TO ALL PERSONS TAKE NOTICE:
Ted Shepard; being duly sworn and upon oath, does affirm and state the following:
1. I am the Senior City Planner for the "Current Planning" division of the City of Fort
Collins department of Community Planning and Environmental Services.
2. I was the project planner for the Fort Collins Truck Sales P.U.D., the_final plan and plat
of which was approved by the Fort Collins Planning and Zoning Board on April 27, 1992.
3. The Fort Collins Truck Sales P.U.D. consisted of Lot 2 of the Brush Mobile Home
P.U.D., which was approved on September 28, 1981, by the Fort Collins Planning and Zoning Board,
notice of which was recorded in Book 2138 at Page 1539 of the Larimer County, Colorado records.
4. On December 18, 1992, the City of Fort Collins caused to be recorded with the Larimer
County Clerk and Recorder certain site and landscape covenants for the Fort Collins Truck Sales P.U.D.,
which covenants were recorded at Reception No. 92081565; and also recorded on December 18, 1992, a
notice regarding the Fort Collins Truck Sales P.U.D. at Reception No. 92081564. Both the aforesaid
covenants and notice made reference to the Fort Collins Truck Sales P.U.D. as including both Lots 1 and
2 of the aforesaid Brush Mobile Home P.U.D.
5. The covenants and notice as described in paragraph 4 above are erroneous in as much as
they reference the Fort Collins Truck Sales P.U.D. as being composed of Lot I of the Brush Mobile
Home P.U.D., and the purpose of this Affidavit is to correct said error by affirming that the Fort Collins
Truck Sales P.U.D. was, and is, only composed of Lot 2 of the Brush Mobile Home P.U.D.
