Box 580 300 LaPorte Avenue Fort Collins, CO 80521 970.416.2276 970.416.2209 – fax fcgov.com HAND DELIVERED November 18, 2009 Brian Mowery Mowery Development, LLC 4315 South Mason St. Fort Collins, CO 80525 RE: Mason Corridor – Bus Rapid Transit Improvements Project Mason Express (“MAX”) Fee Owner: Mowery Development, LLC Property Address: 4315 South Mason Street, Fort Collins Dear Mr. Mowery, Thank you for once again for your time earlier this week. Stephen McQuilkin, Mike Morgan, and I enjoyed meeting with you again to discuss the City’s planned Mason Corridor Bus Rapid Transit Improvements Project (the “Project”). The purpose of this letter is to summarize our conversation and provide a brief run down of the process going forward. As we have previously discussed, to accommodate the planned project improvements the City is interested in acquiring a strip of right-of-way, a permanent easement and a temporary construction easement along the rear of your property. The City understands that your chief concerns relate to the design and coordination of proposed improvements and there impacts to the function of your business. Project staff is encouraged with your hands on involvement, as this is the best way to understand the particulars of your site and business. The next stage in the acquisition process is to present an Ordinance to City Council on December 1, 2009, requesting authorization to use eminent domain for the Project, if necessary. As was expressed to you in person, this is an option of last resort and one the City does not take lightly. The City fully intends to negotiate in good faith with all affected owners. Only in the event that negotiations breakdown will the City consider the use of eminent domain, in order to assure a timely and efficient project. After the Ordinance is approved by City Council, you will receive a “Notice of Intent to Acquire” letter. The purpose of this letter is to officially notify you of what property interests the City will need to acquire for the Project. It will also include the legal descriptions and location sketch for these interests. A real estate appraiser, Bonnie Roerig of Bonnie Roerig & Associates, LLC, will then be scheduled to contact you to obtain permission to inspect your property. If the acquisition has an estimated value of $5,000 or more the City will pay the reasonable cost of a separate appraisal of the property by an appraiser chosen and hired by you subject to the following conditions:  The estimated value of the property to be acquired is $5,000 or more;  The appraisal is made using sound, fair and recognized appraisal practices; and  The appraisal is submitted to the City in accordance with Section 38-1-121 C.R.S. of the Colorado Revised Statutes. Once the City receives Bonnie Roerig’s completed appraisal, we will provide you with a written offer for the property interests that the City needs to complete the Project. We will then contact you to discuss the offer and work to negotiate a fair purchase price. Please feel free to contact me at 224-6127 if you have any questions or concerns, or Steve McQuilkin at 416-2484 for any design specific questions. Sincerely, Patrick Rowe City of Fort Collins Real Estate Services 970.224.6127 prowe@fcgvov.com
