The purpose of this work is to assist you to develop a comprehensive position profile for the position and then to identify, recruit and present outstanding candidates who meet the criteria. Once the profile has been developed and approved, we will have no difficulty identifying quality prospective candidates and becoming immediately productive. Searches of this type normally take between sixty and ninety days to complete. The City is seeking to find a seasoned executive search firm to assist with the recruitment for this position. The City Attorney serves as the chief legal advisor to the City of Fort Collins Colorado, and is responsible for providing sound and efficient legal services to City Council, City Manager, boards, commissions, and other City staff in matters relating to their official powers and duties. Responsibilities include planning, staffing and supervising the legal service needs of the City. Provides legal representation for the City in all actions or suits in which the City is a party. The City Attorney is appointed by the City Council and is directly responsible to the City Council for the functions and duties assigned by the provisions of the City Charter and Municipal Code. The City Attorney serves at the pleasure of the City Council. The City Attorney's Office is comprised of the City Attorney, two Deputy City Attorneys, six Assistant City Attorneys, and one Municipal Court Prosecutor. Mr. Steve Roy, Fort Collins’ longtime City Attorney Steve Roy passed away suddenly on July 3, 2014. Once the City has established the recruitment criteria, we use a variety of means to develop contacts. We certainly access our internal data base. We rely heavily on our network of contacts to identify people who meet the requirements. We will use the Colorado Bar Association, the International Municipal Lawyer’s Association (IMLA) Association and the Colorado Municipal League as important sources for potential candidates. 6. What procedures do you use in assessing your client organization's needs and values? How do you use this information in selecting candidates who meet those needs and share those values? See Proposed Plan Section, particularly paragraphs “C,” “D” and “F” on pages 6, 7 & 8. 7. Describe how you will market the unique characteristics of the City of Fort Collins to potential candidates. How will this differ from other positions you have/are recruiting for? Once targeted prospects are identified, we invite them to consider the position. We contact them by email and telephone. We provide them with the recruitment profile which will describe Fort Collins and the region, the City Government, the City Attorney’s Office, the position and the application and recruitment processes. We refer them the City’s web site as a source for additional information. Our purpose is to provide good prospects with a secure and confidential venue within which they can explore the opportunity without risk of premature exposure. We stay in touch with them and remain available to them to provide additional information and assistance. For very promising prospects we often put them in touch with a high-ranking City official to provide additional information and encouragement. 8. Explain how you will conduct your search to ensure a candidate will be compatible with the specific needs of the City of Fort Collins and Northern Colorado Region? What procedures does your firm utilize in investigating the background of candidates? See Proposed Plan Section, particularly “D” on page 7. 10. What role do you see the City Council, City Manager's Office or Human Resources personnel playing in this process? We will need a City designated liaison who will serve as our primary contact for the search. The primary types of assistance we will need from the City will be to gather information, to schedule meetings, to distribute and return materials and to assist with logistical arrangements for final candidate interviews. 11. How many other executive searches is the primary contact currently involved in? How will you ensure that the City receives prompt and timely attention throughout this process? As of today, by early October, Mr. Slavin will be involved in four executive searches. He is currently working on four others which will be completed in September. This is a comfortable work load for Mr. Slavin. First, all emails are responded to on the day received. Phone calls are almost always returned on the same day. When that is not possible, they are returned at the beginning of the next business day. Secondly, we anticipate prescheduling and pre calendaring the entire search with the City at the start of the project so that we know what is to happen when and will manage it to meet the established schedule. 12. Explain any guarantees of services provided and related time periods. See Guarantees Section on page 13. 13. Please provide at least ten references from past public agency clients. As such, he has managed or assisted Mr. Slavin to manage many SMC executive searches including in Colorado. Mr. Slavin and Mr. Wenbert managed recent searches for both Police Chief and Deputy City Manager for Fort Collins. Mr. Slavin managed the City’s most recent City Manager search. We both know Fort Collins well. Prepared for THE CITY OF FORT COLLINS, COLORADO by Slavin Management Consultants - 2014 5 PROPOSED PLAN We recommend a five-step process as follows: • Develop job qualifications and requirements for the position -- the “recruitment profile”. • Identify and recruit qualified candidates. • Evaluate prospective candidates. • Make recommendations, help in selection and facilitate employment. • Establish evaluation criteria and follow-up. Each step of this process is described below. A. Develop the Position Profile We will meet with the Mayor and City Council, the City Attorney Selection Committee (Committee) and other appropriate stake holders of the City’s choosing to learn the City’s needs, focus and requirements such as experience, education and training as well as preferred management style and personal traits. In developing the recruitment profile we will spend a considerable amount of time at the beginning of the process in Fort Collins to gather additional information about the City and to ascertain the unique challenges of the job and the general environment within which the position functions. Once we have gained the necessary information, we will prepare a draft recruitment profile and review it with the City to arrive at a general agreement regarding the specifications for the position. The final profile will include information about the City of Fort Collins, the City Attorney position, major issues to be faced, the ideal candidate and the selection criteria established. B. Identify Qualified Candidates We will first review our database to find those candidates whom we may already know and/or already have on file who may meet your specifications. Although the above process is valuable, we will rely most heavily on our own contacts in related fields and on our own experience. In other words, through networking, we will conduct a professional search for the best-qualified candidates and invite them to apply for the position. In this effort, we utilize appropriate professional organizations, our established contacts, and our knowledge of quality jurisdictions and their employees. More than 25% of SMC placements are from protected groups. At our clients request, we actively recruit qualified protected group members. Our consultants hold membership in a variety of professional organizations, including minority and women based organizations. We utilize our contacts in these and other minority and women based organizations to achieve a diverse candidate base. We also post announcements on web sites and publications of minority and women’s organizations. In consultation with the City, we will prepare and place advertisements in professional publications. We will acknowledge all resumes received and thoroughly screen all potential candidates. C. Evaluate Prospective Candidates Preliminary Screening and Progress Report Criteria for the preliminary screening will be contained in the approved recruitment profile. They will include such items as education, Colorado Bar Membership, technical knowledge, experience, accomplishments, management style, personal traits, etc. Screening of candidates against those criteria will be based on data contained in the resume and other data provided by the candidates and on our knowledge of the organizations in which they work. At this stage, each must meet the minimum qualifications specified in the recruitment profile. Prepared for THE CITY OF FORT COLLINS, COLORADO by Slavin Management Consultants - 2014 6 We request that all candidates provide us, in writing, substantial information about their accomplishments and their management style and philosophy. This information is verified and, at the City's option, may be further tested by having the finalists respond to a supplemental questionnaire and/or complete management and leadership style inventories. We interpret these instruments for the City as well. We will meet with the City to provide a progress report on a number of semifinalist candidates. These individuals will be top prospects who clearly meet the specifications for the position. With the City’s guidance, we will narrow the semifinalist candidate group on the basis of refined criteria. During this meeting we will determine the City’s expectations relative to interview questions that we will write as well as the candidate rating and scoring processes which will be included in our final report. D. Selection and Employment In-depth Screening and Final Report At this point, we will interview those semifinalist candidates whom you have the greatest interest in. Proper “fit” is as important as technical ability. We assess both. In order to better assess candidates’ management style and interpersonal characteristics, we personally interview each in his or her present work environment. We will closely examine each candidate's experience, qualifications, achievements, management style and interpersonal skills in view of the selection criteria and our professional expertise in evaluating the quality of such qualifications, skills and achievements. We conduct in-depth background checks on those individuals who continue to demonstrate their overall suitability for the position. Included are detailed and extensive reference checks which cover a minimum period of ten years. In conducting these, it is our practice to speak directly to individuals who are now or have been in positions to evaluate the candidate's job performance. We ask each candidate to provide us with a large number of references. We then network these references to other persons who know the candidate. In this way, we thoroughly evaluate each candidate. These references and evaluations are combined to provide frank and objective appraisals of the top candidates. As part of our evaluation process we conduct credit checks, verify undergraduate and graduate college degrees and professional licenses and certifications. We also conduct criminal history, civil court records and driving record checks. SMC contracts with the G4S Corporation to conduct criminal, driving, and civil records checks on finalist candidates. W we utilize Equifax to perform finalist candidate credit checks and National Student Clearinghouse to verify candidate educational credentials. At the City's option, we can arrange for assessment centers and/or psychological (or similar) testing of the candidates. (These optional items will result in extra cost.) We will then meet with the City to present a group of well-qualified finalist candidates for interviews in Fort Collins. These final candidates will not be ranked because, at this point, they will all be qualified and it will then be a matter of chemistry between the candidates and the City that should produce the final selection decision. Our final report will be presented in a meeting with the City. This written report is a comprehensive document. It contains our candidate recommendations, details about the search, interview tips, interview questions, candidate evaluation forms and information about legal vs. illegal inquiries. The report also includes the candidate interview schedule as well as our recommendations relative to timing, sequencing, location, setting, format, and conduct of interviews. The report contains comprehensive information about each recommended candidate. This includes educational and experience information, an evaluation of the candidate's experience relative to the criteria established by the City, a summary of reference comments and a statement of accomplishments and management style prepared by the candidate. Present compensation is also provided for each recommended candidate. We will provide information about trends in employment, employment contracts and agreements, relocation expenses, perquisites, appropriate roles for spouses, receptions, etc. We arrange schedules for top candidate interviews with the City and we will coordinate the entire process. We will properly handle any and all media relations. Unless otherwise directed, it is our standard practice to tell all media that we are working on behalf of the City of Fort Collins and that any public statement should come from the City directly. Within the boundaries of the open records laws, we will not release information to the media unless specifically directed by you to do so. Finally, we will continue to work for the City until a suitable candidate is recruited and hired. E. Establish Evaluation Criteria Once the new City Attorney has been on board for 30 days or so, we will conduct a session with the City Council and the new City Attorney to establish mutually agreed upon performance expectations and goals. F. Follow-up We will follow-up with the City and the new City Attorney during the first year and assist in making any adjustments that may be necessary. G. Reporting We will keep the City informed, involved in decisions and involved in the search process. We will provide frequent progress reports. H. Deliverables Deliverables include the recruitment profile (draft and final), the advertisement (draft and final), the progress report (presented in person), the final report with interview tips, interview schedule, interview questions, candidate resumes, candidate evaluations, candidate writing samples, rating sheets, ranking forms, tabulation forms and appropriate/inappropriate question list and a negotiated employment agreement between the City and the selected candidate. Robert E. Slavin, President Mr. Slavin will manage and serve as the lead consultant for this project. He is a pioneer in public sector and nonprofit executive search. He is among the best known and respected professional recruiters in the business. He is a frequent speaker before professional groups and he has written several articles for professional journals concerning governmental management. By special invitation, Mr. Slavin assisted the United States Office of Personnel Management to define and set up the Senior Executive Service for the Federal Government. Mr. Slavin began his local government career in 1967. His experience includes twelve years working directly for local governments and it includes seven years as a principal consultant with the government search practice of Korn/Ferry International, the largest private sector search firm in the world. He headed the local government search practices for Mercer/Slavin, Incorporated, Mercer, Slavin & Nevins and Slavin, Nevins and Associates, Inc. Mr. Slavin now heads the executive search practice for Slavin Management Consultants. Clients include state and local governments, nonprofit and private sector businesses all over the United States. His experience includes search assignments for the 1984 Los Angeles Olympic’s Organizing Committee. Mr. Slavin's experience and qualifications include organizational analysis, classification and compensation studies, and assessment centers and human resource’s systems studies. Major expenses that will be incurred include consultant travel, advertising, messenger services, communications and background check costs. These expenses will not exceed 55% of the professional fee ($8,860.50). Therefore the total cost for the proposed project will not exceed $24,970.50. The cost for final candidates to travel to Fort Collins for interviews is not covered by this proposal. Such costs are typically paid by the City on a reimbursement basis, directly to the candidates, and controlled through the City's prior approval of the finalist candidates. These costs vary depending on candidate location, espousal involvement, time required for candidates to be in Fort Collins, etc. For budgeting purposes, an average cost of between $500.00 and $850.00 per candidate would be appropriate. About five candidates are normally recommended for interviews Consultant Travel Costs: The client pays direct cost for all necessary consultant travel using coach or, when available, lower air rates, corporate hotel rates at moderately priced properties (Holiday Inn or equivalent), rental cars, using the corporate discount and normal meals. Client controls these costs in the following ways: (1) when appropriate, consultants will accomplish multiple purposes when traveling and will allocate costs to multiple clients; and (2) the client pre-approves all work plans including all consultant (and candidate) travel. Office Costs Include: Telephone ($350 flat fee, billed in two installments), FAX, postage, messenger, copier, and clerical costs. Average Advertising Costs: Normally about $2,000. Client controls these costs because the advertising program will be approved by the City prior to implementation. Should the City's needs result in additional project scope that significantly increases consultant travel and/or advertising costs, it may be necessary to increase the expense budget for the project. Your liability to Slavin Management Consultants for services rendered under this agreement will not exceed the agreed upon price unless an increase is authorized by you in writing. We will submit monthly invoices for fees and expenses. It is our practice to bill 30% at the start of the searches, 30% at the end of thirty days, 30% at the end of sixty days, and the remaining 10% shortly after the time the new City Attorney accepts employment with the City.
