Dear Nick,
Thank you for your interest in Bob Behrends Roofing, LLC. In order to make the roofing experience go
smoothly, let me tell you a little about our process.
• Step One: Receive an estimate from a quality local roofer. To easily verify if a roofing company is from the
area, locate their ad in current and past yellow pages. Most reputable local companies use this form of
advertising. Also, verify that your roofer has both worker's compensation & general liability insurance. We
can mail you certificates upon request. They should also hold a current license for your municipality as
required by our city.
• Step Two: Choose a roofer. Remember to not only choose your roofer by price, but compare what is being
offered as far as product, professionalism, and knowledge as well. If you choose to work with us, all we
need from you is a signed copy of the estimate and a color.
• Step Three: Choose how you want to pay. By choosing to use Bob Behrends Roofing you have the ability to
make the choice between payment upon completion with check, visa or mastercard. The second option is 12
months same as cash with our partner Allied Building Products. This requires a short over the phone
application and approval is given within minutes. This option must be chosen upon acceptance in order to
get the proper paper work in place. please call with any questions you may have or how this can benefit your
decision.
• Step Four: After receiving the signed estimate, we will proceed with ordering your shingles from our
supplier. Your shingles shall arrive prior to starting thejob.
• Step Four. We will try to contact you the day before or the morning prior to starting the job. What we need
to start the job:
• Access to driveway & outside electrical
• If you have anything in your attic or unfinished garage that you do not want us to get dirty, please
move it. Debris falls down through decking, especially spaced decking, during the roofing process.
• If you have a satellite dish please plan on scheduling with the dis¢ provider to have dish realigned
because we may have trouble getting a signal. You may incur a cost for this please check you're your
provider.
• Most homes are complete in 1-2 days.
• Step Five: Yourjob is complete! You will soon be receiving an invoice in the mail or via fax or phone.

Roofing Proposal INCLUDES: Based on an onsite assessment 9/10/12
1. Remove multiple layers of existing shingles to the roof deck

Considerations/Options:

3. Reflash drip edge material at loose areas only a soutr modified built-up roof, as per Nick's direction. Existing metal and roof system to
remain, remove existing ship -in material, and flash in new edge material to tic -into existing mof system, approx. 1801f, add $2.922.00 to
proposal amount
This offer will remain open for you acceptance for 30 days from the date of this letter. If there is an increase in the price paid by Front Range
Roofing Systems, LLC for products, the amount of this proposal/contract shall be similarly increased to reflect the increased costs to obtain materials.

TERMS AND CONDITIONS
FRONT RANGE ROOFING. LLC awes to the followbha:
A. Contractor will carry Workers Compensation and General Liability Insurance during the Work on this project
2. This proposal includes all material, labor, and equipment to complete the Work outlined herein and payment terms. Contractor will notify
the Customer of any unforeseen conditions which the roofing crew observes that may affect the Work The Customer may have the
conditions corrected by Front Range Roofimg, LLC under a change order, or by another qualified Contractor. The Customer acknowledges
that Contractor is neither an architect nor an engineer and that only obvious defects will be reported.
3. The Work will be scheduled upon receipt of an acceptance of this proposal from Customer. All Work will be completed in a timely and
workmanlike manner. Worst will only be performed when weather permits quality application. Schedule adjustments may be necessary
due to conditions caused by bad weather.
THE CUSTOMFR agrees to the following;
I. No warranty, either expressed or implied, is provided by Contractor unless specifically stated in writing elsewhere in this proposal. Any and
all warranties provided by Contractor do not cover patch work, partial reroofs, or tie-ins to adjacent roofs or wall surfaces, or arty conditions
beyond the control of Front Range Roofing LLC.
2. Customer agrees to afford the Contractor with reasonable opportunities to remedy any deficiencies in the Work through prompt notification
ofany leaks and by providing access to the Work area. The Customer agrees that documented leakage will be the sole and only basis of
any legal action regarding deficiencies in the Work.
3. Damage mused by other trades is not the responsibility of Front Range Roofing, LLC.
4. Contractor's scope of work does not include die identification, detection, abatement, encapsulation or removal of asbestos or any other
hazardous materials. If any such product or material is encountered and identified by anyone in the course of Contractor's Work, Contractor
shall have the right to discontinue the Work until such products, materials or hazards are removed or until it is determined that no hazard
exists. Remobilization fees and time delays will be the responsibility of the Customer.
5. The Customer shall be fully responsible for any required identification or removal of mold or mold spores within the structure resultant from
moisture either before or after the Work of this contract. Customer agrees that no warranty, whether express or implied, covers any mold or
mold spore removal, and also agrees to be fully responsible for any health conditions mused by mold or mold spores present either before or
after the Work of this contract.
6. The Customer will provide access to the building electricity, and water, if required by Contractor to perform the Work.
7. 1he Customer will relocate or provide protection and insurance for any and all contents of die building upon which Work is performed.
8. Contractor is not responsible for interior or consequential damages occurring during tie course of Work or during the duration of any
warranty. The Customer is responsible for all primary insurance coverage for the building and its contents dun ing the course of Contractor's
Wmi, and for the duration of the warranty.
9. Upon completion of Contractors Work, maintenance of the building shall be the responsibility of the Customer. This includes periodic
professional inspection of the roof surface, caulking of sheet metal components, prompt correction ofdefects not covered by the warm»ty, if
any, and prompt notification of any and all defects covered by any warranty.
10. The following items are not included unless specifically stated in this proposal: a. deck repair or replacement; b. mow, im, or moisture
removal; c work of other trades including carpentry; d. painting; e. skylight replacement; F. plumbing; g. electrical; h, structural; or i. the
added slope of the roof surface through either tapered insulation or structural modification.
11. The Customer may accept this proposal either by signature or real assent followed by written verification authorizing the Contractor to
commmcc work, or nmldng payments to the Contractor in the consideration of services, and any of the above incorporates all of the
terms of dtis proposal into the contract between the parties thereby formed.
12. Payment in full is due upon completion ofihe Work unless otherwise specified stated in this proposal. Monthly progress billings may be
issued during the course of this job for material stored for this job and Work done to data A finance charge calculated at 1.5%per month
(I go/aAPR) will be added to the unpaid balance for all past due accounts (Minimum cbe ge: S 10.00 per month). In the event this account
becomes delinquent, attorney fees and collection charges will be paid by the Customer.

The prices, scope of work on page I and terms and conditions on page 2 are satisfactory and arc hereby agreed to and accepted by the

Scope of work
1. Remove existing shingles and replace with new Owens Corning Oakridge Dimensional shingles in a standard color. (Includes disposal,)
2. Install standard Owens Corning starter shingles, ridge shingles, and metal flashing as necessary.
3. Install Ice and Watershleld underlayment on eaves and in valleys. Install new 15if felt underlayment on remaining roof.
4. Install metal drip edge on rakes and eaves.
S. Remove and reset existing furnace flue flashings as necessary.
6. Replace plumbing stack flashings. Paint flashings to match shingle color.
7. Install vented ridge to ensure proper attic ventilation.
8. All roofing debris will be cleaned up daily. Every effort will be made to keep the site clean and presentable throughout the project.
9. If there is delammated or rotten wood decking found it must be replaced. The cost will be $45,00 per repair area up to 4' x 4. This amount is not included in the
price below. This cannot be conclusively determined until the time of the tear -off.
10. Anticipated completion time is three days -from start to finish.
11. Price includes all necessary labor, materials, taxes, licenses, permits, deliveries, safety, miscellaneous flashings, sealants, and clean-up as may he required fora

SCOPE of WORK
We propose to complete the following:
• On EPDM roof, pull up the loose flashing, clean area, and reattach to surface walls. Strip -in laps with 6" uncured
rubber.
• On smooth modified roof, cut back loose flashing along drip edge (approx. 158 LF). Prime perimeter with an asphalt
primer to ensure proper adhesion. Strip -in metal edge with plastic cement and 6" cotton fabric.
• Reseal around pipe flashing and where old curbs used to be with plastic cement.
• Coat all repairs with aluminum coating to prolong repairs and to protect from UV rays.
• For your reference, we will provide before and after pictures within 3 days of repair completion.
• Price includes all labor and materials necessary for repairs.

SERVICF GUARANTEE: RTN guarantees that all work performed will he done in a professional and workmanlike manner in strict compliance
with accepted roofing practices. RTN promises to use `good faith' in all of its practices and assessments. Unless stated oth erwise in this proposal, the
workmanship and performance of any roof repair is guaranteed for a period of 2 years from the date of completed service. In order to reduce the overall
cost of service to you, RTN will endeavor to perform any leak repair in a conservative and progressive fashion. Therefore, there is no expressed or
implied guarantee that each individual leak repair will be successful in eliminating such leak, only that the work will be performed in good faith as
described above. This means that we will begin any leak repair with a limited scope of work and expand that scope progressively if the previous repairs
are deemed to be insufficient. This approach will prevent the more costly comprehensive scope of work in the initial stages of the service. In no case
will RTN perform and charge for service work that it does not deem necessary. Our guarantee to you is that we will endeavor to provide superior
maintenance and repair service with the utmost professionalism, honesty and integrity at a fair, reasonable and honest price. Any warrantyclaim is

EXHIBIT A
DELAYS If RTN is delayed at any time either before commencement of work or while in the process of work by any
instruction(s) of the Owner, or their duly -authorized agent, or by rain, snow, storm, gale, hurricane, fire, hailstorm,
tornado, flood, other such natural phenomena, labor disputes, unusual delays in transportation, unavoidable
casualties, or any causes beyond RTN control, the anticipated date of commencement or completion shall be
extended by a reasonable amount of time.
WARRANTIES RTN makes no warranties of any kind, expressed or implied, except those provided for in the signed
contract or by separate written warranty of RTN or manufacturer. RTN specifically disclaims, and shall not be liable
for, any damage(s) which result from conditions which pre-exist the commencement of work by RTN or which result
from rain, snow, storm, gale, hurricane, fire, hailstorm, tornado, flood, or other such natural phenomena after
commencement of work by RTN. It is also understood by Owner that roof conditions which pre-exist the
commencement of work by RTN may result in water infiltration or damage(s) during the performance of the work by
RTN due to the natural result of the reroofing process and therefore, Owner holds RTN harmless for any and all
incidence(s) and damage(s) that result from work performed by RTN with such pre-existing conditions.
EXCLUSIONS Due to the fact that mold and mildew may naturally develop on many different building components
and surfaces, including roofs, and in consideration of any and all work performed by RTN, including but not limited
to, maintenance, repairs, recovering, or coating, RTN hereby disclaims any and all responsibility for any and all
incidental or consequential damage(s), including health problems, that is/are attributed to pre-existing, present, or
future claims and actions associated with the growth of mold or mildew.
RTN specifically excludes the removal, handling, or disposal of asbestos -containing materials of any type as part of
the signed contract, unless specifically and otherwise noted.
RTN will exercise due caution when working around or moving existing air conditioning (A/C) units or other
equipment. However, RTN will not assume responsibility for any necessary or deemed necessary repairs to A/C units
or equipment that is/are damaged in the normal course of roofing.
RTN makes every effort to include all labor and material(s) required to properly complete the roofing installation as
outlined in the signed contract. However, if items are discovered in the course of satisfying the signed contract,
which requires additional work for project completion, such items and/or additions will be performed with an
authorized Change Order, usually at an additional charge. Owner will be notified upon discovery of such items and
prior to completion of any work resulting in added costs. This applies to circumstances that could not reasonably
have been apparent at the time of the bidding and/or contracting process.

During my PM inspection of Club Tico, I observed that the shingle portion of the roof
was very deteriorated and worn. The shingles are cracked, torn, missing in places and
nails are popping through on the entire body of the roof. I have enclosed pictures for your
reference.
It looks like repairs have been done previously but it appears that a complete removal and
re -roof may be in order. During my inspection of the shingle roof I also looked at the
built up roofing and EPDM roofing, and while both these areas could use some work, I
feel that repairs will be sufficient to bring the built up and EPDM areas back up to speed.
I received bids from RTN Roofing, Front Range Roofing and Bob Behrends roofing.
��• RTN's quote is $19,833 for the main body of the roof and $1413 for the built up
and EPDM sections. They have included a unit price of $120.00 per SQ to replace
21 I plywood roof deck if necessary.
Bob Behrend's quote is $27,217 for the main body of the roof, the EPDM and
also the built up roof. They have also included a unit price of $130 per SQ to
replace plywood roof deck if necessary.
i • Front Range Roofing's quote is $17,815 for the main body of the roof, $728 for
the EPDM repairs and $2,922 for the built up roof repairs. They have also

If this work were to be approved, based on the scope of work, materials provided and
inclusions, I would recommend that RTN be awarded the contract.

SCOPE of WORK
We propose to complete the following:
• On EPDM roof, pull up the loose flashing clean area, and reattach to surface walls. Strip -in laps with 6" uncured
rubber.
• On smooth modified too& cut back loose flashing along drip edge (approx. 158 LF). Prime perimeter with an asphalt
primer to ensure proper adhesion. Strip -in metal edge with plastic cement and 6" cotton fabric.
• Reseal around pipe flashing and where old curbs used to be with plastic cement.
• Coat all repairs with aluminum coating to prolong repairs and to protect from Uv rays.
• For your reference, we will provide before and after pictures within 3 days of repair completion.
• Price includes all labor and materials necessary for repairs.

SF,R'vTCE GUAP kNCEE: RTN guarantees that all work performed will be done in a professional and workmanlike manner in strict compliance
with accepted roofingpractices. RTN promises to use'good faith' m all of its practices and assessments. Unless stated otherwise in this proposal, the
workmanship and parformance of any roof repair is guaranteed for a period of 2 years from the date of completed service. In order to reduce the overall
cast ofservice to you, RTN will endeavor to perform any leak repair in a conservative and progressive fashion. Therefore, there is no expressed or
implied guarantee that tech individual leak repair will be snecessfld in eliminating such leek, only that the work will be performed in good faith as
described above. This means that we will begin any leak repair with a limited scope of work and expand that scope progressively if the previous repairs
are decried to be insufficient This approach will prevent the more costly comprehensive scope of work in the initial stages o f the service. In no case
will RTN perform and charge for service work that it does not deem necessary. Our guarantee to you is that we will endeavor to provide superior
maintenance and repair service with the utmost professionalism, honesty and integrity at a fair, reasonable and honest price. Any warranty claim is
limited to correcting any 6ulty work that RTN performed. Guaranteespecifically excludes any claim for consequential damages.

DELAYS If RTN is delayed at any time either before commencement of work or while in the process of work by any
Instruction(s) of the Owner, or their duly -authorized agent, or by rain, snow, storm, gale, hurricane, fire, hailstorm,
tornado, flood, other such natural phenomena, labor disputes, unusual delays in transportation, unavoidable
casualties, or any causes beyond RTN control, the anticipated date of commencement or completion shall be
extended by a reasonable amount of time.
WARRANTIES RTN makes no warranties of any kind, expressed or implied, except those provided for in the signed
contract or by separate written warranty of RTN or manufacturer. RTN specifically disclaims, and shall not be liable
for, any damage(s) which result from conditions which pre-exist the commencement of work by RTN or which result
from rain, snow, storm, gale, hurricane, fire, hailstorm, tornado, Flood, or other such natural phenomena after
commencement of work by RTN. It is also understood by Owner that roof conditions which pre-exist the
commencement of work by RTN may result in water infiltration or damage(s) during the performance of the work by
RTN due to the natural result of the reroofing process and therefore, Owner holds RTN harmless for any and all
incidence(s) and damage(s) that resultfrom work performed by RTN with such pre-existing conditions.
EXCLUSIONS Due to the fact that mold and mildew may naturally develop on many different building components
and surfaces, including roofs, and in consideration of any and all work performed by RTN, including but not limited
to, maintenance, repairs, recovering, or coating, RTN hereby disclaims any and all responsibility for any and all
incidental or consequential damage(s), including health problems, that Is/are attributed to pre-existing, present, or
future claims and actions associated with the growth of mold or mildew.
RTN specifically excludes the removal, handling, or disposal of asbestos -containing materials of any type as part of
the signed contract, unless specifically and otherwise noted.
RTN will exercise due caution when working around or moving existing air conditioning (A/C) units or other
equipment However, RTN will not assume responsibility for any necessary or deemed necessary repairs.to A/C units
or equipment that is/are damaged in the normal course of roofing.
RTN makes every effort to include all labor and material(s) required to properly complete the roofing installation as
outlined in the signed contract. However, if items are discovered in the course of satisfying the signed contract,
which requires additional work for project completion, such items and/or additions will be performed with an
authorized Change Order, usually at an additional charge. Owner will be notified upon discovery of such items and
prior to completion of any work resulting in added costs. This applies to circumstances that could not reasonably
have been apparent at the time of the bidding and/or contracting process.

SB38 -The Consumer Protection/Roofing Bill
Applying to residential properties for roofing work over $1000, will be signed into law by
Governor Hickenlooper and become effective on Wednesday 6/6.
There is no'grace period' for compliance. The recommendation is to comply with the spirit
and intent of the law immediately and get contracts printed or altered with newly required
contract language as soon as is practical and possible.
Therefore, effective 6/6:
Allow for the stated rescission periods; do not waive, pay or rebate any deductibles; if your
company requireslaccepts deposits from property owners, set up a trust account to hold funds
as required by law. Immediately and always include in the required written & signed contract
between the property owner and roofing contractor the following information:
• scope of roofing services & materials to be provided
• cost for same based on damages known at the time the contract is entered into
• approximate dates of service
• roofing contractor's contact information
Addendum 1 to Contract/Estimate Shall Be Considered Part of Contract
1. Bob Behrends Roofing, LLC shall hold in trust any payment received from you until
Bob Behrends Roofing, LLC has delivered roofing materials at the site or has performed
a majority of the roofing work on your property.
2. Bob Behrends Roofing, LLC carries worker's compensation, automobile and commercial
general liability (bodily injury and property damage) insurance. A Certificate of Insurance
identifying our insurance carrier and the types and amounts of coverage and our insurance
contact information is attached or will be provided to Customer and is incorporated herein by
reference and should be considered as part of this contract.
3. You have the right to rescind this contract and obtain a full refund of any deposit within 72
hours after entering the contract. If you plan to use the proceeds of a property and casualty
insurance policy to pay for the roofing work, you may rescind this contract within 72 hours after
you receive written notice from the property and casualty insurer that your claim has been
denied in whole or in part. However, Bob Behrends Roofing, LLC is entitled to retain payments
or deposits to compensate Bob Behrends Roofing, LLC for roofing work actually performed in a
workmanlike manner consistent with standard roofing industry practices. Bob Behrends Roofing,
LLC cannot pay, waive, rebate, or promise to pay, waive or rebate all or part of any insurance
deductible applicable to the insurance claim for payment for roofing work on your property.
4. Property Owner is / is not intending to make payment from the proceeds of
a property and casualty insurance policy.
Penalties:
1) Existing Colorado statute related to property insurance fraud (CRS 18.13.119.5) states that
paying, waiving or rebating a property owner's insurance deductible is a Class 2 Misdemeanor.
This bill goes farther to say that if it is proven a deductible was paid/waived/rebated, the
insurance company does not have to consider the estimate from any contractor violating the
provision, and the property owner or the insurer may sue the contractor for any damages related
to same. Damages may include just the deductible amount, or the cost difference between
appropriate roofing materials and any lesser quality materials that a contractor may have used
in order to offset the cost of the deductible, etc. Recoverable damages would be case specific.
2) A contract lacking SB38's specific written provisions may be found to be unenforceable by
either party.
