At the meeting, Tom Herman presented the contractor's concerns regarding the upcoming winter months and the impact on the project schedule, suggesting that the City had delayed the project schedule due to licensing and building permit issues. Unanticipated construction during the winter months will result in significant winter protection costs to the project. Tom presented an exhibit outlining the original schedule proposed and accepted at the outset of the project as well as two additional exhibits including an option of closing down construction for the winter and the other option of continuing construction through the winter. During the meeting, it was agreed that the building permit process began on June 19, 2012. It was also agreed that the City had completed its building permit review on August 31, 2012 and the permit was available for pick-up as of the same date. Due contractor licensing issues, Designscapes did not pick-up the permit until October 19, resulting in the delay. The City supports the option of closing down construction for the winter, though the City would like to have the park completed by the end of May, or at the latest, mid -June of 2013. The City is concerned about the public perception of the delayed park opening, as the public was originally informed that a late 2012 opening would be possible. The City does not agree that cost delays are the fault of or the responsibility of the City beyond the August 31 building permit sign -off date. The City is willing to work with the contractor and allow flexibility with the scheduling of work in order to ensure the best possible product and substantial completion of the park by the end of May. The City appreciates the contractor's proactive approach to solution building regarding this schedule delay. However, the City requests that the contractor be more proactive in returning change orders that are in acceptable format (no lump sums) to the City within one week that of Fort Collins the need for the change order is identified. The City needs to have proper identification of cost revisions in a timely manner in the format acceptable to the Purchasing Department and the City project manager. The City has been pleased with the progress and quality of the work to date on the park and would like the contractor to continue with park construction.
