Subject: Gate Pricing Change Order Request Hi Ryan, 0 12150 E. 112' Ave. Henderson, CO80640 303-286-8000 This letter is for documentation to outline Sturgeon Electric's Estimate and to justify the increase in pricing for the Gate operators on the BRT Guide way. When Sturgeon bid this job we did so with the intent of supplying the project with a product that most closely met the specifications written and provided for this project. We bid this project using a phone quote from a vendor (Automated Systems) at bid time with the understanding that we would have to finalize pricing after bid for all components need for the project.At that time Automated Systems stated it would be able to meet the Specifications for the project,and the project specifications were written around the Automated Systems operational specifications.There alsowas not any other gate on the market that met the specifications. Post bid during the submittal process, Sturgeon became aware of the fact that this vendor could not meet the Buy America specification and that the project would not allow this vendors product to be used on the project. Sturgeon then went through a process of finding any operator's that would meet the Buy American specification and compared them to the Operational Specification for the project. In this process we found that there was NO Gate Operator that met the specification and was BAA compliant.The Project then approved a gate system from By Securitythat was closest to general overall operation they were looking for and BAA compliant.The material cost of this gate was substantially more than the Original bid quote. Sturgeon's original bid for the Gate System was $37,330.76 EA, Totaling $522,630.64, with a quoted material cost for the Gate Operator of $15,000.00 EA, Totaling $210,000.00.This is for Gate Operator only and doesn't include the material for bases and conduit or labor and equipment to install. The material cost of the Automated Systems Gate with Like parts supplied would have cost Sturgeon (3) Gates @ $12,556.00 = $37,668.00and (I1) Gates @ $16807.00 = $184,877.00,Totaling $222,545.00. The material cost of the HySecurity gate operators approved post bid with Like Partsis(3) Gates @ 21,375.00EA = $64,125.00 and (11) Gates @ $22,833.00 EA .= $251,163.00plus (1) Gate @ $46,150.00 Totaling $361,438.00. There is a Differenceof $138,893.00 for providing the Hy Security Gate Operator. Sturgeon does understand that the Automated Systems Gate did not meet the BAA requirement but also contends that there is no gate on the market today that meets the operational requirements of the project. Because of this Sturgeon is asking for a change order for the difference in cost form the Automated Systems Gate ($522,630.64) and the Hy Security Gate ($661,523.64) with a net change of $138,893.00. Optional Control Devices • Emergency & street maintenance egress from a side street is a concern since Opticom must have a line of sight. For the option of a "push button," can this be added to the exterior of the gate operator? The push button should also have a hood for obscurity and button protection, and camouflage with the gate operator. The hood (push button access) will not be locked. The location should be such that it isn't readily visible to street or pedestrian traffic. From reviewing the submittal, it appears as though the manual gate control button is contained within the operator cabinet (hold open switch; page 53; sheet 72 in PDF). If this is the manual control switch, the Owner would like it made available to the exterior without removing the cabinet. (CEI) was directed through Work Change Directive (WCD) No. 113 to adjust the product supplier for the BRT guideway gate system as the specified supplier (Automated Systems) does not provide Buy America compliant products. A new product supplier was identified through a comparative process completed during the submittal review (#614-01). This process also included product enhancements and spare part requests for the system. WCD113 reconciled all of these changes into one change directive which was responded to by CEI with CCR 268, 287 and 288. Please find attached the referenced change requests. In reviewing this request, an independent analysis was completed using the change review process. Comparative costs were obtained from Wizard Works (gate supplier) to verify the change in material costs. Spare parts and enhancement costs were then added to verify the total. Based on the information from our analysis, the independent estimated cost for the change is $161,075.59. CEI's proposed cost of $178,703.94 ($83,498.05, $76,228.90 and $18,976.99 combined) was not accepted. Through the change review process, CEI has accepted a cost for this change in the amount of our independent cost analysis. As such, I recommend $161,075.59 added to the contract for gate system modifications. When Sturgeon bid this job we did so with the intent of supplying the project with a product that most closely met the specifications written and provided for this project. We bid this project using a phone quote from a vendor (Automated Systems) at bid time with the understanding that we would have to finalize pricing after bid for all components need for the project.At that time Automated Systems stated it would be able to meet the Specifications for the project,and the project specifications were written around the Automated Systems operational specifications.There alsowas not any other gate on the market that met the specifications. Post bid during the submittal process, Sturgeon became aware of the fact that this vendor could not meet the Buy America specification and that the project would not allow this vendors product to be used on the project.
