The restoration design will be based on the concept that has already been developed through the collaboration of Biohabitats, Natural Areas, Colorado Water Trust (CWT), and their consultant, Tessara Water. As part of the final design process, this proposal letter also covers 404 wetland permitting and coordination with the floodplain permitting consultant. The construction scope and budget will be submitted after the final design is complete. This project will be design/build; as such, the plans will be developed to a level of detail necessary for permitting and the design/build process. The plans will not be developed to the level of detail needed for bidding. SCOPE OF WORK 1. Final Design Kick Off Meeting. Biohabitats will meet with Natural Areas staff and appropriate CWT representatives to confirm the tasks and schedule, review actions that have occurred since the concept development, and further discuss the completed concept plan, as needed. 2. Field Reconnaissance. Biohabitats will visit the site to collect more detailed site information important for final design development. As part of this task, we will field -check items shown on the concept plan and may collect spot elevations in key locations. Biohabitats has also included time in this task to complete the wetland delineation necessary for wetland permitting (described in a later task). 3. Draft Plan. Biohabitats will develop a draft restoration design and put together a draft design/build• plan set based on available aerial photography and existing contour information. The Draft Plan will include floodplain and wetland grading elevations, structure removal details based on input provided by CWT, channel bed regrading and instream features, bank treatment approaches, planting zones, and plant schedules. 4. Plan -in -Hand. Upon completion of the Draft Plan, Biohabitats will conduct a plan -in -hand meeting with City Natural Areas staff, appropriate CWT staff and consultant, and other participants, as deemed necessary by Natural Areas, to review the Draft Plan and discuss the design, site constraints, and other pertinent considerations. The City will compile and submit comments on the draft plan following the meeting. Biohabitats will incorporate these comments into the Final Plan. 5. Wetland Permitting. Biohabitats will coordinate with the Corps of Engineers (USACE) and prepare and submit a Section 404 wetland permit application to obtain a Nationwide 27 permit. As part of this task, we will participate in a pre -application consultation with the USACE and will obtain a "No Concern" ruling from the U.S. Fish and Wildlife Service (FWS). We will use Natural Area's plant assessment information to help in this task (see assumption #6, below). We will also track the USACE review process and respond to any questions and requests raised by the agency. The permit submittal will be based on the Draft Plan. This task includes Biohabitats' review the current U.S. Fish and Wildlife Service (USFWS) list to identify whether federally listed or candidate special status species or their critical habitat may be present within the project area; in addition, we will contact Colorado Parks & Wildlife and the Colorado Natural Heritage Program to identify special status species information that they may have in their databases for the project area. 6. Biological Assessment. If required, Biohabitats will complete a biological assessment for both the wetland permit application as well as Section 7 consultation under the Endangered Species Act. The following items are proposed for this task: • Conduct one field visit to identify whether federally listed species, candidate species or their critical habitat may be present within the project area and if they may be impacted by the proposed project. • Produce a biological assessment report summarizing our findings. This report will be included in the wetland permit application. A separate copy of the report will be submitted to the U.S. Army Corps of engineers to give to the U.S. Fish and Wildlife Service for Section 7 Consultation. • Coordinate with the agencies to answer any questions that may arise regarding the biological assessment. This task does not include detailed field surveys for specific species (e.g. Preble's meadow jumping mouse) or extensive coordination with the agencies regarding these specific species. Based on our knowledge of the project area, we are assuming that specific species surveys or associated coordination will not be required by the FWS or USACE. If detailed surveys or extensive coordination are required by agencies, an additional scope of work including the field surveys will be provided to the City of Fort Collins for approval. 7. Floodplain Permitting Coordination and Support. It is our understanding that the City will hire a floodplain permitting consultant who will manage all related Floodplain permitting tasks for the entire corridor from Shields Street to the upstream end of the restoration project and including the Shields Street bridge replacement and West Vine outfall project. Biohabitats will provide the 2 floodplain permitting consultant with proposed cross section ground elevations for up to eight (8) cross sections. This cross section information will be based on the existing HEC-RAS cross sections from the floodplain modeling that,will be provided from the floodplain permitting consultant. This task also includes time to attend one team meeting to plan and prepare for the joint CLOMR application as well as time to prepare for and attend one floodplain board review meeting. 8. Final Design Plans. We will prepare the Final Plans to a level suitable for design/build by Biohabitats that will be based on the Draft Plans. The Final Plans will incorporate comments received by the City and regulators, as appropriate, and will include plan views, typical details and cross sections, and planting schedules. Biohabitats will also provide a cost estimate for construction. The Final Plans will include proposed grading based on available existing contour information. TENTATIVE SCHEDULE We are available to begin work on this project immediately. Due to this project's dependence on floodplain permitting and the actions of and coordination with other City departments, there are numerous uncertainties regarding the schedule. Our understanding is that the joint CLOMR is planned to be submitted towards the end of March or in April. Biohabitats will have the Draft Plan completed in time to be able to provide proposed cross section information to the floodplain consultant to allow sufficient modeling time of proposed conditions. Floodplain permitting should be complete by summer, allowing construction to begin during the fall of 2013. FEE Our fee for the scope of work described in this document is $54,010. If the biological assessment is not needed, then the fee is $50,000. Please note that in keeping with our September 30, 2011 Phase 2 Poudre proposal, this fee incorporates the additional Professional Engineer rate of $115.00 per hour to address the absence of a middle category between the of contract rates $95.00 and $125.00. Assumptions This scope and fee estimate is based on the assumptions listed below: 1. The City of Fort Collins is responsible for coordinating project planning activities with their staff. 2. CWT and their design consultant will design the alteration or removal of the Josh Ames diversion structure and dam and related restoration of area impacted by the changes to the structure. In addition, they will provide Biohabitats with these design features and any related information in a format that is easy to add to the plans. 3. Biohabitats' design effort will focus on ecological restoration. 4. If the completed Final Plan requires revision due to unanticipated changes from other related activities (such as floodplain modeling or changes in project objectives), then Biohabitats will prepare and submit a work order modification depending on the extent of the required changes. 5. Biohabitats' scope of work does not include an assessment of water rights, property ownership, or other legal issues that may be associated with the project. 3 6. This scope of work assumes that Natural Areas staff will complete an assessment of Spironthes diluvialis_(Ute Ladies' -tresses) for help obtain FWS approval of the project. 7. Biohabitats' scope does not include special status species surveys. 8. This scope of work assumes that the wetland and open water impacts.will require a Nationwide Permit 27 Aquatic Habitat Restoration and Enhancement and that the FWS will not have any concerns regarding endangered species. It also includes time for a biological assessment, should that be necessary. If, for some unanticipated reason, a different type of permit is required, or if the FWS does have concerns that extend beyond this scope of work, then it will need to be amended to include the work necessary to address the additional regulatory issues. 9. The scope, fee, and schedule do not include any hydraulic analysis related to floodplain regulations or attendance to meetings not covered by this scope of work. Should the project assumptions or design approach change, any additional analysis and coordination will need to be added on a time and materials basis based on our contract rates.
