Dear Mr. Holter,
As we discussed over the phone on November 5th, due to a legal description mistake, City Staff
will be re-submitting the legal description for the proposed purchase area over the L Triple H B
property at 4001 S. Mason Street, Fort Collins to City Council on December 1, 2009 for
condemnation authorization. Again, authorization only indicates that condemnation would be an
available option should good faith negotiations break down, which we do not anticipate.
The delay that this legal description mistake has caused will create a similar delay in the
acquisition process. I anticipate that the Project appraiser will begin appraising both your Mason
Corridor properties in mid January.
