Bid 7168, Boiler Replacement
Date: 10/29/ 10
Per Article 15 of the General Conditions, SUSPENSION OF WORK AND
TERMINATION, and specifically 15.2, OWNER MAY TERMINATE, the City is
issuing seven (7) days written notice to Standard Renewable Energy to complete the
work as identified in the scope of work from the agreement dated September 9, 2010.
That means that substantial completion must be complete by November 6, 2010.
After November 6, 2010, if the work is not complete, the City may terminate the
agreement; take possession of the Work and all of the Contractors tool, appliances,
construction equipment and machinery at the site.
Following is the timeline of the project and documentation for the work completed as of
10-28-10 for the Boiler work being done for Operation Services and for the Museum.
The "Notice To Proceed" was issued to -Standard Renewable Energy (SRE) to begin on
1015110 with a Substantial Completion Date of 10/22/10 per the agreement dated
September 9, 2010. This date was arrived to per the City of Fort Collins phone
conversation with SRE. In this conversation it was agreed upon that Substantial
Completion would mean that we would have heat in the buildings. Then this would give
SRE time to do the final trim out of the boilers/hot water heaters.
Demolition work / abatement, for the Museum, began on 10/6/10. This work was
completed by 10/8/10. The demolition work of the boiler at Operation Services began on
10/11/10 and was completed by 10/13/10.
The Museum has been without heat and hot water since the demolition day of 10/6/10
and still does not have either one as of the writing of this letter. Operation Services has
been without heat since the start of the demolition, 10/11/10, and still does not have heat
as of the writing of this letter. The hot water was off from 10/11/10 until 10/20/10. The
new hot water heater was changed over to an electric one and could have been installed at
any time.
The boiler for the Museum was set on 10/8/10. It was noticed on 10/11/10 that the boiler
did not have the drawing required 4" housekeeping pad. Contractor did not feel this was
needed. Because of the tight schedule that we were all under, the City of Fort Collins was
willing to work with SRE to keep the schedule moving. The City of Fort Collins asked
that the housekeeping pad be installed at Operation Services per the drawings. It was
acknowledged by the crew of 3 that they did not have the drawings for the work, on site.
That is why they missed the installation of the housekeeping pad.
During the week of 10/11/10, SRE's Project Manager was in Chicago and was not at the
job site. He was available by phone and email. During this week the boiler for the
Museum was piped in. City of Fort Collins asked the Engineer, Beaudin-Gauze (B-G), to
do a Field Observation of the work that was being done in the Museum. This observation
was done on 10/18/10. During this observation it was observed that the boiler was not
piped in correctly and per the drawings. This was noted on B-G's report dated 10/20/10.
As a result, the existing work that was done by SRE had to be removed and reconfigured
to follow the drawings. This was completed in time for B-G to do another field
observation by the end of the day on 10-19-10. It was here that B-G approved of the fixes
for the boiler at the Museum. Also, during the week of 10/11/10, the fire alarm was set
off by SRE. This caused the Poudre Fire Department to come to the job site. Poudre Fire
asked SRE to cover the smoke sensors when they are doing there work during the day. At
the end of the day, they need to remove the cover on the sensor.
Up until 10/18/10, the contractor typically had a crew of 3 working on the job. They
would move between the Operation Services building and the Museum. On 10/19/10 and
10/20/10 there was 1 pipefitter working that was noticed. When asked why the crew was
smaller, the City of Fort Collins was told that the other 2 employees were pulled from the
job to go to another job in Silverthorn. SRE was asked to provide more employees and
since 10/20/10, there have been, on average, 3 to 4 employees on the job. At the end of
the week of 10/18/10, the Project Manager stayed on site to bring more control to the job.
He has been on site, with the exception of 10/26/10, since then. Before 10/20/10, he was
not observed on site more then 2 to 3 times.
SRE and the Raypak salesman attempted to start the Museum boiler on 10/27/10. This
work began at Noon and was called off at 5:00 pm because the controller for the boiler
was damaged. During this time the boiler experienced a water leak as well. As of
10/28/10 the boiler is not up and running.
Work for the boilers at Operation Services began on the week of 10/15110. The City of
Fort Collins asked SRE to make sure that the housekeeping pad was poured. This was
done on 10/15110. It was noticed by the City of Fort Collins that the pad was 2" out of
square. This would become an issue during the layout of the boilers.
Because of the past experience on the Museum boiler, the City of Fort Collins asked B-G
to do a field observation for Operation Services to make sure the installation was being
done correctly. This was done on 10/25/10. It was observed that the piping would need to
be changed so that it was followed per the drawings. This was noted on B-G's report
dated 10/26/10. During this observation SRE said that they would like to utilize the
existing flue of the building. This would require a special liner in order to work. B-G and
the City of Fort Collins asked for more information and pricing, from SRE, to see if this
would be acceptable. We were told that we would have this information by 10/26/10 to
make a decision. As of 10/28/10, we have not received any information on this and the
boilers are not operational. The City of Fort Collins has scheduled B-G to do a field
observation on 10/29/10 to check the boilers at Operation Services.
Since the job was not close to be ready for the Substantial Completion date of 10/22/10.
The City of Fort Collins issued Change Order #1 to SRE, at no cost adjustment, for a
0 0
Substantial Completion date of 10/29/10. As of the writing of this letter, neither building
has operational boilers. Because the buildings have not -had any heat, the City of Fort
Collins has had to use personal heaters to warm the buildings. 16 extra heaters were
purchased along with 8 heaters used from storage. The weather became very cold on
10/26/10 and 10/27/10. The City of Fort Collins rented a portable heater from Sunstate
Rentals to be used to heat Operation Services.
In total to 10/28/10, the Operation Services building has not had heat for 18 calendar
days. The Museum has not had heat for 23 calendar days.
SRE will provide the City of Fort Collins a "Day by Day" working schedule up until the
Completion Date of 11/6/10. In this schedule, SRE will show the Raypak start-up date for
the Operation Services boilers so that the City of Fort Collins can have a Mechanical
Technician on site in case of emergency. This schedule will also highlight the day when
the Museum will have heat and when Operation Services will have heat.
