Dear Patrick:
Walsh Environmental Scientists and Engineers, LLC (WALSH) is pleased to present this proposal to conduct
a Modified Phase I Environmental Site Assessment (ESA) for the above -referenced property. WALSH will
conduct the assessment in general accordance with ASTM International (ASTM) Standard E1527-05 for
conducting Phase I ESAs. WALSH understands that the City does not presently have right access to the
subject property. Therefore, the ASTM process will be modified and the physical inspection of the subject
property will be performed from readily available public right of ways.
A Phase I ESA is designed to identify recognized environmental conditions. The term recognized
environmental conditions means the presence or likely presence of any hazardous substances or
petroleum products on a property under conditions that indicate an existing release, a past release, or a
material threat of a release of any hazardous substances or petroleum products into structures on the
property or into the ground, groundwater, or surface water of the property. No sampling of suspect air,
soils, waters, wastes, or building materials is included in this bid.
The costs to conduct the Modified Phase I ESA will be billed on a fixed -price basis of $3,000. The report can
be completed within approximately three weeks from receipt of written notice to proceed. This cost and
timeframe are based upon timely receipt of information from the user of the Modified Phase I ESA, readily
available access to the property for the visual inspection, and full cooperation with the current
owner(s)/occupant(s). Attached is a written scope -of -work to be performed and the projects terms.

SCOPE OF SERVICES
Modified Phasel Environmental Site Assessment:
BNSF Railway Property, Parcel Number 97234-00-807, Fort Collins, Larimer County, Colorado
The scope of WALSH's services will include the following tasks:
Task 1. Records Review
The records review will provide information on the physical setting of the site and activities on the site in
the surrounding area which may have had an adverse impact on the property. This task includes review of
the records identified below.
Physical Settine Sources
At a minimum, the latest USGS 7.5-minute topographic map for the site will be reviewed to determine site
topography and likely contaminant migration pathways (e.g. surface water and groundwater). In addition,
other readily available sources will be reviewed including USGS and/or State geologic maps and
groundwater maps.
Environmental Database and Records Review
An environmental database report for the site will be obtained which includes searching the following
records and minimum search distances (per ASTM standard requirements):

As necessary, readily available/electronic versions of selected files for facilities identified in the
environmental database report will be reviewed to evaluate environmental impacts to the site. If
supplemental file review activities at the physical location of appropriate government agencies are
determined to be warranted, this task would be completed on a separate time and materials basis.
Historical Records Review
The records review will also include a review of historical records to identify, if possible, obvious uses of
the site back to its first developed use or to 1940, whichever is earlier. The historical sources consulted
may include any or all of the following, as well as other records necessary to satisfy the objectives of the
ASTM standard:

available city or county planning, zoning and building records, historic Sanbom maps, and
historic topographic maps;
• local, state and federal regulatory agencies records for public information related to
possible hazardous material releases on the subject and surrounding properties;
available historical aerial photographs.
Task 2. Site Inspection/Interviews
A physical inspection of the subject property will only be conducted from public right of way areas. In
addition, to the extent possible a physical inspection of adjacent properties will also be conducted to
complement the findings of the records review, to identify past and present land use practices, and to
identify potential environmental liabilities. This task will:
identify visual indications of environmental contamination, land use practices, waste
materials, suspect building materials, and other potential liabilities on the subject site and
adjacent properties;
examine any transformers located on site for conspicuous leaks involving potential PCB
containing fluids;
to the extent possible based on the interview, document current and past chemical usage
and waste management on the property;
obtain photographic documentation of the current site conditions and pertinent site
features.
A representative of the owner(s) and/or occupant(s) will be interviewed or asked to complete a site -specific
questionnaire. Interviews or questionnaires will also be completed/requested from the user of the ESA,
state and local government officials, and (if necessary) other individuals with knowledge of the site such as
current employees or past owners, operators, or employees.
Task 3. Report
The final report will compile the findings of the investigation along with copies of relevant documents as
exhibits. The report will at a minimum:
• present factual information and WALSH's professional opinion regarding the presence or
absence of contamination at the subject properties;
provide documentation of all Modified Phase I ESA activities;
include a statement of assumptions used in conducting the assessment and a review of its
limitations;
provide a discussion of data gaps in the report and their significance;
present recommendations for further investigations, sampling, or corrective actions, if any.
WALSH will provide two bound copies and. one electronic (Adobe PDF format) version of the report.

By accepting this proposal, the client agrees to the following:

/. User Responsibilities. ASTM Standard E1527-05 requires that the user of the ESA
perform certain tasks associated with the Phase I ESA, and provide the information
obtained to the environmental professional conducting the Phase I ESA. The client
agrees to provide the following information to WALSH prior to the site reconnaissance
performed by WALSH:
• Actual knowledge the client has regarding any Environmental Liens or Activity and Use
Limitations in connection with the property.
• Any specialized knowledge or experience of the client that is material to recognized
environmental conditions in connection with the property
• If the purchase price of the property does not reflect the fair market value the property
because of known or suspected contamination on the property
• Any commonly known or reasonably ascertainable information about the property that the
client is aware of within the local community that is material to recognized environmental
conditions in connection with the property.
The client must also undertake a review of title and judicial records for Environmental Liens or
Activity and Use Limitations in connection with the property of the ESA. Any Environmental
Liens or Activity and Use Limitations identified by the client will be reported to WALSH.
Failure to complete these activities and provide the information obtained to WALSH may
result in a determination that the all appropriate inquiry is not complete.
