterative process. The firm will provide several design variations along with design-support modeling and thorough analysis of hydraulic function, stability, sediment transport, aesthetics, geotechnical constraints, floodplain mapping, maintenance, preliminary cost estimate, opportunities for Page 4 of 12 DocuSign Envelope ID: DD1C6814-475A-4E2B-8D64-374C00E88E29 Utilities Work Order Form Official Purchasing Form Last updated 10/2017 geomorphic and ecological improvement, and scour issues. Written descriptions and concept drawings will be provided for each alternative. All alternatives must meet all local, state, and federal floodplain requirements. A matrix will be provided with impacts analysis provided for each alternative (e.g. geomorphology, floodplain, wetlands, water rights, permitting requirements). Potential U.S. Army Corps of Engineers (USACE) permitting requirements will be provided for each alternative. The City, together with input from the firm, will select the preferred alternative with support from a group scoring exercise using a multi-criteria decision analysis tool. Assumptions and deliverables: Conceptual design information, including plan view, supporting narrative, and preliminary opinions of probable cost, for up to 4 alternative solutions will be provided for City consideration and comment. To support the City with the annual budget process, an initial construction cost estimate will be provided for the City at the end of March for the alternative (out of the up to 4 being evaluated) that is anticipated to be the most expensive to implement. Hydraulic modeling & Sediment Transport Analysis The firm will use a detailed HEC-RAS one-dimensional (1D) hydraulic model as the hydraulic basis of the design with detailed survey of the project site. When more complex hydraulic conditions warrant, the firm will develop a two-dimensional (2D) hydraulic with the same detailed survey data. For the most complex hydraulic questions and conditions on-site, the firm will use 3D modeling where warranted and with approval from the City’s Floodplain Administrator and Master Planning Engineer. All hydraulic models submitted to the City of Fort Collins should be in a FEMA approved modeling platform. When selecting a 2D modeling platform for design, consideration should be given to the possible iterative approach necessary to achieve a diversion design that can be incorporated into the 1D regulatory model. This approach will be discussed in the required initial meeting with the City’s Floodplain Administrator and Master Planning Engineer concerning the proposed project as outlined in Section 3.1 of the 31Thttps://www.fcgov.com/utilities/img/site_specific/uploads/fp-modeling.pdf31T. This document can be found online and should be reviewed in detail prior to any submission to the City of Fort Collins. The firm will also conduct sediment transport analyses to determine the full effect of each design alternative on water and sediment dynamics. Assumptions and deliverables: 2D modeling will be used in support of analysis and design, including to better understand complex split flow conditions. If review of 2D modeling results suggests that application of 3D modeling is warranted (i.e., at the point of diversion), the firm will coordinate with the City prior to initiation of 3D modeling efforts. 2D and 3D modeling results will inform the regulatory 1D model. Sediment transport analysis includes incipient motion calculations, as well as application of sediment transport equations to integrate transport over the entire flow duration curve (FDC) to estimate water/sediment balance through time. Fieldwork will include a minimum of 3 pebble counts. A preliminary basis of design memorandum, documenting data collection/survey, analysis and design approach, geomorphic setting, and hydraulic and sediment transport analyses methods, limitations, and assumptions will be provided for City consideration Page 5 of 12 DocuSign Envelope ID: DD1C6814-475A-4E2B-8D64-374C00E88E29 Utilities Work Order Form Official Purchasing Form Last updated 10/2017 and comment. A working draft of the Multi-Criterion Decision Analysis (MCDA) matrix for comparison of up to 4 alternative solutions, along with the conceptual design information, narratives, and preliminary opinions of probable cost, will be provided to the City in support of a ranking and prioritization meeting with City staff to select the preferred alternative solution. II Phase 2: 60% Design & Construction Cost Estimate Design Report & Permitting Checklist The firm will prepare a 60% design following the selection of a preferred alternative. This design milestone will include USACE permits, and cost estimates, as well as technical specifications outline and draft sections of the technical specifications for primary construction items that affect feasibility, permitting, and/or cost estimating components of the 60% design effort. Focusing on key items in the 60% phase (with development of full technical specifications as part of final design) is a common practice that avoids inefficient expenditure of time and budget on specifications that require substantial revision upon completion of final design evaluations and design refinements. A draft design report will be included detailing assessment and feasibility of the diversion structure. The firm will meet with City staff to discuss the design report. The firm will identify all necessary permits and will initiate the permitting process at 30% design stage. A permitting checklist will be provided to the City detailing required permits and timelines. The firm will be responsible for identifying FEMA permitting associated with this project and initiating the permitting process, including CLOMR. The firm will coordinate FEMA permitting with the City Floodplain Administrator. In Phase 2, the geotechnical firm will provide construction recommendations, including temporary excavations, ground improvement (if needed), preparation of excavated surfaces for placement of fill and/or foundations, bedrock or oversize material excavation, compaction requirements, and acceptable structural backfill and site fill material types. The City anticipates hiring a contractor for construction during Phase 2. The Consultant team will work with the selected contractor as part of the project team. During Phase 2, the firm will coordinate closely with the City to identify the optimal timing of initiating the Section 404 permit application. The firm is responsible for preparing the Section 404 permit application, including Pre-construction Notification (PCN) materials, if one is required. Assumptions and deliverables: The preferred alternative is unknown at this time. To allow scoping of the level of effort required for structural/hydraulic analysis and 60% design, this scope of work includes costs that cover analysis and design efforts range of scenarios from simple surface-type diversion features to a modified concrete structure with Obermeyer gate. This range of alternatives aligns with the City’s priority of reducing impacts to natural fluvial processes. A modified concrete structure could be a non-channel-spanning structure or a very low height (i.e., 2-feet or less) structure. If a cross channel-spanning structure were needed, the firm will prepare a separate scope of work and fee estimate for consideration by the City. The importance of this cost assumption is that analysis and design efforts will be Page 6 of 12 DocuSign Envelope ID: DD1C6814-475A-4E2B-8D64-374C00E88E29 Utilities Work Order Form Official Purchasing Form Last updated 10/2017 greater for a cross-channel structure than what would be required for a simple surface- type diversion feature (e.g., naturalized riffle crest). This scope of work includes standard scour calculations and cutoff wall sizing and a vertical slide gate at approximately 3-foot by 3-foot dimensions, which are anticipated to accommodate the required 30 cfs diversion, based on professional judgment. Additionally, this scope of work includes analysis and design of small-scale fish passage measures (e.g., cascade feature on one side of the structure). This scope of work does not include analysis and design of a large height (i.e., over 2-feet) structure that requires retaining walls and more extensive fish passage accommodations (e.g., fish ladder). Additionally, this scope of work assumes that preliminary structure stability analysis will suffice for the 60% design effort (i.e., supporting feasibility investigations and development of a 60% level opinion of probable cost). The 60% structural analyses will include structure sizing to determine structure layout and estimate construction cost; and basic stability calculations to confirm feasibility. The final structure stability investigations (for final structural layout and geometry) will be completed as part of the future Final Design phase. The final structural stability calculations will include buoyancy/uplift, sliding, and rotation calculations for usual, unusual, and extreme conditions. Concrete and metals design and detailing would also occur as part of the future Final Design phase, and therefore not be included in this scope of work. Section 404 permitting requirements will be evaluated. This scope of work includes the level of effort suitable for Nationwide Permit or Regional General Permit authorizations. If an Individual Permit is required, the firm will prepare a separate scope of work and fee estimate for consideration by the City. The preliminary basis of design memorandum will be updated to include 60% analysis and design information for the preferred alternative. CLOMR Submittal During Phase 2, the design team will be required to attend a meeting with the City’s Floodplain Administrator and Master Planning Engineer to discuss CLOMR/LOMR setup, approaches, and any potential issues based on the selected alternative. At 60% design, if there is confidence in the details of the hydraulic structure, the Consultant will begin the CLOMR submittal. This will involve review through the City of Fort Collins prior to submittal to FEMA. Deliverables/Milestones Updated Project Schedule The schedule below is updated from the schedule provided in the Stillwater-FlyWater Team proposal to reflect anticipated start of work and to identify an interim deliverable by the end of March 2020 to provide the City with an initial construction cost estimate for use in City budget planning. The initial construction cost estimate will be based on best available information on the most expensive probable alternative diversion structure at the end of February. The Stillwater-FlyWater Team will recommend analyses for focus in March to reduce most uncertainty in construction costing (e.g., refine information on the highest cost drivers) to improve the initial estimate for planning purposes. Team member firm, The FlowPath, will complete the CLOMR for $38,500 LS. The updated fee estimate includes the change to $38,500 LS for the CLOMR (see Phase 2, Task 2 Permitting, including CLOMR - Task 7 in the fee estimate spreadsheet). The Federal Emergency Management Agency (FEMA) CLOMR fee of $6,750 is separate from the lump sum fee. The FEMA CLOMR fee was included as an expense (permit fee) under Task 7 in the fee estimate provided in the Stillwater-FlyWater Team proposal and is unchanged in the updated fee estimate. Task 7 includes additional time for The FlowPath to attend meetings with the City Floodplain Administrator and Master Planning Engineer. Hours for other team members were reduced in Phase 1, Task 1a Coordination Calls/Meetings (Task 1 in the fee estimate spreadsheet), such that the CLOMR preparation meetings do not constitute an increased total fee for the Project. For insurance provided by this endorsement only: 1. The exclusions, under the Liability Section of the policy, Paragraph H.1. Applicable to Coverage C - Liability Coverages, other than exclusions a., b., d., f. and i. and the Nuclear Energy Liability Exclusion, are deleted and replaced by the following: a. Bodily injury to: (1) An employee or co-employee of any insured arising out of and in the course of employment by any in- sured; or (2) Any employee, prospective em- ployee or past employee of any in- sured arising out of the employment relationship or prospective employ- ment relationship.
