LLC tut ecdlogy October 17, 2012 Mr. Craig Foreman Park Planning Manager City of Fort Collins Park Planning Department 215 North Mason Street P.O. Box 580 Fort Collins, Colorado 80522-0580 RE: Phase I Environmental Site Assessment: Sidehill (Bucking Horse, LLC) Property, Portion of Parcel Number 87204-12-001 (Approximately 6 Acres), Fort Collins, Larimer County, Colorado Dear Craig, Walsh Environmental Scientists and Engineers, LLC (WALSH) is pleased to present this proposal to conduct a Phase I Environmental Site Assessment (ESA) for the above -referenced property. WALSH understands that the site consists of approximately six (6) acres of land which have been used principally for agricultural purposes. Furthermore, it is our understanding that the proposed use of the property will be for development of a neighborhood park. The proposed project area is based on information (a figure/drawing) which was submitted to WALSH on October 12, 2012. A Phase I ESA is designed to screen properties for environmental contamination or listing on relevant federal, state and local environmental databases and to identify recognized environmental conditions (RECs) affecting the subject property. WALSH will conduct the assessment in accordance with ASTM International (ASTM) Standard E1527-05 for conducting Phase I ESAs. No sampling of suspect air, soils, waters, wastes, or building materials is included in this bid. The costs to conduct the Phase I ESA will be billed on a fixed price basis of $3,250. The report can be completed within approximately four weeks from receipt of written notice to proceed (executed City of Fort Collins — Work Order). This cost and timeframe are based upon timely receipt of information from the user of the Phase I ESA, readily available access to the properties for the visual inspection, and full cooperation with the current owner(s)/occupant(s). Attached is a written scope of work to be performed and the projects terms (Attachment A). We appreciate the opportunity to provide you a proposal for this project. Please contact me if you have any questions. Respectfully submitted, Troy C. ASTM Standard E1527-05 defines RECs as "the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, ground water, or surface water of the property." RECs do not include de minimis conditions. ASTM Standard El527-05 defines de minimis conditions as "conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies." WALSH will conduct the assessment in accordance with ASTM International (ASTM) Standard E1527- 05, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process. No sampling of suspect air, soils, waters, wastes, or building materials is included in this bid. The subject property (hereafter referred to as the "Site") consists of approximately six (6) acres of land which have principally been used for agricultural purposes. The scope of WALSH's services will include the following tasks: Task 1. Records Review The records review will provide information on the physical setting of the Site and activities on the site and in the surrounding area which may have had an adverse impact on the property. This task includes review of the records identified below. Physical Setting Sources At a minimum, the latest United States Geological Survey (USGS) 7.5-minute topographic map for the Site will be reviewed to determine site topography and likely contaminant migration pathways (e.g. surface water and groundwater). In addition, other readily available sources will be reviewed including USGS and/or state geologic maps and groundwater maps. Environmental Database and Records Review An environmental database report for the site will be obtained which includes searching the following records and minimum search distances (per ASTM standard requirements): Record Searched Federal National Priorities List (NPL) sites Federal Delisted NPL sites Federal Comprehensive Environmental Response, Compensation, and Liability Information Systems (CERCLIS) sites Federal CERCLIS no further remedial action planned (NFRAP) sites Federal Resource Conservation and Recovery Act (RCRA) corrective actions (CORRACTS) sites Federal RCRA Non-CORRACTS treatment, storage, and disposal (TSD) facilities Federal RCRA Generators list Radius Searched 1 mile mile Mile Mile 1 mile /z mile Site and adjoining properties Proposal -Phase I ESA - Sidehill (Bucking Horse, LLC) Property 10-17-2012.doc I AiWa4sh Environmental Scientists and Engineers, LLC Federal Institutional/Engineering Control Registries _ Site Federal Emergency Response Notification System (ERNS) list Site State and Tribal -equivalent NPL sites I mile State and Tribal -equivalent CERCLIS sites %2 mile State and Tribal Landfill sites %2 mile State and Tribal Leaking Storage Tanks lists %2 mile State and Tribal Registered Storage Tanks lists Site and adjoining properties State and Tribal Voluntary Clean -Up sites /2 mile State and Tribal Brownfield sites /2 mile State and Tribal Institutional/Engineering Control Registries Site As necessary, readily available/electronic versions of selected files for facilities identified in the environmental database report will be reviewed to evaluate environmental impacts to the Site. If significant supplemental file review activities at the physical location of appropriate government agencies are determined to be warranted, this task would be completed on a separate time and materials basis. Historical Records Review The records review will also include a review of historical records to identify, if possible, obvious uses of the Site back to its first developed use or to 1940, whichever is earlier. The historical sources consulted may include any or all of the following, as well as other records necessary to satisfy the objectives of the ASTM standard: Available city or county planning, zoning and building records, historic Sanborn maps, and historic topographic maps; . Local, state and federal regulatory agencies' records for public information related to possible hazardous material releases on the subject and surrounding properties; and Historical aerial photographs. Task 2 - Site Inspection/Interviews A physical inspection of the Site and, to the extent practical, adjacent properties will be conducted to complement the findings of the records review, to identify past and present land use practices, and to identify potential environmental liabilities. This task will: • Identify visual indications of environmental contamination, land use practices, waste materials, suspect building materials, and other potential liabilities on the Site and adjacent properties; • Examine transformers located on sites for conspicuous leaks involving potential poly- chlorinated biphenyl (PCB) containing fluids; • To the extent possible based on the interview with the current owner or key site manager, document current and past chemical usage and waste management on the Site; • Obtain photographic documentation of the current Site conditions and pertinent Site features; and • Interview a representative of the owner(s) and/or occupant(s) and/or ask to complete a site -specific questionnaire prior to the time of the inspection. Interviews or questionnaires will also be completed with the user of the Phase I ESA, state and local government officials, and (if necessary) other individuals with knowledge of the Site such as current employees or past owners, operators, or employees. Task 3. Report Proposal -Phase I ESA - Sidehill (Bucking Horse, LLC) Property 10-17-2012.doc 2 WaN Environmental Scientists and Engineers, LLC The report will compile the findings of the investigation along with copies of relevant documents as exhibits. The report will: • Present factual information and WALSH's professional opinion regarding the presence or absence of recognized environmental conditions at the Site; • Provide documentation of Phase I ESA activities; • Include a statement of assumptions used in conducting the assessment, deviations from the ASTM standard, and a review of its limitations; and • Provide a discussion of data gaps in the report and their significance. WALSH will provide two bound copies and one electronic (Adobe PDF format) version of the report.
