Cherry Street, Suite 1050 Denver, CO 80246 OWNER: John Dixon 1314 Red Cedar Circle Fort Collins, CO 80524 PROJECT DESCRIPTION: Request to construct a new 80 foot tall co -locatable wireless telecommunication pole at 1314 Red Cedar Circle. The pole will be located at an existing RV storage yard in a fenced enclosure within a fenced compound. The site is located in the Employment zone district. RECOMMENDATION: Approval EXECUTIVE SUMMARY: The proposed wireless telecommunication facility complies with the applicable standards in Articles 3 and 4 of the Land Use Code. COMMENTS: Background: The surrounding zoning and land uses are as follows: N: I. vacant industrial land, CN; Country Club Corners Shopping Center (Including Alberston's) S: I; existing welding shop, vacant industrial land, E: I; existing industrial businesses, W: I; natural gas storage tank, CN; existing commercial uses along College Avenue. Definition [Section 5.1.21: The Land Use Code defines "Wireless telecommunication facility' as "any freestanding facility, building, pole, tower or structure used to provide only wireless telecommunication services, and which consists of, without limitation, antennae, equipment and storage and other accessory structures used to provide wireless telecommunication services." 3. Zoning [Division 4.191: The entire block is zoned Industrial (1). In this zone district, wireless telecommunications facilities are permitted, subject to administrative review. 4. Compliance with Applicable Standards (Section 3.8.131: The Land Use Code requires that a request for wireless telecommunications facilities comply with a prescribed set of standards as outlined in Section 3.8.13 of the code. The applicable standards are discussed below. A. Co -location [3.8.13(B)]: The proposed pole provides a space for an additional antennae to be located 10 feet below the proposed antennae. A note has been attached to the plans stating that the owners or lessees shall not act to exclude any other wireless telecommunication provider from using the same existing structure. B. Color [3.8.13(C)(3)]: The pole will be painted gray to blend in with the sky as best as possible. C. Landscaping [3.8.13(C)(4)]: The entire RV storage yard is fenced with a 6 foot stockade cedar fence. Landscaping meeting the requirements of LUC 3.2.1 already exists to screen the site. D. Fencing [3.8.13(C)(5)]: The area around the ground -mounted equipment will be fenced with a six-foot high cedar fence enclosure. E. Lighting [3.8.18(C)(9)]: There will be no new lighting as a result of this proposed pole. 5. Neighborhood Compatibility: The primary compatibility issue typically raised during the review process of telecommunications requests is radio interference. The applicant has stated the frequency of wireless telecommunications equipment are designed not to interfere with frequencies used by other electronic devices such as radios, Evergreen Park, The i oy Shed (1314 Red Cedar Circle), Wireless Telecommunication Facility — P.D.P. , File # 50-91 F March 20, 2001 — Type 1 Administrative Hearing Page 3 televisions and in no way be detrimental to the health, safety and well-being of the community. Since the installation of numerous wireless telecommunications equipment, Staff has not received one complaint from surrounding residents regarding electronic interference. 6. Findings of Fact and Conclusion: In reviewing the request for the Toy Shed Wireless Telecommunication Facility, Project Development Plan, staff makes the following findings: A. The request is defined as "wireless telecommunications facility." B. Wireless telecommunications facilities are permitted in the Industrial (1), Zone District, subject to administrative review. C. The proposed facility meets the applicable criteria in the zone district standards in Article 4 of the LUC. D. The proposed facility, including the pole and ground -mounted equipment, meet the applicable design standards in Article 3 of the LUC. Collins, Colorado will be designed according to standard engineering practice with reference to a site specific soils report and according to site wind load conditions. The tower will be designed not to fall down under normal and most adverse circumstances. Box 580 Fort Collins, CO 80522-0580 On behalf of Nextel Communications (Applicant) please accept this letter as proposed Applicant's request for an Administrative Review (Type One), and approval, for an unmanned, wireless, telecommunications facility to be located at 1314 Red Cedar Circle, Ft. Collins, CO 80524. Current use of this site location is as a recreational vehicle storage yard. Proposed Applicant's intent is to install an unmanned, collocatable, wireless telecommunications facility. The purpose of this installation is to provide wireless telecommunications coverage in and around the northeast area of Ft. Collins, CO. Statement of Planning Objectives Proposed Nextel Wireless Telecommunications Facility (Josh Ames/CO-0398C) Owner: John C. Dixon Location: 1314 Red Cedar Circle, Ft. Collins, CO 80521 Assessor's Parcel Number: 9701214004 The Zone District is Industrial (1). Wireless Telecommunication Facilities are permitted, subject to Administrative Review, in this Zone, according to the City of Ft. Collins Land Use Code (updated December 1998), Division 4.23 (B)(2)(d). Maximum building height in this Zone is 4 stories (100 feet) for nonresidential uses, according to the City of Ft. Collins Land Use Code (updated December 1998) Division 4.23 (13)(1)(a). Nextel is requesting approval for an 80-foot, collocatable, monopole. This request is 20 feet below the allowable height maximum. Required Setbacks, for the monopole, from the east and west lot lines are satisfied (1 foot of setback for each foot of height, from the City of Ft. Collins Land Use Code, Division 3.8, Section 3.8.13 (C)(1)). The required Setbacks from the north and south are not satisfied, however a Stamped letter from a Colorado licensed PE stating that this monopole is engineered to avoid structural failure, is a part of this Application (and is required in order to waive the required setback). There will be a solid cedar fence around the base of this 40' by 40' (total footprint) facility, for screening. The facility will include a 12' by 22' equipment shelter and an 80' monopole. The facility is to be located inside an existing fenced area, the outside of which has been landscaped according to a landscape plan that was approved by the City of Ft. Collins in 1998. The owners of the property have recently brought this landscaping plan into compliance (as of 7/12/00) by completing the original planting schedule and by replacing some of the original plantings that had died. Out of 81 plants and trees that have been planted here, 9 are dead or dying. These will be replaced with identical, live, plants. It should be noted that even with the 9 dead plants (out of a total of 81 in the landscaping plan), this property has by far the most, and nicest, landscaping on Red Cedar Circle. The property to the south (1232 Red Cedar Circle) has only 4 trees and 8 shrubs. The property across the street, to the west, (1331 Red Cedar Circle) has 48 various trees and bushes (mostly untrimmed and neglected), some of which have overgrown the sidewalk so badly that a pedestrian would have trouble walking on the sidewalk in some places. The property adjacent, to the north and east (no address, but the owner is Scott R. Milan) has no landscaping whatsoever on either of the two sides (north and east) that face city streets Red Cedar Circle and Blue Spruce, respectively. The original landscaping plan for 1314 Red Cedar Circle leaves little room for new landscaping along the north and west sides of the property. However, the existing fence is an additional screen on these sides. Additionally, views from the north side of the property are well screened by existing buildings on the property, with additional screening being provided by the outside perimeter fence and the proposed inside fence at the base of the facility. The views from the east and south will be screened by an existing building, a covered parking structure, and the recreational vehicles stored thereunder, and the proposed fence surrounding the facility. Because it would appear that this area seems to be adequately screened from public view, Nextel is not planning on adding any additional landscaping to this property unless specifically directed to do so by the Current Planning Department, as a condition of approval. Nextel will paint the monopole a tan or medium brown color as preferred by the City. Additionally, the antennas willbe enclosed with fiberglass shields -(painted -to -match -the monopole) in order to make the antennas resemble light fixtures atop the monopole.
