Trinidad State Junior College, herein referred to as the “College”. and Trinidad State .1 unior College Educational Foundation. a non—profit Colorado corporation that has been corflmunicalilIg with the City regnTing any concerns related to the Fund and related to any recipient s adherence to the criteria set forth below. C. The Foundation will transfer monies from the Fund to the scholarship recipient’s studeni account in three installments upon the recipient s successful completion of the requii-ed course goals at five weeks, ten weeks, and fifteen weeks. TI the scholarship recipient fails to meet the required criteria, the. Foundation will immediately notify the City and the Foundation shall not transfer funds from the. Fund to the scholarship recipient’s student account. Also, if the scholarship recipielit receives two unexcused absences during the 15 week course, the Foundation or the College must immediately notify the City in writing. 1). lithe following criteria are not met by a scholarship recipient, the Foundation shall not transfer monies from the Fund to the scholarship recipient’s student account: I) Complete a scholarship applicatioru and 2) Complete, execute and submit a Family Rights and Privacy Act of 1974 Release Form authoriiing Trinidad Slate Junior CollegciRMLS to release all of Scholarship Recipient’s student education records and information to the City within 7 days of starting the electric lineworkei- training program: and 3) Successful completion of fitness-for—duty examination and background: and check by the City: and 4) Maintain a 2.0 grade point average while attending RMLS; and 5) Maintain a sufficient attendance record while attending RMLS. An insufficient attendance record occurs when a scholarship recipient has three or more unexcused absences. An excused absence occurs when scholarship recipient notifies instructor of absence prior to 8:00 A.M. and the instructor determines the reason for absence to be legitimate. An unexcused absence occurs when scholarship recipient does not notify instructor of being tardy before 8:00 A.M., or does not notify instructor about absence or reason offered for absence is not acceptable to the instructor and 6) Scholarships arc [tot required to he awarded. If a recipient fails 1:0 meet all criteria, the Foundation will cease transferring funds from the Fund to the scholarship recipient’s student account and the Foundation will maintain any remaining balance in the Fund for possible future award: and 7) A letter of acknowledgment and thanks must he received by the City via the Foundation office before funds will be distributed. IV. I. PURPOSE The Foundation agrees to maintain the City of Fort Collins Scholarship Fund as a current temporarily restricted asset, for the purpose of awarding annual scholarships to full—time students accepted in Rocky Mountain Lineman School (“RMLS” at Trinidad State Junior College. Students attend the RMLS in Colorado Springs. Colorado. II. SCH1DULE AND FORM OF CONTRIBUTTONS if the City notifies the Foundation that ii has selected a scholarship recipient in a given year, the City agiees to contribute the sum of $8,000 by December 3 1 that same year to fund payment of expenses as described below tbr the scholarship recipient’s attendance at RMLS in January through April of the following year. The City shall have no obligation to annually fund the City of Fort Collins Scholarship Fund. The City’s financial obligations under this agreement are contingent upon the annual appropriation, budgeting, and availahilfty of specific funds to discharge those obligations. Nothing in the agreement shall create a payment guaranty to the Foundation or Trinidad State Junior College or a debt or a multi-year fiscal obligation under the Colorado Constitution or any similar provisions of the City’s charter or ordinances. Further, the City may notify’ the Foundation in writing at any time that it elects to discontinue the City of Fort Collins Scholarship Fund (the “Fund”). If there are monies in the Fund at. the time the City elects to discontinue the Fund. the Foundation will remit those funds to the City within 30 days of notice from the City that it has elected to discontinue the Fund. III. ADMINISTRATION A. Gifts are to be made payable to the Trinidad State Junior College Educational Foundation, a 501 (c)(3) organization under IRS guidelines which is charged with soliciting, receiving, investing, and disbursing private gifts for the benefit the College and its students.
