SERVICES AGREEMENT
Facility Video Security System
Pilot Project, Video Management System Implementation, Camera Conversion
THIS AMENDMENT to the AGREEMENT is made and entered into by and between THE CITY
OF FORT COLLINS, COLORADO, a Municipal Corporation, hereinafter referred to as the "City"
and COLORADO SYSTEMS GROUP, Inc., hereinafter referred to as "Service Provider".
Background to the Amendment
During contract negotiations, the Service Provider and the City contract officer relied on a Davis
Bacon Wage schedule published in late 2010. On February 27, 2012 a new wage schedule
was published. The City contract officer noted the new schedule and entered it into the
Agreement, neither he nor the Service Provider realized that the increase in wages, especially
for the Electrician trade, was substantial. The Agreement was executed on March 3, 2012 and
the Service Provider did not realize the specified wage rates had been updated at the time.
Electrician wages increased from $24.59 plus $8.09 for fringes to $31.60 and $12.52. This
represents a 35% increase in wages, which would have a serious effect on the Service
Provider's project costs.
According to the FTA Best Practices Manual (BPPM):
"If the effective modification is not received by the contracting officer until after award, the
contracting officer must modify the contract to incorporate the wage modification retroactively to
the date of contract award and equitably adjust the contract for any increased or decreased cost
of performance resulting from any changed wage modifications."
Though the City's contract officer was aware of the new wage schedule and included it in the
Agreement, he did not realize how much the wage rates had increased. The previous wages
had been specified several months before, in Addendum #1 to the original RFP, published in
August, 2011.
Since the mandated increase in wages is not a change in Scope, this Amendment was created
to enter the revised Service Provider labor costs into the Agreement, per FTA BPPM.
