Dear Mr. Everhart,
Thank you for your time yesterday. Stephen McQuilkin, and I enjoyed meeting with you
to discuss the City’s planned Mason Corridor Bus Rapid Transit Improvements Project (the
“Project”). The purpose of this letter is to summarize our conversation and provide a brief run
down of the process going forward.
As we discussed, to accommodate the planned project improvements the City is
interested in acquiring a small permanent easement and a temporary construction easement
(where available) along the west property boundary.
While a number of project details are still outstanding, I understand that as a concept, you
are generally supportive of the Project. In regards to your specific property, I further understand
that there will be a number of Project challenges related to the close proximity of property
improvements to the Project improvements. Many of these challenges will not be resolved until
a project designer furthers the design in this area; however, as the acquisition process unfolds, it
would be appropriate to have further conversations related to your concerns.
The next stage in the acquisition process is to present an Ordinance to City Council on
December 1, 2009, requesting authorization to use eminent domain for the Project, if necessary.
As was expressed to you in person, this is an option of last resort and one the City does not take
lightly. The City fully intends to negotiate in good faith with all affected owners. Only in the
event that negotiations breakdown will the City consider the use of eminent domain, in order to
assure a timely and efficient project.
After the Ordinance is approved by City Council, you will receive a “Notice of Intent to
Acquire” letter. The purpose of this letter is to officially notify you of what property interests the
City will need to acquire for the Project. It will also include the legal descriptions and location
sketch for these interests. A real estate appraiser, Bonnie Roerig of Bonnie Roerig & Associates,
LLC, will then be scheduled to contact you to obtain permission to inspect your property. If the
acquisition has an estimated value of $5,000 or more the City will pay the reasonable cost of a
separate appraisal of the property by an appraiser chosen and hired by you subject to the
following conditions:
The estimated value of the property to be acquired is $5,000 or more;
The appraisal is made using sound, fair and recognized appraisal practices; and
The appraisal is submitted to the City in accordance with Section 38-1-121 C.R.S. of
the Colorado Revised Statutes.
Once the City receives Bonnie Roerig’s completed appraisal, we will provide you with a
written offer for the property interests that the City needs to complete the Project. We will then
contact you to discuss the offer and work to negotiate a fair purchase price.
