SPECIFICATIONS AND CONTRACT DOCUMENTS
Description of BID 7455: Fort Collins Senior Center Expansion
OPENING DATE: 3:00 PM (Our Clock) January 15, 2012
To all prospective bidders under the specifications and contract documents described
above, the following changes/additions are hereby made and detailed in the following
sections of this addendum:

EXHIBIT 1 - QUESTIONS & ANSWERS
1. Contract: Paragraph 5.04, page 12: Is it the City's expectation that the design
team provide $5M in liability coverage for a $4M project? If it is to cover the
builder's liability as well, the reference to "professional liability errors and
omissions" is misleading, since professional liability insurance is only written for
design professionals and does not normally cover the construction. Please clarify,
since the design team's liability coverage would normally be in the range of
$500,000 to $1M for a project of this size.
A: The City standard will remain at $5,000,000.00.
2. Contract: Paragraph 6.21, Indemnification, page 20: Is it the City's expectation
that the design/builder's insurance indemnify the City for acts and omissions that
are attributable to the City or City staff? This may be an uninsurable requirement.
A: The paragraph includes language that limits by any “negligent act or omission”
and the City has had no problems for projects being insured.
3. Contract: Article 9, Retainage: Does the City intend to retain 10% of the design
team's professional fees and expenses until the project construction is at least
50% complete?
A: The City will retain 5% of the design teams professional fees and expenses
until the project construction is at least 50% complete.
Change “The City will retain 90% of the cost of the work…” to “The City will
retain 95% of the cost of the work…”.
4. Many references were made during the pre-proposal conference to energy
upgrades that are expected to be made in the existing facility and site. Has the
City performed an energy audit or other study to determine what upgrades are to
be made? If not, is it the City's expectation that the design team will perform such
a study as a part of their services? If so, please provide a list of the expected
parameters of this study and how extensive it may be, i.e. is it limited to lighting
upgrades and toilet fixture/faucet replacements, or does it extend to evaluation of
the building's mechanical systems, pool equipment, controls, etc.
A. There was an energy audit conducted on this facility in 2007. The City has
completed some retrofits and upgrades noted for energy savings, but there are
several items that remain untouched. The facility is still operating using the
original HVAC equipment which if upgraded could offer considerable savings.
The City will provide the Design-Build this audit along with a list of upgrades
completed for their review and input on how we address remaining items and
work toward the goal of Net Zero energy increase for this facility.
5. Please clarify when the "drop-dead" date will be for adding the budget for the
enhanced internet cafe. Will it be during design at the end of Schematic Design or
Addendum 1 – 7455 Fort Collins Senior Center Expansion Page 3 of 3
Design Development, or prior to construction start? This may have a significant
impact on the design fees.
A. The City is currently seeking grants along with other fund raising opportunities.
The City will not have final answers on grants until October 2013. The design
for the addition will move forward using the budget noted in the RFP for the 12-
15,000 SF, but have a plan in place on how the additional space could be
relatively easily added by a change in scope if this additional funding becomes
available.
6. Given the design build nature of this project, is it acceptable to bring specific
design disciplines (Mechanical, Electrical engineers, etc.) onto a team under
contract as a DB team with a subcontractor (Mechanical, Electrical contractor) ?
A. The City does not have an issue with the Mechanical or Electrical engineers
being under contract with the Mechanical or Electrical subcontractor to the
Design-Build team. This process often helps facilitate the integrated team
approach.
7. What is the square footage of the existing Senior Center?
A: 41,200 SF
8. Under Chapter 5 - Qualification Requirements, is number 9, Subcontractors,
required to be turned in during this first step?
A: Yes, per Chapter 1, #4 Step 1, of the RFP, “The City will issue a “Request for
Proposal” (RFP) and select the top three design/build teams based upon the
quality and experience of the team”. Please submit qualifications for your
complete team including major subcontractors.
9. Under Chapter 5 - Qualification Requirements, Is number 11, Construction Cost
Factors, required to be turned in during this first step?
A: No, construction cost factors are a requirement of Step II and not of Step I.
10. Under the Standard General Conditions of the Contract , Section 6.06 A, is 20% of
the work to be self-performed by the general contractor?
A: Yes, 20% of the work must be performed by the general contractor.
