Proposals may be submitted by E-mail. E-mail submittal shall be e-mailed to: jstephen@fcgov.com. Please send a separate e-mail to confirm that your proposal was received. If submitting written proposals, five (5) copies, will be received at the City of Fort Collins' Purchasing Division, 215 North Mason St., 2nd floor, Fort Collins, Colorado 80524. Proposals will be received before 3:00 p.m. (our clock), May 17, 2012 and referenced as Proposal No. 7389. If delivered, they are to be sent to 215 North Mason Street, 2nd Floor, Fort Collins, Colorado 80524. If mailed, the address is P.O. Box 580, Fort Collins, 80522-0580. O'Neill II, CPPO, FNIGP Director of Purchasing & Risk Management RFP 7389 Exhibit Lighting for the Fort Collins Museum of Discovery Page 2 of 144 7389 EXHIBIT LIGHTING FOR FORT COLLINS MUSEUM OF DISCOVER SCOPE OF WORK Section 1.0: Proposal Requirements 1.1 General Description The City of Fort Collins is soliciting proposals for the purchase and installation of exhibit lighting in the Fort Collins Museum of Discovery, located at the 408 Mason Court, Fort Collins, CO 80524. 1.2 Proposal Submittal The City of Fort Collins shall not reimburse any firm for costs incurred in the preparation and presentation of their proposal. Firms submitting proposals shall submit five (5) copies of the proposal with the following information: a. Company history and experience in installation of lighting, as described in the scope of work. b. The name of the company representative responsible for coordinating with City representatives during the procurement and installation of the exhibit lighting. c. References from five or more governmental organizations which have used your company for similar products and services within the last five years. d. A written description of the proposed products and services as required below. e. Pricing, as requested. The proposal must be signed by a duly authorized representative of the firm submitting the proposal. The signature shall include the title of the individual signing the proposal. Section 2.0: Background The City has constructed a new 46,928 square feet facility for the Fort Collins Museum of Discovery. During the summer of 2012, the Museum will be installing exhibits in their Main Gallery in their new facility, per Gyroscope Exhibit Plan 0.1.0 (Phase 1&2) with the ultimate build-out as shown on Gyroscope Exhibit Plan 0.1.0. The exhibit lighting system has been designed to highlight the exhibits in the main and traveling galleries and provide lighting for the pathways through the exhibits. Section 3.0: Scope of Work The exhibit lighting shown in the Drawings LT-102a and LT-102B, prepared by Lightswitch Architectural, shall be installed accordingly. Drawings LT-103A through LT-103H provide detailed dimensions for locating each of the light fixtures. However, not all of the lighting shown on the plans shall be installed. All F1, F1EM and L1 fixtures shall be installed at 16’ AFF and all of the lighting track shall be installed with sufficient clearance above these fixtures throughout the Main Gallery. The F1 and F1EM fixtures shall be joined together to rigidly form the segmented curves shown throughout the galleries. Track heads to be supplied for the Main RFP 7389 Exhibit Lighting for the Fort Collins Museum of Discovery Page 3 of 144 Gallery shall not be installed. The track head quantities shown on LT-101 shall be disregarded and those shown in Exhibit B shall be followed. The lighting Relay Panels 1 and 2 shown on LT-101 were installed by the building construction contractor with conduits stubbed out from them into the Main Gallery. The cut sheets for these Lighting Control Panels are included in Exhibit C. The conduits stubbed out from the Lighting Control Panels will be extended to feed the lighting shown on the plans. All lighting shall be provided in accordance with the cut sheets provided in Exhibit C. All lighting in the Traveling Gallery will be considered as Alternates. Following are the exceptions to the plans:  Local Brewing – Eliminate 3-DW1 Fixtures and 4-T3 Heads;  Install JB’s for these DW1 Fixtures;  City Building – Eliminate 7 – T3 heads;  Voices & Perspectives - Eliminate 4 – T3 Heads;  Water, Sustainability & Energy – Eliminate 8 - T1 Heads and 28 - T3 Heads;  Live Animals - Eliminate 18 – T3 heads;  Trappers & Trackers – Eliminate 1- S2 Fixtures;  Funky Forest – Eliminate 3 – C1 Fixtures and 1 – L4 Fixture;  Media Experience – Eliminate 2 – L4 Fixtures and 2 – C1 Fixtures;  The Garage – Eliminate all Track;  Eliminate 2- DW5 Fixtures, 6 – C1 Fixtures, 4 – D6 Fixtures, 15 - T2 Heads and 4 – T3 Heads;  Early Childhood – Eliminate all Specialty Lights;  8 – L5 and 19 – S2 Fixtures;  Natural Areas – Eliminate 3 – C1 Fixtures. Traveling Exhibit and Exception Areas  Alternate 1 – Install 42 – F1 Fixtures in Traveling Exhibit  Alternate 2 – Install all TK3 Track in Traveling Exhibit  Alternate 3 – Supply 68 Total – T3a, T3b & T3c Heads for Traveling Exhibit  Alternate 4 – Deduct Track from the Exception Areas  Alternate 5 – Deduct 33 - F1 and 2 - F1EM Fixtures from the Exception Areas Section 4.0: Pricing In your written response to this proposal provide pricing to cover the following items: 1. Complete exhibit lighting package, as designed, without the exceptions preceding. 2. Installation costs. 3. Alternate pricing, as requested. RFP 7389 Exhibit Lighting for the Fort Collins Museum of Discovery Page 4 of 144 Section 5.0: Evaluation 5.1 Evaluation and Assessment of Proposal An evaluation committee shall rank the interested firms based on their written proposals using the ranking system set forth below. Firms shall be evaluated on the following criteria. The rating scale shall be from 1 to 5, with 1 being a poor rating, 3 an average rating, and 5 an outstanding rating. Recommended weighing factors for the criteria are listed adjacent to the qualification. The award may be made based solely on an evaluation of written proposals, or up to four firms may be selected for further evaluation via interviews/demonstrations. Such interviews/demonstrations shall be evaluated using the same criteria and rating method. Weighting Factor Qualification Standard 2.0 Scope of Proposal Does the proposal show an understanding of the project objective and results that are desired from the project? 2.0 Assigned Personnel Are sufficient people of the requisite skills assigned to the contract? 1.0 Availability Can the work be completed in the time frame required? Can targeted dates be met? 1.0 Motivation Is the firm interested and are they capable of doing the work in the required time frame? 2.0 Cost Are the costs presented reasonable? 2.0 Firm Capability Does the firm have the capability and experience to successfully complete a project of this type and scope? 5.2 Reference Evaluation (Top-ranked firms) The Project Manager will check references using the following criteria. The evaluation rankings will be labeled as Satisfactory / Unsatisfactory. 5.2.1 Qualification and Standard a. Overall Performance - Would you hire this company again? b. Timetable - Was the original Scope of Work completed within the specified time? c. Completeness - Was the company responsive to client needs? Did the company anticipate problems? Were problems solved quickly and effectively? d. Budget - Was the original Scope of Work completed within the project budget? e. Job Knowledge - Did company personnel exhibit the knowledge and skills necessary for the efficient completion of the Scope of Work? Section 6.0: Proposal Acceptance All proposals shall remain subject to initial acceptance 90 days after the day of submittal. You are the apparent successful Bidder and have been awarded an Agreement for 7389 Exhibit Lighting for the Fort Collins Museum of Discovery. The Price of your Agreement is ($ ). Three (3) copies of each of the proposed Contract Documents (except Drawings) accompany this Notice of Award. Three (3) sets of the Drawings will be delivered separately or otherwise made available to you immediately. You must comply with the following conditions precedent within fifteen (15) days of the date of this Notice of Award, that is by , 20 . 1. You must deliver to the OWNER three (3) fully executed counterparts of the Agreement including all the Contract Documents. Each of the Contract Documents must bear your signature on the cover of the page. 2. The City of Fort Collins (hereinafter called OWNER) and (hereinafter called CONTRACTOR) OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, agree as follows: ARTICLE 1. WORK CONTRACTOR shall complete all Work as specified or indicated in the Contract Documents. The Project for which the Work under the Contract Documents may be the whole or only a part is defined as the construction of the 7389 Exhibit Lighting for the Fort Collins Museum of Discovery. ARTICLE 2. ENGINEER The Project has been designed by Lightswitch Architectural. The City of Ft Collins Operation Services, who is hereinafter called ENGINEER and who will assume all duties and responsibilities and will have the rights and authority assigned to ENGINEER in the Contract Documents in connection with completion of the Work in accordance with the Contract Documents. ARTICLE 3. CONTRACT TIMES 3.1 The Work shall be Substantially Complete within fifty (50) calendar days after the date when the Contract Times commence to run as provided in the General Conditions and completed and ready for Final Payment and Acceptance in accordance with the General Conditions within ten (10) calendar days after the date when the Contract Times commence to run. 3.2. Liquidated Damages. OWNER and CONTRACTOR recognize that time is of the essence of this Agreement and that OWNER will suffer financial loss if the Work is not completed within the times specified in paragraph 3.1. above, plus any extensions thereof allowed in accordance with Article 12 of the General Conditions. They also recognize the delays, expenses and difficulties involved in proving in a legal preceding the actual loss suffered by OWNER if the Work is not completed on time. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR agree that as Liquidated damages for delay (but not as penalty) CONTRACTOR shall pay OWNER the amounts set forth hereafter. RFP 7389 Exhibit Lighting for the Fort Collins Museum of Discovery Page 12 of 144 1) Substantial Completion: One Hundred Dollars ($100.00) for each calendar day or fraction thereof that expires after the fifty (50) calendar day period for Substantial Completion of the Work until the Work is Substantially Complete. 2) Final Acceptance: After Substantial Completion, Fifty Dollars ($50.00) for each calendar day or fraction thereof that expires after the ten (10) calendar day period for Final Payment and Acceptance until the Work is ready for Final Payment and Acceptance. ARTICLE 4. CONTRACT PRICE 4.1. OWNER shall pay CONTRACTOR for performance of the Work in accordance with the Contract Documents in current funds as follows: Dollars ($ ), in accordance with Section 00300, attached and incorporated herein by this reference. ARTICLE 5. PAYMENT PROCEDURES CONTRACTOR shall submit Applications for Payment in accordance with Article 14 of the General Conditions. Applications for Payment will be processed by ENGINEER as provided in the General Conditions. 5.1. PROGRESS PAYMENTS. OWNER shall make progress payments on account of the Contract Price on the basis of CONTRACTOR's Application for Payment as recommended by ENGINEER, once each month during construction as provided below. All progress payments will be on the basis of the progress of the Work measured by the schedule of values established in paragraph 2.6 of the General Conditions and in the case of Unit Price Work based on the number of units completed, and in accordance with the General Requirements concerning Unit Price Work. 5.1.1. Prior to Substantial Completion, Owner will be entitled to withhold as contract retainage five percent (5%) of each progress payment, but, in each case, less the aggregate of payments previously made and less such amounts as ENGINEER shall determine, or OWNER may withhold, in accordance with paragraph 14.7 of the General Conditions. If , in the sole discretion of Owner, on recommendation of Engineer, Owner determines that the character and progress of the Work have been satisfactory to OWNER and ENGINEER, OWNER may determine that as long as the character and progress of the Work remain satisfactory to them, there will be no additional retainage on account of Work completed in which case the remaining progress payments prior to Substantial Completion will be in an amount equal to 100% of the Work completed. 95% of materials and equipment not incorporated in the Work (but delivered, suitably RFP 7389 Exhibit Lighting for the Fort Collins Museum of Discovery Page 13 of 144 stored and accompanied by documentation satisfactory to OWNER as provided in paragraph 14.2 of the General Conditions) may be included in the application Section 00520 Page 3 for payment. 5.1.2. Upon Substantial Completion payment will be made in an amount sufficient, if necessary, to increase total payments to CONTRACTOR to 95% of the Contract Price, less such amounts as ENGINEER shall determine or OWNER may withhold in accordance with paragraph 14.7 of the General Conditions or as provided by law. 5.2. FINAL PAYMENT. Upon Final Completion and Acceptance of the Work in accordance with paragraph 14.13 of the General Conditions, OWNER shall pay the remainder of the Contract Price as recommended by ENGINEER as provided in said paragraph 14.13. ARTICLE 6. CONTRACTOR'S REPRESENTATION In order to induce OWNER to enter into this Agreement, CONTRACTOR makes the following representations: 6.1. CONTRACTOR has familiarized himself with the nature and extent of the Contract Documents, Work, site, locality, and with all local conditions and Laws and Regulations that in any manner may affect cost, progress, performance or furnishing of the Work. 6.2. CONTRACTOR has studied carefully all reports of explorations and tests of subsurface conditions and drawings of physical conditions which are identified in the Supplementary Conditions as provided in paragraph 4.2 of the General Conditions. 6.3. CONTRACTOR has obtained and carefully studied (or assumes responsibility for obtaining and carefully studying) all such examinations, investigations, explorations, tests, reports, and studies (in addition to or to supplement those referred to in paragraph 6.2 above) which pertain to the subsurface or physical condition at or contiguous to the site or otherwise may affect the cost, progress, performance or furnishing of the Work as CONTRACTOR considers necessary for the performance or furnishing of the Work at the Contract Price, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents, including specifically the provisions of paragraph 4.2 of the General Conditions; and no additional examinations, investigations, explorations, tests, reports, studies or similar information or data are or will be required by CONTRACTOR for such purposes. 6.4. CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground RFP 7389 Exhibit Lighting for the Fort Collins Museum of Discovery Page 14 of 144 Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. No additional examinations, investigations, explorations, tests, reports, studies or similar information or data in respect of said Underground Facilities are or will be required by CONTRACTOR in order to perform and furnish the Work at the Contract Price, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents, including specifically the provision of paragraph 4.3. of the General Conditions. 6.5. CONTRACTOR has correlated the results of all such observations, examinations, investigations, tests, reports and data with the terms and conditions of the Contract Documents. 6.6. CONTRACTOR has given ENGINEER written notice of all conflicts, errors or discrepancies that he has discovered in the Contract Documents and the written resolution thereof by ENGINEER is acceptable to CONTRACTOR. ARTICLE 7. The Contract Documents also include all written amendments and other documents amending, modifying, or supplementing the Contract Documents pursuant to paragraphs 3.5 and 3.6 of the General Conditions. 7.6. There are no Contract Documents other than those listed or incorporated by reference in this Article 7. The Contract Documents may only be amended, modified or supplemented as provided in paragraphs 3.5 and 3.6 of the General Conditions. ARTICLE 8. MISCELLANEOUS 8.1. Terms used in this Agreement which are defined in Article I of the General Conditions shall have the meanings indicated in the General Conditions. 8.2. No assignment by a party hereto of any rights under or interests in the Contract Documents will be binding on another party hereto without the written consent of the party sought to be bound; and specifically but not without limitations, moneys that may become due and moneys that are due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment no assignment will release or discharge that assignor from any duty or responsibility under the Contract Document. 8.3. OWNER and CONTRACTOR each binds itself, its partners, successors, assigns and legal representatives to the other party hereto, its partners, successors, assigns and legal representatives in respect to all covenants, Agreement and obligations contained in the Contract Document.
