This letter is for documentation to outline Sturgeon Electric's Estimate and to justify the increase in pricing for the
Gate operators on the BRT Guide way.
When Sturgeon bid this job we did so with the intent of supplying the project with a product that most closely met
the specifications written and provided for this project. We bid this project using a phone quote from a vendor (Automated
Systems) at bid time with the understanding that we would have to finalize pricing after bid for all components need for the
project.At that time Automated Systems stated it would be able to meet the Specifications for the project,and the project
specifications were written around the Automated Systems operational specifications.There alsowas not any other gate on
the market that met the specifications.
Post bid during the submittal process, Sturgeon became aware of the fact that this vendor could not meet the Buy
America specification and that the project would not allow this vendors product to be used on the project. Sturgeon then
went through a process of finding any operator's that would meet the Buy American specification and compared them to
the Operational Specification for the project. In this process we found that there was NO Gate Operator that met the
specification and was BAA compliant.The Project then approved a gate system from By Securitythat was closest to general
overall operation they were looking for and BAA compliant.The material cost of this gate was substantially more than the
Original bid quote.
Sturgeon's original bid for the Gate System was $37,330.76 EA, Totaling $522,630.64, with a quoted material cost
for the Gate Operator of $15,000.00 EA, Totaling $210,000.00.This is for Gate Operator only and doesn't include the
material for bases and conduit or labor and equipment to install. The material cost of the Automated Systems Gate with
Like parts supplied would have cost Sturgeon (3) Gates @ $12,556.00 = $37,668.00and (I1) Gates @ $16807.00 =
$184,877.00,Totaling $222,545.00. The material cost of the HySecurity gate operators approved post bid with Like
Partsis(3) Gates @ 21,375.00EA = $64,125.00 and (11) Gates @ $22,833.00 EA .= $251,163.00plus (1) Gate @ $46,150.00
Totaling $361,438.00. There is a Differenceof $138,893.00 for providing the Hy Security Gate Operator. Sturgeon does
understand that the Automated Systems Gate did not meet the BAA requirement but also contends that there is no gate on
the market today that meets the operational requirements of the project. Because of this Sturgeon is asking for a change
order for the difference in cost form the Automated Systems Gate ($522,630.64) and the Hy Security Gate ($661,523.64)
with a net change of $138,893.00. Please call with any Questions.

Description of Change:
This change order adds WCD113 — Gate Systems to the CEI contract. The gate system as specified in the MAX
BRT bid package was exclusively written around an Automated Systems gate product. Through the submittal
review process it was found that the Automated Systems gates are not BAA compliant. As such, another vendor
was selected. Hy Security gate systems were selected and evaluated through submittal #614-01. This product
was claimed to be more expensive. The costs were analyzed and presented through WCD113. The overall cost
included gate enhancements and spare parts as requested by Transfort. WCD113 was fully reconciled through a
change review document and presented as attached.
Change in Contract Value:
The contract value is being increased by $161,075.59. Please see attached pending issues log summary and work

2.02. OPERATION
E. Optional Control Devices
• Emergency & street maintenance egress from a side street is a concern since Opticom
must have a line of sight. For the option of a "push button," can this be added to the
exterior of the gate operator? The push button should also have a hood for obscurity and
button protection, and camouflage with the gate operator. The hood (push button access)
will not be locked. The location should be such that it isn't readily visible to street or
pedestrian traffic.
From reviewing the submittal, it appears as though the manual gate control button is
contained within the operator cabinet (hold open switch; page 53; sheet 72 in PDF).
If this is the manual control switch, the Owner would like it made available to the
exterior without removing the cabinet. Contractor shall provide cover plate or equal
with clip to secure access plate/cover per Section 614, pg 95, paragraph 2.
• Contractor to provide:
o Radio control push button controllers 6 total; (backup gate operation for bus drivers)
o Free egress vehicle detectors
F. Optional external sensors
• Contractor to provide both the arm edge sensor (contact) and a photo eye (non -contact).
G. Other Options
• Contractor to provide aluminum gate arm. If gate length precludes full aluminum, a
combination of aluminum and fiberglass is 2ntl option.

Gate System Changes

Concrete Express, Inc. (CEI) was directed through Work Change Directive (WCD) No. 113 to adjust the
product supplier for the BRT guideway gate system as the specified supplier (Automated Systems) does
not provide Buy America compliant products. A new product supplier was identified through a
comparative process completed during the submittal review (#614-01). This process also included
product enhancements and spare part requests for the system. WCD113 reconciled all of these changes
into one change directive which was responded to by CEI with CCR 268, 287 and 288. Please find
attached the referenced change requests.
In reviewing this request, an independent analysis was completed using the change review process.
Comparative costs were obtained from Wizard Works (gate supplier) to verify the change in material
costs. Spare parts and enhancement costs were then added to verify the total.
Based on the information from our analysis, the independent estimated cost for the change is
$161,075.59. CEI's proposed cost of $178,703.94 ($83,498.05, $76,228.90 and $18,976.99 combined)
was not accepted. Through the change review process, CEI has accepted a cost for this change in the
amount of our independent cost analysis. As such, I recommend $161,075.59 added to the contract for
gate system modifications.

Description of Review:
CEI quantified additional material cost associated with procurement of the Hy -Security Gate system as opposed to
the Automated Systems Gate as per the specifications as outlined on pages 1-8 of CEI's CCR 287 and 288. The
MAX BRT gate specifications (Section 614) were largely written around the Automated Systems Gate. Therefore,
a reasonable assumption that contractors would bid this system during the May 2012 bid phase.
The following change.request items have been reviewed as follows and attached hereto.
For this analysis the Contract Documents (Section 614 and General Conditions) were reviewed to compare CEI's
bid price to the value claimed in CCR 287 and 288. The contract documents state "Each unit price will be deemed
to include an amount considered .by Contractor to be adequate to cover Contractor's overhead and profit for each
separately identified item,"in section 11.9.2 of the General Conditions.
The pricing provided 1. by CEI through Sturgeon and Wizard Works; dated 6/27/2013 for the Hy Security gates and
11/12/2012 for the Automated Systems gates; respectively, was analyzed for this change request. Wizard Works
provided itemized costs for both the Hy -Security Gate system and Automated Systems Gate system. These costs
have been attached on pages 11 and 12; summarized on pages 9-10.
For this comparison, labor and equipment rates were maintained at the same rate for both Automated Systems
gate and Hy -Security gate installation costs. Material costs were changed based upon itemized costs provided by
Wizard Works. Markups were re -calculated to compare gate costs between both manufacturers.
The costs for the Automated Systems gate installation are attached on pages 9-10. The total cost to install this
system (as bid) is as follows.
• Total material, labor, equipment, OH&P for all contractors - $555,552.20
The costs for the Hy -Security gate installation are attached on pages 9-10. The total cost to install this system (as
approved) is as follows.
• Total material, labor, equipment, OH&P for all contractors - $697,650.80
As this bid item was not provided as balanced, the City will only agree to the differential between the calculated bid
value against the approved product installation cost which equals $142,098.60 - which includes reasonable,
contract allowed markups for OH&P and permanent materials. The City will also agree to the value of spare parts
requested through the submittal review and approval phase. As such, the summary of this change request is
outlined below.

This letter is for documentation to outline Sturgeon Electric's Estimate and to justify the increase in pricing for the
Gate operators on the BRT Guide way.
When Sturgeon bid this job we did so with the intent of supplying the project with a product that most closely met
the specifications written and provided for this project. We bid this project using a phone quote from a vendor (Automated
Systems) at bid time with the understanding that we would have to finalize pricing after bid for all components need for the
project.At that time Automated Systems stated it would be able to meet the Specifications for the project,and the project
specifications were written around the Automated Systems operational specifications.There alsowas not any other gate on
the market that met the specifications.
Post bid during the submittal process, Sturgeon became aware of the fact that this vendor could not meet the Buy
America specification and that the project would not allow this vendors product to be used on the project. Sturgeon then
went through a process of finding any operator's that would meet the Buy America/ specification and compared them to
the Operational Specification for the project. In this process we found that there was NO Gate Operator that met the
specification and was BAA compliant.The Project then approved a gate system from By Securitythat was closest to general
overall operation they were looking for and BAA compliant. - The material cost of this ate was substantially more than the

Sturgeon's original bid forjhe Gate System was $37,330.76 EA, Totaling $522,630.64, with a quoted material cost
for the Gate Operator o 15,000.00 EA, Totaling $210,000.00.This is for Gate Operator only and doesn't include the
material for bases and conduit or labor and equipment to install. The material cost of the Automated Systems Gate with.
Like parts supplied would have cost Sturgeon (3) Gates @ $12,556.00 = $37,668.00and (11) Gates @ $16807.00 =
$184,877.00,Totaling $222,545.00. The material cost of the HySecurity gate operators approved post bid with Like
Partsis(3) Gates @ 21,375.00EA = $64,125.00 and (11) Gates @ $22,833.00 EA .= $251,163.00plus (1) Gate @ $46,150.00
Totaling $361,438.00. There is a Differenceof $138,893.00 for providing the Hy Security Gate Operator. Sturgeon does
understand that the Automated Systems Gate did not meet the BAA requirement but also contends that there is no gate on
the market today that meets the operational requirements of the project. Because of this Sturgeon is asking for a change
order for the difference in cost form the Automated Systems Gate ($522,630.64) and the Hy Security Gate ($661,523.64)
