REQUEST FOR PROPOSAL
P1 158 Insurance
The City of Fort Collins and Poudre Fire Authority are seeking proposals from qualified
brokerage/agency firms providing Property and Liability insurance, including Workers'
Compensation. Proposals from respondents will be reviewed and a limited number of firms will
be selected to secure quotes for its insurance renewal for the policy year beginning April 15,
2009. (This date may be changed to May 1, 2009).
Written proposals, five (5) will be received at the City of Fort Collins' Purchasing Division, 215
North Mason St., 2nd floor, Fort Collins, Colorado 80524. Proposals will be received before
3:00 p.m. (our clock), January 6, 2009. Proposal No. P1158. If delivered, they are to be sent to
215 North Mason Street, 2ntl Floor, Fort Collins, Colorado 80524. If mailed, the address is P.O.
Box 580, Fort Collins, 80522-0580.
It is our intent to notify selected firms on January 12, 2009.
There will be no further public notice of this proposal.

1. Download the Proposal/Bid from the BuySpeed Webpage,
www.fcgov.com/eprocurement
2. Come by Purchasing at 215 North Mason St., 2n' floor, Fort Collins, and request
a copy of the Bid.
The City of Fort Collins is subject to public information laws, which permit access to most
records and documents. Proprietary information in your response must be clearly identified and
will be protected to the extent legally permissible. Proposals may not be marked 'Proprietary' in
their entirety. Information considered proprietary is limited to material treated as confidential in
the normal conduct of business, trade secrets, discount information, and individual product or
service pricing. Summary price information may not be designated as proprietary as such
information may be carried forward into other public documents. All provisions of any contract
resulting from this request for proposal will be public information.
Sales Prohibited/Conflict of Interest: No officer, employee, or member of City Council, shall have
a financial interest in the sale to the City of any real or personal property, equipment, material,
supplies or services where such officer or employee exercises directly or indirectly any decision -
making authority concerning such sale or any supervisory authority over the services to be
rendered. This rule also applies to subcontracts with the City. Soliciting or accepting any gift,
gratuity favor, entertainment, kickback or any items of monetary value from any person who has
or is seeking to do business with the City of Fort Collins is prohibited.

EXECUTIVE SUMMARY
Process Overview
The marketing of the City of Fort Collins (COFC) and related entities' property and
liability coverages was beneficial for the following reasons:
• Examined altematives to the expiring program.
• Controlled pricing increases by facilitating increased levels of competitiveness.
• Validated the competitiveness of the existing program.
• Resulted in a few coverage improvements and opportunities for additional ones.
The broker selection and competitive bidding performed to meet the City's purchasing
requirement involved multiple parties and options. Several years ago the City and the
Poudre Fire Authority combined under an "excess of loss" program structure. Therefore,
this year in addition to having two brokers, Arthur J Gallagher and Marsh secure quotes,
the City requested two direct -writer providers to afford quotes directly to the City based
on current program design and specifications and two fire services programs for first
dollar options (low deductibles versus the higher retentions presently applicable to the
City's property and liability coverages). The two providers that the City worked directly
on a combined program basis (including fire services) were CIRSA and States. Both
providers are alternative risk financing programs, an intergovernmental pool and a
liability risk retention group, respectively. The two fire services programs providing
quotes are the Colorado Special Districts Pool and Volunteer Fire Insurance Services
(VFIS).
All participants were provided the same underwriting data, historical program
information, coverage specifications and limit structures to work with in submitting their
proposals. Further, the City furnished all parties with analysis worksheets provided by
ARS to help facilitate a thorough analysis of the proposals secured from the various
insurance companies and programs.
Results
The marketplace was properly canvassed by the two brokers involved. A summary of the
markets contacted and the responses received are summarized in Exhibit Vt.
The Executive Summary exhibit shows the recommended program that includes all
expiring programs, except for liability and fine arts. Here we see the cost difference
between expiring and the recommended plan. The general liability program shown in
this exhibit is State's program. T.he_premium-leve__ l and_supporting.coverage-levels-serve
as the-basis=for_this_change-in carriers from -Munich -to -States. Fine Arts through AXA
offers premium savings and a sound alternative to Commerce and Industry the expiring
carrier who is no longer writing this coverage. Where premiums have decreased in other
coverage areas, this is due to the competitive marketing, except for property where the

libraries were removed to be under their own program accounts. This reduction in value
is the basis for this decrease. Increases in equipment breakdown are inflationary but is
still very competitive compared to all other options. Workers Compensation increased
for the City based on increased payroll.
Exhibit I shows the costs of the programs received. Exhibit II expands the cost
information shown in Exhibit I to also show the coverage limits of each program. All
coverages proposed by Marsh were substantially higher in premium cost. Although
CIRSA provided a large premium savings opportunity at $111,758 when compared to
Munich and States at $189,005 and $165,364, respectively, CIRSA's program can't be
split up and the property at $506,541 is more than double the best property program
offered by Lexington at $227,327 without the terrorism charge included.
Exhibit Il — A addresses the costs and limits as previously stated for the combined
program including PFA in the excess of loss structure which exist currently for the City.
Exhibit II —B shows two areas of information. First the premiums f VFIS nd the
Colorado Special District Pool on PFA at low deductible structures o 000 for
Property. Secondly, the premium charges under the best combined program options for
PFA's portion of the total premium are shown. As mentioned earlier, this incidental
charge for PFA when combined with the City caused us to focus on these options rather
than in splitting out PFA under its own program structure for other than workers
compensation.
With PFA's premium charges being fairly incidental under the combined excess of loss
structure, Marsh's premium options for the City including PFA being non-competitive
with those offered by Gallagher, and CIRSA's overall program also being non-
competitive, the only -deviation from 'Gallagher's=program_worth-further-cons_ id_ eratioon is
thediability:program-offered=by-States
States offers a better priced program than Gallagher's recommended program which is
Munich. Travelers who was also approached by Gallagher is actually better than either
of these, but in light of the comments provided by Gallagher and observation made by
ARS, both shown in Exhibit IV, we have ruled out Travelers. Our rationale is that
Gallagher had already worked with Travelers to amend the drawbacks experienced and
detected in the Travelers program without success. If they did not then this is
unfortunate. In these competitive times the broker's charge is to work with each
competitive carrier to amend terms around a client's need, not to accept these as a given.
Travelers is the only carrier that offered an aggregate retention. None of the liability
carriers are without room for improvement in coverage. Both States and Munich have
broad coverage. Both are occurrence based and were quoted at the limits requested.
The premium advantage over Gallagher's best program option Munich, the incumbent
market for this coverage, is $23,644. State's is an "alternative market" group program
formed under the Federal Risk Retention Act, a non -assessable program made up of other
Cities and Counties. States retains the first $600,000 in loss on any one occurrence

before treaty reinsurance steps in. You would be able to continue with CCMSI as your
third party claims administrator. I don't believe the City has had any program or carrier
audits to oversee claims practices with Munich, but this would be a yearly activity with
States and shown by Gallagher as a negative for Travelers. They see no auditing as a
benefit to the entity. If performed in the proper manner, we see this as a positive. Many
partial self -insureds pay third parties for this service, here it would be included without
charge. Since States is a member -owned program, it would involve attendance at a
membership meeting once a year. Expenses are paid by States. The City of Lakewood is
a local member of this program.
Munich is the next best program. There is a large_claim=that_remains-open�This and
other considerations need to be discussed before moving away from the Munich program.
Further, additional coverage and possibly pricing may be warranted on both of these
programs. In our opinion, Munich should have provided better pricing in this process.
Following are comments on coverages not previously addressed
Equipment Breakdown — Pricing on this coverage went up, but remains highly
competitive as compared to other options received. Zurich through Gallagher remains
the best option.
Fiduciary — This is a new coverage to the portfolio and is a recommended inclusion in
the program. No other stand-alone quotes were received on this line. States believes a
certain level of coverage for this exposure is included in their form. If their program is
selected, we will review this further.
Excess Workers Compensation — Midwest Employers, the incumbent program, remains
the best option for the City on price and coverage. Within Gallagher's proposal is an
executive summary report from Midwest Employers analyzing the City's loss
performance from a benchmarking standpoint. Evidently, based on this report, the City's
performance needs to improve greatly. Gallagher should be consulted as to what they or
Midwest can do to assist the City in the area of both pre -loss and post -loss controls.
PFA Workers' Compensation — cemrnend that 12EA rcriew with Pinnacol. The
one alternative received through Colorado Special Districts Poo is lower but with
Pinnacol's general dividend and the m tvl ual dividers per ormance of the pool,
P.inndeOl'isa-better_program. The cost analysis can be found in Exhibit V.
Crime — Travelers, the incumbent is the best program.
Our coverage specifications checklist as completed by the participants in a side by side
format can be found in Exhibit III. Here you will see that broad coverage is offered by
the proposers. The "yes" responses denote that the extension is found in the proposer's
program. When an unqualified response is "yes," the City has the best opportunity,
through a compliance review, to amend language to fully secure the intent of the
coverage enhancement. However, this also creates the likelihood of unresolved issues.

The programs recommended are for the most part per specifications. As to liability, there
are pros and cons to each program and the improvement opportunities assessed and
negotiated. We reviewed some of these with the broker/carrier, but were told that these

rate locks on the recommended carriers were discussed and the broker/carriers are open
to revisiting this issue. In the proposals received, this provision was shown as having
been declined.
Exhibit IV is our review comments of the liability coverage observations and potential
changes.
Exhibit VI, our Marketing Summary, shows all markets assigned and the results
achieved. The brokers did a good job in contacting markets assigned, pursuing quotes,
and advising us on the disposition of those markets.
Exhibit VII is a summary of the A.M. Best Ratings of the insurance carriers. All carriers
are appropriately rated, except that States, as a risk retention group is not rated. Its
retention of risk is limited and its reinsurers are major reinsurance companies and
properly rated.
We look forward to discussing the content of this report with management and reviewing
both pricing and coverage in the context of the City's needs. Since we have not done an
exposure analysis for the City or PFA, we like to review certain coverages in the context
of the City's superior knowledge of its exposures and therefore identify any resulting
value that a particular coverage may have.

Proposal Number P1158 Insurance
The City of Fort Collins and Poudre Fire Authority are seeking proposals from qualified
brokerage/agency firms providing Property and Liability insurance, including Workers'
Compensation. Proposals from respondents will be reviewed and a limited number of firms will
be selected to secure quotes for its insurance renewal for the policy year beginning April 15,
2009. (This date may be changed to May 1, 2009).
Terms and Conditions for Request for Proposal
Proposers are expected to examine the specifications, schedule of delivery, and all
instructions. Failure to do so will be at the proposer's risk.
2. Each proposer shall furnish the information required in the RFP.
3. The Contract/Purchase Order will be awarded to that responsible proposer whose
submittal, conforming to the Request For Proposal, will be most advantageous to the
City of Fort Collins, price and other factors considered.
4. The City of Fort Collins (Purchasing Division) reserves the right to reject any or all
qualifications and to waive informalities and minor irregularities in proposals
received, and to accept any portion of or all items proposed if deemed in the best
interest of the City of Fort Collins to do so. We reserve the right to move coverages
to another broker who is considered to offer the best overall program.
5. No submittal shall be withdrawn for a period of sixty (60) days subsequent to the
opening of proposals without the consent of the City.
6. In submitting the proposal, the proposer agrees that acceptance of any or all
proposals by Purchase Order within a reasonable time frame constitutes a contract.
7. The proposed price shall be exclusive of any Federal or State taxes from which the
City of Fort Collins is exempt by law.
8. Any interpretation, correction or change of the Proposal Documents will be made by
Addendum. Interpretations, corrections and changes of the Proposal Documents
made in any other manner will not be binding, and Proposer shall not rely upon such
interpretations, corrections and changes. The City's Representative will not be
responsible for oral clarification.
9. Confidential/Proprietary Information: Proposals submitted in response to this RFP
and any resulting contract are subject to the provisions of the Colorado Public
(Open) Records Act, 24-72-201 et. seq, C.R.S., as amended. Any restrictions on the
use or inspection of material contained within the proposal and any resulting contract
shall be clearly stated in the proposal itself.
10. The City assumes no responsibility for proposals being either opened early or

11. In the bidding phase of this RFP, the City reserves the right to secure quotes from
direct writers, including Pool programs.
Background and Loss Data
Although the City of Fort Collins has essentially been self -insured since 1988, the City still relies
upon commercial insurance to provide protection over and above the City's self -insured retention
level. The City maintains a Loss Fund to make reimbursement on claims within our retention levels.
A summary of current policies is attached as Attachment "A" and Attachment "B".
Scope of Work
The selected brokerage/agency(s) will be required to assist in the placement of insurance, excess
insurance, reinsurance, and/or alternative coverage's as needed.
The City's broker will ultimately be expected to perform most, if not all, of the following services:
A. Risk Analysis and Insurance Marketing
1. Assist the City in the assessment of loss exposures.
2. Prepare a market analysis and forecast by line of insurance at least 150 days prior
to each renewal.
3. Assist the City in the design of required coverage.
4. Identify for the City prior to marketing its insurance coverage, all viable markets and
provide this proposed distribution list to the City for approval.
5. Prepare detailed submissions for presentation to markets in a timely manner. A
copy of such submission will be provided to the City prior to its release.
6. Negotiate effectively with underwriters, securing the broadest coverage at the best
available cost.
7. Present renewal programs and options to the City within a reasonable time period
prior to expiration, but no later than 30 days prior.
8. Provide a detailed summary of all marketing activity including carrier's names,
underwriter contacted, final disposition of carrier's quote or action, and a clear
explanation of any declination or reasons for no further consideration being shown a
market.
B. Administration
1. Issue binders, certificates of insurance and other coverage verification documents
as required.

2. Respond promptly to questions from the City.
3. Keep Risk Management advised of activities taking place nationally and locally on
the City's behalf.
4. Prepare and present a formal annual report to the City on the past year's activities
and future plans and goals.
5. Assist with cost allocations, if asked.
6. Prepare a recap of coverage's bound for the City as early in the year as possible.
7. Maintain confidentiality of City records.
8. Assist the City in the creation and maintenance of an underwriting database on City
. premises.
C. Claims
The City of Fort Collins self -administers its Workers' Compensation program and
property/casualty claims. Regardless, some claims will require the brokerage/agency to do
the following:
1. Handle the transmittal of documents to the appropriate insurance carrier's claims
service office.
2. Coordinate with the City's Risk Manager and City Attorney on claims investigation
when requested and, if necessary, conduct post -loss visits to assist in proper claims
preparation, salvage operations, temporary protection and negotiation of claims with
adjusters.
3. Act as the City's advocate in claim disputes with insurance carriers.
4. Provide audits of our claims administered, both property/casualty and worker's
compensation.
D. Loss Control'
1. Act as a liaison between the City and insurance company loss control personnel.
2. Review and evaluate the City's in-house loss control activities.
3. Assist the City in exposure analysis.
4. Develop and assist in the presentations of loss control training and education
programs.
'Note: As this service pertains to "excess of loss" coverage placements, activities are currently
structured in an as needed basis at various levels within the organization.

Insurance
The successful brokerage/agency will be required to provide a certificate to the City of Fort Collins
showing that it has professional liability insurance with minimum coverage of $1 million per claim.
Evaluation Process
It is our intent to review all proposals with a selection committee and an outside consultant.
Members of the selection committee will independently review and rate each proposal based on,
but not limited to, the following criteria:
The extent and effectiveness to which the proposal appears to meet the
requirements of the Request for Proposal.
2. The quantity and quality of similar work that has been provided for other public
entities.
3. Market expertise (availability to varied markets) and the extent of applicable
resources available to the City.
4. Understanding of the services required by the City as outlined in the Scope of
Services as evidenced in the proposal.
5. Qualifications of the brokerage/agency's ability to successfully complete the
services. This qualification shall include, but not be limited to, the agency's financial
status, expertise as an agency, personnel to be assigned to the contract, and the
agency's capability to perform to schedules and demands.
6. Location of personnel to be assigned to the City's account.
7. Overall responsiveness to the RFP.
8. Fees.

previous and current local government experience. These should include other public

LIABILITY COVERAGE OBSERVATIONS AND POTENTIAL CHANGES
Liability Ouotes:
All generally provide the equivalent limit structure, except CIRSA has sub -limits for
discrimination, non -monetary damages, and miscellaneous coverage. '
2. All but CIRSA are "pay on behalf of." Munich's provided form is "indemnification" based,
but either form is available. ,
3. All programs meet the "Liability Named Insured and Additional Insureds" specification
description, except Travelers omits "past boards, commissions and employee."
4. All but CIRSA provide occurrence based coverage.
5. One improvement on limit and retention levels and the impact of defense costs is that
"defense" is inside retention, but applies in additional limits; for all options except CIRSA.
This structure costs an additional 5% under States. Last year Munich's program provided
defense inside the retention and inside the limit.
6. None of the carriers agreed to grant "insured's permission to settle is required." CIRSA
shows some consideration in their program, that is, the Named Insured is consulted. I am
surprised that the policyholder is not shown more courtesy and (who?) has a "hammer
clause" if needed.
7. All general liability quotes have a $500,000 retention. Limits quoted apply in addition to this
limit and not inclusive of it. The only carrier quoting an aggregate retention is Travelers with
a limit of $1,000,000.
8. Of interest is that all polices, except for Workers' Compensation, are non-auditable.
G9. Although the City's liability program has never been auditable, it became evident through
this process that the different programs are rated on any number of measures, for example, by
population for Munich, payroll and employees for Travelers, etc. We recommend the City's
broker define this basis so these fields can be reviewed in their proper context in the
application and included in the insurance summary.
10. Although governmental entities, and more specifically municipalities, strongly control any
risk assumed contractually, we need to address independent contractor exposures in the
context of governmental immunity. States and CIRSA are the only carriers covering this.
H. Munich and Travelers said "no" to our stipulation that `Blanket Contractual (including oral
contracts and department approved law enforcement for others)" coverage be addressed.
Clarification needs to be obtained as to why an unconditional "no" exists with these

States:
At the 25% loss threshold for reporting claims, does the reporting to State's and resulting
association in a claim impair the City's standard claims handling practices internally, and in
the use of their TPA. Our concern is that some carriers wish to be very heavily involved in a
claim. States indicated that a 50% threshold may be possible.
2. Clarification is needed on the level of coverage granted for "improper use of force" in
general and in conjunction with further allegations of criminal conduct for the office in
question and for the management and advisory personnel.
3. The City concerns are:
a. On the issue of Joint and several liability for claims falling within the RRG's
retention and potential assessments, this program is non -accessible.
b. There is no sharing in anyone losses.
4. States has limited coverage for takings, i.e. taking of private property by the insured whereby
the taking is incident to an arrest or the taking is for the purpose of protecting persons or
property in an emergency.
5. Need a copy of the sexual abuse and molestation coverage to confirm coverage.

Clarification is needed as to when and how an offense is deemed to be a criminal act. This
should probably be subject to final adjudication.
Further, the Intentional Acts exclusion makes no reference to any buy back for firefighter
professionals or intentional acts resulting in bodily injury or property damage on any of the
"professional" activities that may result in bodily injury or property damage.
Gallagher's Comparison of Travelers and Munich
Bullet Points of clarification on our recommendation of Munich vs. Travelers
Per Karen Graham: I'd like to preface this by saying both carriers are respectable, financially
stable carriers that specialize in the Public Sector arena.
Munich (recommended carrier)
• Munich form is superior and does not have a "duty to defend" in the form.
• The City and Munich have a large working loss that is in litigation.
• Relationship: Munich understands the City's risks and exposures.
• Munich only works with self insured clients and understands their role in the claims
process vs. a first dollar coverage.
• Munich's claim department has a high level of comfort with the City's claim handling (tpa
and City Attorney).
• Munich's claim handling is hands off and consultative with the City.
• Munich's claim personnel have a thorough understanding of CGIA.
Travelers
• Form is comprehensive but does have a "duty to defend" clause. I caution you to read the
SIR endorsement. While the premium is competitive, I would want to be sure the City
Attorney's office is willing to trade claims handling autonomy for a $30,000 savings.
That alone can ultimately cost the City more than $30,000.
• Travelers Claim Audit will be required annually.
• Travelers claim department doesn't always take CGIA into consideration when adjusting
claims. This is problematic for two reasons, first it can make the City's claims history
higher than it should be and cause undeserved increased rates on future renewals and it
sets a precedence that the City doesn't practice its protection under CGIA.
• Travelers will dictate reserve setting even within the SIR.
