Home My WebLink AboutCORRESPONDENCE - AGREEMENT MISC - NABI BUS PURCHASE - DART OPTIONApril 11, 2014 North American Bus Industries Attn: Brian Dewsnup, VP & General Manager 106 National Drive Anniston, AL 36207 Subject: Notice of Exercise of Options Dear Mr. Dewsnup: Pursuant to the Assignment of Options to the City of Fort Collins, Colorado executed by the Dallas Area Rapid Transit (DART), the City of Fort Collins, Colorado, and the North American Bus Industries (NABI), LLC (previously known as North American Bus Industries, Inc.) dated as of March 24, 2014 and attached hereto, the City of Fort Collins herein confirms the exercise of such purchase options, with the specifics of the purchase reduced to a mutually-agreed upon writing and executed by the parties by April 30, 2014. The essential elements of the purchase contract are to include: 1. The purchase of seven (7) 31-LFW CNG buses and three (3) 40-LFW CNG buses to be delivered no later than December 31, 2014. 2. Bus and option pricing shall be in accordance with the attached pricing summary. 3. The City of Fort Collins intends to purchase a Spare Engine Power Plant for each bus length at $82,045 each. This Notice of Exercise of Options becomes null and void in the event the parties do not execute a definitive purchase contract by April 30, 2014. Accepted and Agreed this 11th day of April 2014.
