AMENDMENT #01
AGREEMENT BETWEEN THE CITY OF FORT COLLINS
AND GILLIG, LLC
This First Amendment (Amendment #01) is entered into by and between the CITY OF FORT COLLINS
(the “City”) and GILLIG, LLC (the “Service Provider”).
WHEREAS, the Service Provider and the City entered into an Agreement effective March 12, 2018
(the “Agreement”); and
WHEREAS, Service Provider and the City desire to amend the Agreement to provide transportation
buses pursuant to the Agreement terms and revised options and Contract Sum attached hereto as
Attachment 1.
NOW, THEREFORE, in consideration of the foregoing recitals and the mutual promises herein
contained, the parties agree as follows:
1. Pricing. Exhibit B, Pricing, is hereby amended to incorporate revised bus components as set
forth in Attachment 1, consisting of two (2) pages, attached hereto.
2. Section 5, Contract Sum, is deleted in its entirety and replaced with the following:
The City shall pay the Service Provider for the performance of this Contract, subject to
additions and deletions provided herein, Five Hundred Sixty-Four Thousand Six Hundred
Forty-Three Dollars ($564,643.00) per 40ft LF CNG bus with selected equipment options for
a total of six (6) 40ft LF CNG buses, one (1) CNG Transfer Hose at a cost of Two Thousand
Six Dollars ($2,006.00), and one (1) spare Power Plant at a cost of Eighty-Eight Thousand
Nine Hundred Seven Dollars ($88,907.00) for a total spend of Three Million Four Hundred
Seventy-Eight Thousand Seven Hundred Seventy-One Dollars ($3,478,771.00) as per the
attached Exhibit "B", consisting of seventy-six (76) page(s), and incorporated herein by this
reference.
Except as expressly amended by this Amendment #01, all other terms and conditions of the
Agreement shall remain unchanged and in full force and effect. In the event of a conflict between the
terms of the Agreement and this Amendment #01, this Amendment #01 shall prevail.
IN WITNESS WHEREOF, the parties have executed this First Amendment the day and year shown.
